Terms of Service
Y'all, I know it's kinda boring, but you seriously have to read this cuz it helps me so much if you understand what you're getting into *before* sending me money. I'll try my best to be concise with all of this.
Y'all, I know it's kinda boring, but you seriously have to read this cuz it helps me so much if you understand what you're getting into *before* sending me money. I'll try my best to be concise with all of this.
By commissioning me, you — the client — agree to all of these terms.
All prices listed are in $USD. However I live in Brazil, so when the invoice is sent, the price will be listed in $BRL using an online converter, with a screenshot of that conversion being sent to the client. This is done to avoid unnecessary conversion fees.
Getting a price estimate is free and encouraged. After filling out the google form The Client will be contacted within 1 to 2 business days, then we can discuss details of the commission as well as an estimated time when I'll be ready to service The Client.
I will only charge The Client once I'm sure I can start work immediately. I'll notify The Client that I'm ready to take their payment and begin work, at that point, they may instead choose to give up their spot due to a change in financial situation or whatever other reason free of charge.
Refunds will only be issued if I am unable to finish the drawing for whatever reason.
I reserve the right to refuse any commission if I so choose.
All commissions require references. Be it for pose, clothing, design, etc. The more the better. Reference sheets are invaluable too. Even if you aren't a professional artist, a doodle or a collage can go a long way.
2a. Written descriptions are OK, so long as they are substantiated with images or are sufficiently unambiguous. ("I want my character to have gazelle antlers" as opposed to "I want my character to have antlers")
2b. For comics: I require — at the very least — a decent script that describes the plot beat-by-beat. With things such as developing each plot beat into scenes and pages falling to me in the storyboarding phase.
Service time depends on The Client's placement on my Queue. They will automatically be placed on it upon filling out a commission form. It is first-come-first-serve, with patrons having access to a priority queue.
I reserve the right to cancel a commission at any time for reasons such as: Poor communication, rudeness or inappropriate behavior, or inability to meet a client's expectations. Should this happen, a partial or full refund may be issued depending on the amount of work put in.
4a. In that event, I'm entitled to reuse sketches and materials from the cancelled commission in future personal projects and work.
4b. In the case of me being unable to meet a client's expectations, a full refund will be issued instead of a partial one.
Tipping is greatly appreciated!
Throughout the commission, communication is key. I will do my best to send frequent progress updates and keep the client involved with the production. Failure to communicate on the client's part will lead to delays as I wait for them to respond.
1a. If the client does not respond after 14 days have elapsed since their last message without a given reason, I will assume the commission to be cancelled and claim the full payment as compensation.
Sketching phase: After instructions have been given and payment goes through I'll work on an initial rough sketch and send it for approval, that sketch will then be refined and sent for approval as well before moving on to lineart. Any changes at this point are more than welcome.
2a. For Comics: I will fully storyboard the comic before moving on to sketch. That essentially means plotting down the panels with a label for what'll happen on each panel, and after that is approved I will proceed to sketch out the whole comic.
After sketching has been done: I'll move to lineart, with any major changes to pose past this point being subject to a fee correspondent to the effort required. Upon approval I'll then do coloring, and finally shading and final touches.
3a. Notably, changes to colors, dialogue and mistakes on my end will remain free throughout.
3b. For Comics: I will completely finish each page before moving on to the next one. So while all the sketches will be done back-to-back, the same won't happen for lineart, coloring and shading. This is done to prevent exhaustion.
After completion, the commission will be e-mailed to the client so as to avoid file compression. The e-mail will include a receipt, alongside the drawing itself and any alternate versions.
Tipping is greatly appreciated!
All commissions will be posted to my social media and galleries. That includes any private or public portfolio, as well as my Patreon page. You may choose not to be credited as the client if you so choose.
1a. If The Client holds reservations about their character being posted on e621, I'm willing to accommodate that, just ask!
1b. I reserve the right to post approved sketches and Work-in-Progress updates as exclusive content for my Patreon page
The client is allowed to post the commission on their social media and galleries, as well as using it as a profile picture. While crediting me isn't required, it's appreciated as a courtesy. Under NO circumstance is the client allowed to claim authorship over the commission OR edit it in any way without my approval (such as removing my watermark/signature.)
The commission may NOT be used for profit unless it is agreed upon otherwise. That includes using it in branding, or using it to create physical merchandise and prints. If the commission is to be used in such a way, it must be discussed with me.
My artwork may NOT be used for NFTs or AI dataset training.
Most Important Rule: This TOS is not be comprehensive or immutable. Should some edge case happen, or I find that a rule comes off as ambiguous, I'll make my own judgement on how to interpret and deal with the situation. I will commit myself to keeping this list and my community updated when such changes and clarifications happen.
items on this list with a (+$) tag may incur an additional fee due to being notably harder to include in a piece, thus requiring more work time.
