Welcome to Lenspot ("Lenspot", the "App", "we", "us", or "our").
Please read these Terms of Use ("Terms") carefully before downloading, installing, accessing, or using the App.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
Lenspot is an AI-powered visual recognition application designed to help users identify plants, birds, food, coins, and minerals using their mobile device camera.
Features include:
Identifying plants, birds, food, coins, and minerals from photos
Displaying knowledge cards with curated information
Providing safety alerts for toxic plants, protected species, and inedible items
Saving identification history locally on your device
Visual recognition powered by AI technology
Lenspot processes images temporarily for identification purposes. Your images are processed and then immediately discarded. Your identification history is stored locally on your device and is not uploaded to our servers unless explicitly required for specific features you actively choose to use.
By using the App, you represent and warrant that:
You are at least 13 years old, or the minimum age required in your jurisdiction
If you are under the age of majority, your parent or legal guardian has reviewed and agreed to these Terms on your behalf
You have the legal capacity to enter into a binding agreement
You will comply with all applicable laws and regulations
Lenspot does not require account registration.
You are not required to provide:
Name
Email address
Phone number
Password
The App may use device identifiers to provide services and manage local data storage.
Because no account exists:
We may not be able to recover your identification history if the App is deleted
We may not be able to restore your history if your device is lost, replaced, or reset
You are responsible for backing up any important identification records and maintaining any security settings available on your device.
We recommend exporting and saving important identification results to external storage or cloud services if you wish to retain them beyond the App.
Lenspot requires access to device camera and storage to provide its core functionality.
By using the App, you acknowledge and agree that:
Camera Access
The App may access your device camera to:
Capture images of plants, birds, food, coins, and minerals for identification
Take photos of objects you want to recognize
Camera access is only used at the moment you actively initiate a capture. The App does not access the camera in the background or without user action.
Photo Library Access
The App may access your device photo library to:
Import existing images for identification processing
Save identified results or images back to your photo library (if applicable)
Photo library access is only used when you actively choose to import or save images.
Storage Access
The App may access your device storage to:
Save identification history locally on your device
Cache recognition results for faster loading
Storage access is only used when you actively save or view your identification history.
User Control
You may revoke camera, photo library, or storage permissions at any time through device settings. Disabling permissions may limit or disable App functionality.
You retain full ownership of all images and content you capture, import, or process using the App ("Your Content").
By using the App, you acknowledge and agree that:
Temporary Processing
Images you capture for identification are transmitted to our recognition service solely for the purpose of providing identification results. Once identification is complete, the image is immediately discarded from our servers. Your Content is not stored on our servers unless explicitly required for specific features that you actively choose to use.
Local Storage
Identification history (thumbnails and results) is stored locally on your device only. We do not store your identification history on our servers.
No Data Collection
We do not collect, store, or access Your Content for any purpose other than providing the identification service you request. We do not share, sell, or distribute Your Content to any third party.
User Responsibility
You are solely responsible for:
The content you capture and identify
Ensuring you have the right to capture and identify any objects
Complying with applicable laws regarding privacy and photography
Backing up your identification history
You may not use Lenspot for any unlawful or prohibited purpose, including but not limited to:
Scanning or identifying:
Counterfeit documents or currency
Illegal or restricted substances
Copyrighted materials without permission
Content that violates privacy rights
Fraudulent or misleading content
Using the App to:
Violate any applicable laws or regulations
Infringe upon intellectual property rights
Harass, threaten, or harm others
Engage in any illegal activity
Violation of this policy may result in suspension or termination of access and may be reported to applicable authorities.
Lenspot uses AI technology to identify objects from images.
You acknowledge and agree that:
Accuracy Limitations
Identification results may be:
Inaccurate
Incomplete
Affected by image quality (lighting, angle, focus)
Dependent on the clarity of the object in the image
Limited by the AI model's training data
Lenspot does not guarantee 100% accuracy of identification results. Results are provided for informational and entertainment purposes only.
