By installing the Loca mobile application (the “App”) linking to this privacy policy (the “Privacy Policy” and “Affiliated Application”), you are agreeing to comply with, and be bound by, the following Privacy Policy, and when applicable any other Loca Mobile Application operating rules policies, and other supplemental terms and conditions or documents that may be published from time to time. Please review the Privacy Policy carefully.
General
This Privacy Policy outlines the privacy practices associated with the Loca mobile application Service and covers our treatment of personal information that we collect when you install a mobile application that uses our Service. Please note that we are not responsible for and have no control of any mobile application’s (including the Affiliated Application’s) privacy practices and have no control over how the developer of a mobile application collects, uses or shares information about you. Service Overview
The app is a trend browsing application that allows users to review trends and topics, searches of others around them.
Features
The app is used based only on Loca mobile application, without logging in with social account (anonymous state) The Mobile app is an anonymous service where users will not be able to see other user’s details. The app also collects social account names, i.e. it is an anonymous service, and user will not know who of his/her friends made a search and got a result.
Your Affirmative Opt-in Consent
The App requires the sharing of both your anonymized and personal information with affiliated third parties for processing, servicing, preventing fraud, joint marketing, marketing, analytics and improving the App, and other activities. We also work with non-affiliated third parties to engage in marketing activities and to perform services on our behalf as described below. However, we will not share your personal information with, or sell your personal information to, any non-affiliated third parties for their own marketing purposes without your consent; rather, we use your anonymized data to identify a range of goods and services offered by non-affiliated third parties that may be of interest to you. By downloading our App, you are affirmatively opting-in and giving your affirmative consent to us to disclose your personal information, including personal financial information to affiliated and non-affiliated third parties as described herein.
Information We Collect Directly From You
We require you to register to use the App. To register, we will collect your name, email address, and log-in credentials. After registration, certain features of the App are available to all registered users (“Users”).Users and Members are referred to collectively as "Customers."
You are required to provide us with some personal information to be able to use the functions offered in the App. The type of information and how much you provide to us is up to you and will depend on your desired interactions with the App. If you do not want us to use this information you should not download and use the App. Loca Application Members may also use our App to interact with their Member Portal. Other examples of information you may elect to share with us include:
Contact information (in addition to your name and email address, which are required, you may provide your and phone number)
Identification numbers and cards (e.g., driver’s license number)
Social Security number
Photographs and images that you upload
Any other information that you choose to provide to us
Loca Application Information: When you use our services, including our mobile apps, we may collect information about your mobile usage . For example, we may collect information about your precise location using GPS, wireless networks, cell towers, Wi-Fi access points, and other sensors, such as gyroscopes, accelerometers, and compasses
Information We Collect Automatically
We and our third party providers will track user interaction with our App. If you do not want us to collect this information from you, please do not use our App. Through various technologies (which may include cookies or similar programs designed to work with mobile apps) we will collect:
Device ID or alternative ID where required by the platform provider
Length of time spent on our App, what features you use, where you click within our App
Installations
Clicks
Gestures
Loca Application information
Other aggregate, non-personally-identifying and/or statistical information about usage
Information We Collect About You from Other Sources
We may obtain information about you from third party sources, such as the companies we work with to provide service to you (i.e., our service partners), affiliates, data aggregators or other public databases. We may combine the information that we collect about you from whatever source.
Social Media
The App may make third-party social-media features (Twitter, Facebook) available to its users. We cannot ensure the security of any information you choose to make public in a social-media feature. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information in these areas.
How Do We Use Your Information?
In general, we use your information to provide and improve our services, to communicate with you, for advertising, to send you offers and other promotional information, and for other related purposes. For example, we use your information, including your personal information (collectively, “information”) for the following purposes:

To understand how you use our App (including features used most frequently), and to improve our App and our services
If you opt-in, to send you SMS texts and/or alerts/push notifications about your account (for example, the information that we collect automatically from you enables us to determine where to send your push notifications)

Sharing Your Information
We do not share or sell your personal information to non-affiliated third parties for their own marketing or business purposes, unless you consent. Service providers: such as entities that assist us with consulting, marketing, advertising, information technology, App usage, analytics, and any other services that we use in our operations

