Welcome to LifeLatch. These Terms of Service (“Terms”) govern your use of the LifeLatch mobile application, website, and related services (collectively, the “Service”).
By creating an account or using LifeLatch, you agree to these Terms. Please read them carefully.
LifeLatch is a personal check-in and safety-support service designed to help users maintain a connection with people they trust.
Depending on your plan and settings, LifeLatch may allow you to schedule check-ins, designate emergency contacts and pet caretakers, send notifications when a check-in is missed, establish contact priority and escalation procedures, store information in a secure data vault, and provide other safety-related features.
We take the operation and reliability of these services seriously. However, LifeLatch is a technology service and cannot control every device, telecommunications network, third-party service, or person involved in an escalation.
LifeLatch is not a substitute for 911, emergency medical services, law enforcement, fire services, professional monitoring, or any other emergency-response service.
LifeLatch does not continuously monitor your physical condition or location and does not independently determine whether an emergency exists.
If you believe that you or another person is experiencing an immediate emergency, contact 911 or the appropriate local emergency service directly.
LifeLatch should be considered an additional safety net—not your sole means of obtaining emergency assistance.
You are responsible for providing accurate and current information when using LifeLatch and for maintaining the security of your account.
Because LifeLatch depends on information you provide, you are also responsible for:
keeping your telephone number, email address, and other account information current;
keeping emergency-contact and pet-caretaker information accurate and current;
removing or replacing contacts who are no longer appropriate or available;
maintaining reasonable access to a functioning compatible device, internet connection, or cellular service where required;
configuring your device so that LifeLatch can provide notifications and other functionality you choose to use; and
periodically confirming that your LifeLatch settings and designated contacts continue to meet your needs.
You should notify LifeLatch promptly if you believe your account has been compromised or accessed without authorization.
LifeLatch allows users to establish check-in schedules and related escalation settings.
If a required check-in is missed, LifeLatch may attempt to contact you and, depending on your settings and the status of the escalation, notify one or more people you have designated.
LifeLatch’s escalation features are intended to provide an additional layer of protection when you may be unable or unavailable to check in. They do not guarantee that an emergency will be detected, that a notification will reach its intended recipient, or that assistance will ultimately be provided.
You choose the people in your LifeLatch safety network.
You are solely responsible for selecting your emergency contacts, pet caretakers, and other persons you designate through LifeLatch and for determining whether those individuals are appropriate for the responsibilities you assign to them.
You are also responsible for obtaining any permissions or consents reasonably necessary to provide their contact information to LifeLatch and to designate them for notifications or other functions.
LifeLatch does not select, screen, investigate, train, supervise, or control your designated contacts. LifeLatch cannot guarantee their availability, responsiveness, reliability, willingness, judgment, or ability to assist you.
LifeLatch facilitates communication and access to authorized information through the Service. Once a designated contact or another third party receives information from LifeLatch, LifeLatch does not control that person’s subsequent actions.
To the extent permitted by applicable law, LifeLatch is not responsible for the independent acts, omissions, decisions, delays, or conduct of emergency contacts, pet caretakers, or other third parties selected by a user.
LifeLatch may use push notifications, text messages, email, in-app communications, or other available methods to provide check-in reminders, escalation notices, account information, and other Service communications.
LifeLatch is designed to send these communications according to the applicable settings and escalation logic, and we take the reliability of those systems seriously.
However, electronic communications depend on systems that LifeLatch does not completely control. Delivery may be affected by cellular or internet outages, carrier delays or filtering, device settings, disabled notifications, full inboxes, incorrect or outdated contact information, operating-system restrictions, third-party service interruptions, device failure, or other circumstances.
Accordingly, LifeLatch cannot guarantee that every communication will be successfully delivered, received, viewed, acknowledged, or acted upon.
Message and data rates may apply depending on your carrier and service plan.
Certain LifeLatch plans may include access to a secure data vault that allows users to store information they may want made available to authorized persons when genuinely needed.
LifeLatch uses security measures intended to protect vault information and restrict access according to the Service’s authorization and authentication procedures.
Under certain circumstances, a designated person may request access to information contained in your vault. LifeLatch may use additional authorization, authentication, verification, waiting-period, or security procedures before access is permitted.
The specific security technologies and procedures used by LifeLatch may evolve as the Service and available security technologies improve.
You are responsible for deciding what information to place in your vault and for keeping that information accurate and current.
LifeLatch does not guarantee that information stored in the vault will be suitable for every emergency or circumstance, and the vault should not be used as the sole repository for information that must remain independently accessible for medical, legal, financial, or emergency purposes.
LifeLatch may allow you to store pet information and designate persons who should be contacted or prioritized for pet care.