Manual Verification Recommended
You are responsible for:
Verifying identification results before relying on them
Consulting expert sources for critical decisions
Ensuring the accuracy of any information you rely upon
No Professional Advice
Identification results are not a substitute for professional advice, including but not limited to:
Medical or dietary advice (do not eat unknown plants or mushrooms based solely on App results)
Legal advice
Financial or investment advice (coin values are for reference only)
Scientific or academic verification
User Responsibility
Identification results are provided on an "as is" basis. You should not rely solely on App results for:
Medical decisions
Consuming wild plants or fungi
Legal determinations
Financial transactions
Any other purpose requiring absolute accuracy
Lenspot may display safety alerts for certain identified objects, such as:
Toxic or poisonous plants
Protected or endangered bird species
Inedible or cautionary food items
You acknowledge and agree that:
Safety alerts are for informational purposes only
Safety alerts do not constitute professional advice
You are solely responsible for your own safety
You should always consult expert sources before making decisions based on identification results
Lenspot is not liable for any harm resulting from reliance on safety alerts
Lenspot may offer subscription plans, one-time purchases, or in-app purchases ("Paid Features") in future versions.
By purchasing Paid Features, you agree to the following:
Payment Authorization
Payments are processed through the Apple App Store. You authorize Apple to charge the applicable payment method for all fees.
Subscription Terms
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You may manage subscriptions through your Apple ID account settings. Fees are non-refundable except as required by applicable law.
Free Trial
Any free trial period offered may be canceled at any time before the trial ends to avoid being charged. Trial terms are as presented at the time of offer.
Price Changes
We reserve the right to change pricing at any time. Price changes will not affect active subscriptions until the next renewal period. You will be notified of any price changes.
No Liability for Third-Party Fees
You are responsible for any fees charged by your mobile carrier, internet service provider, or any third party in connection with use of the App.
All intellectual property rights in the App, including but not limited to:
Software code
Design
Graphics
Trademarks
Text and content (excluding Your Content)
are owned by us or our licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not:
Copy, modify, or distribute the App
Reverse engineer or decompile the App
Create derivative works
Remove any proprietary notices
Use the App for any commercial purpose without our prior written consent
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of identification results
Uninterrupted or error-free operation
We do not warrant that:
The App will meet your requirements
Identification results will be accurate
Safety alerts will be complete or error-free
The App will be compatible with all devices or operating systems
The App will be free of bugs, errors, or security vulnerabilities
TO THE FULLEST EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION:
Loss of identification history or data
Loss of profits or revenue
Business interruption
Damage to reputation
Harm resulting from reliance on identification results or safety alerts
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Lenspot, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
Your use of the App
Your violation of these Terms
Your violation of any applicable laws or regulations
Your infringement of any third-party rights
Your Content
Your reliance on identification results
We reserve the right to suspend or terminate your access to the App at any time, without notice or liability, for any reason, including violation of these Terms.
Upon termination:
Your right to use the App will immediately cease
Any identification history or data stored locally on your device remains your responsibility
We are not responsible for recovering or storing your data
You may terminate these Terms by uninstalling the App.
We reserve the right to update or modify these Terms at any time.
Material changes will be communicated by:
Updating the "Last Updated" date at the top of these Terms
In-app notice (if feasible)
By continuing to use the App after changes become effective, you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
The App may integrate with or link to third-party services, including but not limited to:
Apple App Store
Device operating system services
AI/ML recognition service providers
Cloud infrastructure providers (if applicable)
We are not responsible for:
The privacy practices of third parties
The content or accuracy of third-party services
The availability or performance of third-party services
Any third-party terms or fees
Your interactions with third-party services are governed by their own terms and policies.
Our Privacy Policy explains how we collect, use, and disclose information.
By using the App, you consent to the practices described in the Privacy Policy.
We do not sell, share, or distribute your images, identification history, or personal data to third parties.
We do not knowingly collect personal information from children under 13 without appropriate parental authorization where required by law.
Parents who believe information has been collected improperly may contact us for review and deletion requests.
By using the App, you agree to receive notices and communications electronically, including through the App.
Electronic communications satisfy any legal requirement that communications be in writing.
You agree not to use the App in violation of:
United States export laws
Sanctions regulations
International trade restrictions
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
We encourage you to contact us first if you have any concerns. Most disputes can be resolved informally.
If a dispute cannot be resolved informally, you agree to attempt to resolve it through binding arbitration or small claims court, as applicable.
You waive any right to participate in a class action or class-wide arbitration.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and us regarding use of the App.
They supersede all prior or contemporaneous communications, whether written or oral.
Any waiver of any provision of these Terms must be in writing and signed by us.