Control over Your Information
We want you to be in control of your information, so we provide you with the following tools.
Access and Updates. We strive to let you access and update most of the personal information that we have about you. There are limits though to the requests we’ll accommodate. We may reject a request for a number of reasons, including, for example, that the request risks the privacy of other users, requires technical efforts that are disproportionate to the request, is repetitive, or is unlawful. You can access and update most of your basic account information right in the app by visiting the app’s Account page. If you need to access, update, or delete other personal information that we may have, you can put in a request here. Because your privacy is important to us, we may ask you to verify your identity or provide additional information before we let you access or update your personal information. We will try to update and access your information for free, but if it would require a disproportionate effort on our part, we may charge a fee. We will of course disclose the fee before we comply with your request.
Revoking Permissions. If you change your mind about our ongoing ability to collect information from certain sources that you have already consented to, such as your phonebook or location services, you can simply revoke your consent by changing the settings on your device if your device offers those options. Of course, if you do that, certain services may lose full functionality.
Account Deletion. While we hope you’ll remain a lifelong user, if for some reason you ever want to delete your account, just send us an email to team@qbesta.com or use a contact us page.
What Choices Do I Have?
Notifications. You may have the option of receiving certain status alerts through push notifications and/or SMS text messages. If you choose to opt-in to receive these text messages, we will notify you when a status alert has been posted to your account, and you can log into your account and/or email to read the notification. You may cancel these notifications at any time by changing the settings in the App.
Email Advertising. You may receive marketing messages and materials from us or our affiliates. You may opt-out of the marketing emails by following the instructions in the email and/or by contacting us as noted in the "Contact Us" section below. If you opt-out of email marketing, please note that we may continue to contact you via email regarding your services; we also may continue to market to you through other marketing channels.
The Services are Available “AS-IS”
YOU UNDERSTAND AND AGREE THAT USE OF THE COMPANY APPLICATIONS AND SERVICES ARE AT YOUR OWN RISK. YOU UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS. WITHOUT LIMITING THE FOREGOING, TO THE MAXIUMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE LOCA MOBILE APPLICATION DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE LOCA MOBILE APPLICATION MAKE NO WARRANTY OR REPRESENTATION AND DISCLAIM ALL RESPONSIBILITY AND LIABILITY FOR: (I) THE COMPLETENESS, ACCURACY, AVAILABILITY, TIMELINESS, SECURITY OR RELIABILITY OF THE SERVICES OR ANY CONTENT; (II) ANY HARM TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR OTHER HARM THAT RESULTS FROM YOUR ACCESS TO OR USE OF THE SERVICES OR ANY CONTENT; (III) THE DELETION OF, OR THE FAILURE TO STORE OR TO TRANSMIT, ANY CONTENT AND OTHER COMMUNICATIONS MAINTAINED BY THE SERVICES; AND (IV) WHETHER THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM THE LOCA MOBILE APPLICATION OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY OR REPRESENTATION NOT EXPRESSLY MADE HEREIN.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOCA MOBILE APPLICATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) YOUR ACCESS OR USE OF THIRD-PARTY SERVICES THAT SUPPORT THE SERVICE, SUCH AS PAYMENT PROCESSORS (III) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (IV) ANY CONTENT OBTAINED FROM THE SERVICES; OR (V) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE LOCA MOBILE APPLICATION ENTITIES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO LOCA MOBILE APPLICATION IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE AND WHETHER OR NOT LOCA MOBILE APPLICATION HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
Links to Third Party Sites
Certain portions of our App allow you to link to a third party site, to “like” an article on a social networking site, and to share articles via social networking sites. The third party’s use of the information that you post or share through that site is governed by their privacy policy, not this one.
Security
We take reasonable security measures to protect the information that you submit and view through our App. Please note that no App is 100% secure, and you should implement certain measures (e.g., password protection) to assist in the protection of the personal information you upload and store on your device, including entry of your Social Security number, credit card information, identification cards, or other information you choose to store in the app feature.
Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy at https://sites.google.com/view/locaapp/private-policy and you are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
