# Terms of Use for Level Tool

These Terms of Use (“Terms”) govern your use of the Level Tool iOS application (“Level Tool” or the “App”), provided by Limbic Apps Yazılım Ltd. Şti. (“we,” “us,” or “our”).
By downloading, purchasing, or using Level Tool, you agree to these Terms and Apple’s [Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) (“Apple Standard EULA”). If these Terms conflict with mandatory consumer law or the Apple Standard EULA, the applicable mandatory terms control.
## 1. License and Acceptable Use
You receive a personal, limited, non-exclusive, non-transferable, and revocable license to use Level Tool on Apple devices that you own or control, subject to Apple’s Usage Rules.
You may not:
- copy, sell, sublicense, rent, or redistribute the App except where permitted by law;
- reverse engineer, bypass, interfere with, or attempt to defeat App security or purchase validation, except where such a restriction is prohibited by law;
- use the App unlawfully or to infringe another person’s rights;
- misrepresent App measurements as certified professional inspection or surveying results.
## 2. Measurement and Safety Disclaimer
Level Tool uses sensors in your iPhone. Accuracy can be affected by:
- device model and sensor condition;
- protective cases, attachments, magnets, vibration, and movement;
- calibration quality;
- temperature, environment, surface condition, and how the phone is held;
- camera perspective, lens distortion, selected points, and distance.
Level Tool is a convenience utility. It is not a certified surveying, engineering, aviation, medical, navigation, construction-safety, or life-safety instrument.
Always:
- calibrate and verify measurements against a trusted physical tool when accuracy matters;
- follow applicable building codes, workplace rules, manufacturer instructions, and professional standards;
- use appropriate protective equipment and safe access methods;
- obtain a qualified professional’s assessment for structural, electrical, roofing, machinery, or other safety-critical work.
You remain responsible for checking measurements and deciding whether they are suitable for your project.
## 3. Free and Pro Features
Level Tool may offer free tools and optional Level Tool Pro features. Available features may change as the App evolves. We will not intentionally remove an already-purchased non-consumable entitlement without a lawful reason.
Pro access may be offered through:
- an automatically renewing Annual Pro subscription; or
- a Lifetime Pro non-consumable purchase.
Prices and availability are displayed by the App Store in your local currency and may vary by country.
## 4. Annual Subscription and Free Trial
If Apple shows that you are eligible, Annual Pro may include a seven-day introductory free trial.
- Eligibility is determined by Apple.
- The subscription begins immediately when the trial ends unless you cancel beforehand.
- Payment is charged to your Apple ID.
- The subscription renews automatically for additional annual periods unless canceled at least 24 hours before the end of the current trial or subscription period.
- You can manage or cancel the subscription in Apple ID subscription settings.
- Deleting the App does not cancel a subscription.
The exact price, trial eligibility, renewal terms, and billing date shown in Apple’s purchase confirmation control your transaction.
## 5. Lifetime Purchase
Lifetime Pro is a one-time, non-consumable in-app purchase that unlocks the applicable Pro entitlement for the supported lifetime of the App and your Apple account, subject to these Terms and Apple’s services.
“Lifetime” does not guarantee that every device, operating system, or service will remain supported indefinitely. We may discontinue the App when reasonably necessary, but we will not convert a completed Lifetime purchase into a recurring charge.
## 6. Purchases, Restoration, and Refunds
Purchases are processed by Apple and entitlement status is managed with RevenueCat.
You can use “Restore Purchases” to request restoration of eligible purchases associated with your Apple ID.
Refund requests are handled by Apple under Apple’s policies and applicable law. We cannot directly issue App Store refunds or access your complete payment-card information.
## 7. User Content and Exports
You retain ownership of notes, measurements, and photos you create with the App.
You are responsible for:
- having permission to photograph, store, or share people, property, and job information;
- reviewing exports before sending them;
- selecting appropriate recipients and storage services;
- maintaining backups when records are important.
We do not guarantee that locally stored notes, photos, or exports will never be lost.
## 8. Third-Party Services
Level Tool relies on services provided by Apple and RevenueCat. Their availability, terms, and privacy practices are outside our direct control. Third-party links and services are used at your own discretion.
## 9. Intellectual Property
The App, its design, software, branding, and original content are owned by us or our licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership rights to you.
## 10. Availability and Updates
We may update, modify, suspend, or discontinue features to improve the App, maintain compatibility, address security or legal requirements, or respond to service changes.
Updates may be required for continued operation. Some features require supported hardware, camera permission, internet access, Apple services, or current purchase information.
## 11. Disclaimer of Warranties
To the maximum extent permitted by law, Level Tool is provided “as is” and “as available,” without warranties of accuracy, uninterrupted operation, fitness for a particular purpose, merchantability, or non-infringement.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
## 12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or commercial losses arising from use of or inability to use the App, including project errors, property damage, lost profits, lost records, or business interruption.
We do not exclude liability where exclusion is prohibited by law, including applicable consumer protections.
## 13. Termination
You may stop using the App at any time. We may terminate or restrict access if you materially violate these Terms, misuse the App, commit fraud, or interfere with the service.
Termination does not automatically cancel an Apple subscription. Subscriptions must be canceled through Apple.
## 14. Governing Terms and Consumer Rights
These Terms are governed by applicable law, without limiting mandatory consumer rights in your country or region. If you reside in the European Economic Area, United Kingdom, Switzerland, Norway, or Iceland, mandatory laws and courts of your usual residence may apply.
## 15. Changes to These Terms
We may update these Terms when features, purchases, service providers, or legal requirements change. Continued use after an update means you accept the revised Terms where permitted by law.
