Terms of Use for Lucidity Level

1. Acceptance of Terms

By downloading, installing, accessing, or using Lucidity Level (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Lucidity Level is a lucid dreaming and sleep-awareness application for iPhone. The App may include features such as:

• Dream journaling

• Sleep tracking integrations

• Smart alarms and reminders

• Progression systems, levels, quests, and statistics

• Personalized insights

• Cloud synchronization

• Premium subscriptions and in-app purchases

Features may change over time without notice.

3. No Medical or Psychological Advice

Lucidity Level is not a medical device and does not provide medical, psychiatric, psychological, or sleep disorder advice.

Any sleep-related insights, dream analysis, wellness content, or tracking features are provided solely for informational and entertainment purposes.

The App is not intended to diagnose, treat, cure, or prevent any medical or mental health condition.

You should consult a qualified healthcare professional regarding any medical, psychological, or sleep-related concerns.

Use of the App is at your own risk.

4. HealthKit and Health Data

If you grant permission, the App may read sleep-related data from Apple HealthKit, including sleep duration and sleep schedule information.

The App does not write health data to Apple Health unless explicitly stated within the App.

Health data is used solely to support app functionality and personalization.

All HealthKit access is subject to:

• User-granted permissions

• Apple’s HealthKit policies

• Apple’s privacy and security requirements

Health data is not sold to third parties.

5. iCloud Sync and Data Storage

The App may use Apple iCloud services to synchronize data such as:

• Dream journal entries

• App settings

• Progression data

• Subscription-related state

• Other user-created content

By enabling iCloud sync, you acknowledge that:

• Your data may be stored on Apple-operated infrastructure

• Synchronization reliability depends on Apple services and device connectivity

• The developer is not responsible for data loss caused by iCloud outages, device failures, account issues, or user actions

You are responsible for maintaining access to your Apple ID and iCloud account.

6. User Content

You retain ownership of any dream journal entries, notes, or other content you create within the App.

You agree not to use the App to store or distribute:

• Illegal content

• Harassing or abusive material

• Content that infringes intellectual property rights

• Malware or harmful material

The developer does not actively monitor user-generated content.

7. Subscriptions and In-App Purchases

The App may offer:

• Auto-renewing subscriptions

• Lifetime unlocks

• One-time purchases

• Premium feature access

All purchases are processed through Apple’s App Store.

Subscription Terms

• Payment will be charged to your Apple ID account at confirmation of purchase

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You may manage or cancel subscriptions through your App Store account settings

Pricing may vary by region and may change in the future where permitted by law.

The developer does not collect or store payment information.

8. Free Trials and Promotional Offers

The App may occasionally offer free trials or promotional pricing.

Unless cancelled before the trial ends, subscriptions automatically convert to paid subscriptions according to the pricing displayed at signup.

Eligibility for promotional offers is determined by Apple and/or the App.

9. User Responsibility

You are solely responsible for:

• Maintaining your device and account security

• Backing up important data where appropriate

• Ensuring device permissions are properly configured

• Reviewing dream journal content before storing sensitive information

• Managing your subscription settings

The developer is not responsible for:

• Lost or corrupted data

• Interrupted synchronization

• Device incompatibilities

• Apple service outages

• Operating system limitations or behavior

10. No Guarantee of Availability

The App is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, the developer makes no guarantees regarding:

• Continuous availability

• Accuracy of insights or analysis

• Reliability of notifications or reminders

• Compatibility with all devices or operating system versions

• Error-free operation

Features may be modified, suspended, or discontinued at any time.

11. Intellectual Property

All App content, including but not limited to:

• Branding

• Design

• Graphics

• Animations

• Audio

• User interface elements

• Software code

• Progression systems

• Written content

are owned by the developer or licensed appropriately and are protected by intellectual property laws.

You may not:

• Copy

• Reproduce

• Reverse engineer

• Redistribute

• Modify

• Create derivative works

without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, the developer shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

• Use of the App

• Inability to use the App

• Data loss

• Health-related decisions

• Reliance on App insights or statistics

In no event shall the developer’s total liability exceed the amount paid by you for the App or related purchases during the previous twelve (12) months.

13. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, liabilities, costs, and expenses arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of applicable laws

• Your infringement of third-party rights

14. Termination

These Terms remain effective while you use the App.

The developer may suspend or terminate access to the App if:

• You violate these Terms

• Your use creates legal or security risks

• Required by law

15. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the courts of New Zealand.

16. Changes to These Terms

The developer may update these Terms from time to time.

Updated versions will be posted within the App or associated website/services.

Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
