Welcome to LingoAI (hereinafter referred to as "this App" or "we"). This User Agreement (hereinafter referred to as "this Agreement") is a legal agreement between you and us regarding your access to and use of the LingoAI application and related services (hereinafter referred to as "this Service"). Please read this Agreement carefully.
## 1. Acceptance of Terms
By downloading, accessing, or using LingoAI, you confirm that you have read, understood, and agree to be bound by all terms and conditions of this Agreement. If you do not agree to any part of this Agreement, please do not download, access, or use this App.
## 2. Eligibility
You represent and warrant that you are at least 13 years of age. If you are under 18 years of age, you represent that you are using this Service under the supervision of a parent or legal guardian, and that your guardian agrees to be bound by this Agreement.
## 3. Account Security
You need to create an account to access all features of this Service. You are responsible for:
- Maintaining the confidentiality of your account information
- Preventing unauthorized access to your account
- All activities that occur under your account
If you discover any unauthorized use of your account, please notify us immediately.
## 4. Subscription and Payment Terms
### 4.1 Free Trial
LingoAI offers a 7-day free trial period, during which you get unlimited access to all features. Each user is eligible for one free trial only.
### 4.2 Subscription Plan
After the free trial period ends, this Service will automatically renew based on the monthly subscription plan you selected. Subscription fees will be charged to your Apple Account upon confirmation of purchase.
### 4.3 Auto-Renewal
Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current subscription period.
### 4.4 Canceling Subscription
You may cancel auto-renewal at any time. After cancellation, you may continue to use this Service for the remainder of the current subscription period, but it will not automatically renew after the current period ends. To cancel your subscription:
- Open the iOS Settings app
- Tap your name
- Tap Subscriptions
- Tap LingoAI subscription and manage it
### 4.5 Unused Portion of Trial Period
Any unused portion of a free trial period will be forfeited when you purchase an auto-renewing subscription.
### 4.6 Price Changes
We reserve the right to adjust subscription prices at any time. Price changes will take effect after the current subscription period ends and will be communicated to you through appropriate means before your renewal.
## 5. Refund Policy
All subscription payments are processed through the Apple App Store, and Apple handles all payment-related processing. LingoAI does not directly process any refund requests. If you need to request a refund, please contact Apple Support directly.
## 6. Intellectual Property Rights
The intellectual property rights of this App (including but not limited to all content, design, text, graphics, software, code, and the selection and arrangement thereof) are owned by us and protected by international copyright laws and other intellectual property laws. You may not copy, modify, distribute, sell, or rent any part of this Service.
## 7. User Code of Conduct
7.1.You agree that when using this Service, you will:
- Not infringe upon the rights of any third party
- Not upload or transmit any viruses, malware, or other harmful code
- Not attempt to gain unauthorized access to any part of this Service
- Not use this Service for any illegal purpose
- Not interfere with or disrupt the normal operation of this Service
7.2.LingoAI offers a voice-based answering feature. When using this feature, we need to access your microphone permission for speech recognition, pronunciation assessment, and learning feedback.
## 8. Service Modifications and Termination
We reserve the right to modify, suspend, or discontinue this Service (or any part thereof) at any time, with respect to individual users or all users, without notice. We shall not be liable for any loss incurred by you resulting from any modification, suspension, or termination of this Service.
## 9. Disclaimer of Warranties
To the maximum extent permitted by applicable law, this Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. We do not warrant that:
- This Service will meet all your requirements
- This Service will be uninterrupted, timely, secure, or error-free
- Any results obtained from using this Service will be accurate or reliable
## 10. Limitation of Liability
To the maximum extent permitted by applicable law, neither we nor our affiliates, officers, employees, or agents shall be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use this Service.
## 11. Third-Party Links
This Service may contain links to third-party websites or services. We assume no responsibility for the content, privacy policies, or practices of these third parties, and you access them at your own risk.
## 12. Governing Law

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement shall remain in full force and effect.