LifeLatch facilitates the communication of the information and preferences you provide. LifeLatch does not provide veterinary services, boarding, pet transportation, animal rescue, or other direct pet-care services.
Users remain responsible for selecting appropriate caretakers and maintaining accurate information concerning their animals and care preferences.
LifeLatch may offer both Free and Premium plans.
Features available under each plan may differ and may change over time. Current features and pricing will be displayed within LifeLatch or through the applicable app marketplace before a purchase is completed.
LifeLatch currently offers Premium subscription options that may include monthly and annual plans. Promotional or partner programs may provide different trial periods or other benefits.
Unless expressly stated otherwise at the time of enrollment, a LifeLatch trial does not obligate you to purchase Premium service when the trial ends.
If a Premium subscription ends or you return to the Free plan, access to Premium-only features may be restricted. LifeLatch may retain information previously entered through Premium features in protected form so that it can become available again if Premium access is restored, subject to our Privacy Policy and your available data-deletion rights.
Premium subscriptions purchased through an app marketplace are also subject to the billing, renewal, cancellation, and refund rules of that marketplace.
Before purchasing a subscription, you will be shown the applicable price and relevant subscription terms.
Where automatic renewal applies, you may cancel future renewal through the applicable marketplace or account-management method. Cancellation generally prevents future renewal but does not necessarily result in a refund for a subscription period already purchased, except where required by law or the applicable marketplace’s policies.
LifeLatch may change future pricing or plan features. When required, we will provide notice before changes affecting an existing paid subscription take effect.
LifeLatch is designed to provide reliable check-in, notification, escalation, and related services, and we take the operation and reliability of those services seriously.
At the same time, no mobile, internet, telecommunications, or cloud-based service can be guaranteed to operate without interruption.
LifeLatch may occasionally be unavailable or impaired because of maintenance, software or hardware failures, telecommunications problems, power failures, third-party service interruptions, natural disasters, severe weather, widespread network disruptions, cybersecurity incidents, governmental actions, or other circumstances outside our reasonable control.
When reasonably possible, LifeLatch will work to restore affected services promptly.
You may not use LifeLatch to violate the law, harass or threaten another person, impersonate another person, gain unauthorized access to another person’s account or information, interfere with the operation or security of the Service, attempt to bypass security or authentication controls, introduce malicious software, or use LifeLatch for fraudulent or abusive purposes.
We may restrict or suspend access when reasonably necessary to protect users, LifeLatch, the Service, or others.
Your use of LifeLatch is also governed by the LifeLatch Privacy Policy.
LifeLatch uses administrative, technical, and organizational safeguards designed to protect user information. However, no electronic storage or transmission system can be guaranteed to be completely secure.
You are responsible for protecting your account credentials and for using appropriate security features available on your device and through LifeLatch.
LifeLatch may depend upon or interact with services provided by third parties, including telecommunications providers, cloud-service providers, mobile operating systems, app marketplaces, authentication services, and messaging providers.
Those services may be governed by their own terms and privacy policies. LifeLatch cannot control the operation or availability of independent third-party systems.
LifeLatch and its software, designs, branding, logos, text, graphics, features, and other original content are owned by LifeLatch or its licensors and are protected by applicable intellectual-property laws.
These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not transfer ownership of LifeLatch intellectual property to you.
LifeLatch is designed to provide the functionality described in the Service, and we will use reasonable efforts to maintain and operate that functionality.
However, because LifeLatch depends in part on users, devices, telecommunications networks, third-party providers, and designated contacts, we cannot warrant that the Service will always be uninterrupted, error-free, or successful in producing a particular real-world outcome.
Nothing in these Terms excludes warranties, rights, or protections that cannot legally be excluded under applicable law.
To the maximum extent permitted by applicable law, LifeLatch and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Service.
LifeLatch is not responsible for losses resulting solely from circumstances outside its reasonable control, including failures of telecommunications networks or third-party systems, inaccurate information supplied by users, or independent actions or omissions of user-selected contacts or other third parties.
Nothing in these Terms is intended to limit or exclude liability that cannot lawfully be limited or excluded.
You may stop using LifeLatch at any time.
LifeLatch may suspend or terminate an account when reasonably necessary because of serious or repeated violations of these Terms, fraudulent or unlawful activity, security risks, nonpayment of applicable fees, or conduct that threatens the Service or other users.
Where appropriate and reasonably possible, we will provide notice before terminating access.
LifeLatch will continue to evolve. We may modify features, security measures, plans, or other aspects of the Service over time.
We may also update these Terms. If a change is material, we will provide notice when reasonably required through the app, website, email, or another appropriate method.
The effective or last-updated date at the top of these Terms will identify the current version.
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms limits any consumer right or remedy that cannot legally be waived.
