If one or both spouses wish to end their marriage, they may file for a divorce.
To begin the divorce process, the parties should contact a solicitor, who can assist with the necessary legal proceedings.
While both parties may seek legal representation, a solicitor cannot represent both parties.
The Court encourages parties to resolve matters relating to property, finances, and child custody amicably whenever possible.
Reaching an agreement may help simplify the divorce process. If the parties are unable to agree on matters relating to the divorce, including the division of assets or custody arrangements, the Court may be required to make a determination on those issues.
A divorce becomes effective only once it has been formally granted and finalized through the appropriate legal process.
Upon finalization of the divorce, either party may choose to revert their surname to the name held prior to the marriage at no cost.
