LooksLikeVespa’s Terms of Service for 3D Models Commissions

This Freelance Artist agreement, outlines terms and services (TOS) between LooksLikeVespa (the Artist), and “the client” (defined. Buyer).

If thereafter, the Artist and the Buyer desire to establish the terms and conditions under which the Artist will provide services to the Buyer.

The parties agree as follows:

1. Scope of Work. Artist agrees to perform such consulting, advisory and related services related to the project (s). 

Custom Work: The Artist provides custom 3D models and such they shall do to the best of their ability to replicate the Buyer’s specifications. The Buyer must provide any and all information the Artist requires to complete their work. The Artist will send: Works in Progress (WIP) for the Buyer to approve of before completing the project.

2. Term. This Agreement shall commence from the date this Agreement is agreed upon by both parties and shall continue until the scope of work is completed or if the Artist has terminated the project. 

3. Payment. 

a. Service Cost. In consideration of the Service, the Buyer will pay the Artist of €  the "Service Cost"). 

b. Expenses. The 3D Artist shall be responsible for all business expenses incurred by the Artist in connection with, or related to, the performance of the services. 

c. Invoices. The Client shall pay to the Artist amounts shown on each statement or invoice described in Section 3(a) and 3(b) within (x) days after receipt thereof or within an outlined payment plan which will have been discussed between the Artist and Buyer.

Full cost of project

d. Payment method: The Artist uses Paypal only. 

4. Termination of Project. The Artist reserves the right to terminate the project / contract at any time for any reason. 

5. Broken Parts

a. Replacement and Repair. The projects which the Artist sells are made from non-industrial grade resin and as such breakage of projects may or can occur. The Buyer must reach out to the Artist to discuss if it is within the Artist’s scope to repair or replace what has been broken. This includes but not limited to: 

Swords, glaves, other weapon

Model Joints

Limbs

Clothing

a.1.1 Buyers are responsible for paying shipping costs for replacement parts. 

a.1.2. The Artist has the right to waive this fee.

B. Models/statues that have been left in the sun and received damage (outlined in Artist Expectation of Buyer) are not eligible for a refund.

6.Refunds

a. Refunds. Refunds shall be given only if Section 5 of this agreement is no longer an option. Stipulations apply.

b. Obtaining Refunds Proper refunds must include: documentation of shipping box conditions, such as pictures, videos and time of date noted. Photos and video must include the model in question. The more information the Buyer provides, the quicker a resolution will be had.

c. Buyers Remorse. Completed projects are not subject to refunds.

7. Shipping 

a. Shipping Costs. This will be calculated and added to the total cost of the payment to be paid in full by the Buyer.

b. Shipping Delays. The Artist is not responsible for any delays by local Postal Services. A tracking number is provided where applicable. 

c. Package Returns. If the package is returned to the Artist due to a. wrong address given, b. failure to retrieve the package in a timely manner, or c. or for reasons unlisted, the Buyer has the options to pay the shipping fee again, or cancel the order after the Artist has received the package, not before. 

7. Warranty: Free replacement of parts outlined in 5a, if there are breaks during shipping or resin becomes brittle or “melting” occurs within six (6) months.

Artist Expectation of Buyer

1. DO NOT PUT STATUES/MODELS IN DIRECT SUNLIGHT FOR EXTENDED PERIODS OF TIME. THIS INCLUDES PRE-MADES AND CUSTOM MODELS.

As outlined in 5a the resin used is non-industrial grade and as such can succumb to normal wear and tear, however, it is advised models and statues remain in a cool, dimly lit area to prevent damage. 

Buyers understand that what they are ordering from the Artist are not toys and should not be used in a manner beyond their purpose. 

The Art expects the Buyer to have read and understand the TOS as written.
