These Terms of Service ("Terms") govern your access to and use of the mobile application Learn morse code - CodeMorse ("App"), provided by Maksym Hrechukha ("we", "our", or "us").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. About the App

Learn morse code - CodeMorse is an educational app designed to help users learn and practice Morse code through lessons, exercises, training modes, and related learning tools.

The App is provided for personal, non-commercial use unless otherwise agreed in writing.

2. Eligibility

You may use the App only if you are legally allowed to do so under the laws of your country or region.

If you are under the age of majority in your country or region, you should use the App only with permission from a parent or legal guardian.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal educational purposes.

You may not:

- Copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App

- Sell, rent, sublicense, distribute, or commercially exploit the App

- Use the App for unlawful, harmful, or abusive purposes

- Interfere with or disrupt the operation of the App

- Attempt to bypass paywalls, subscription systems, security features, or access restrictions

- Use the App in a way that violates applicable laws or third-party rights

4. Educational Purpose

The App is intended for learning and practicing Morse code.

We do not guarantee that use of the App will result in any specific learning outcome, certification, professional qualification, or ability level.

Your progress may depend on your own practice, consistency, prior experience, and learning habits.

5. In-App Purchases and Subscriptions

The App may offer paid features, in-app purchases, or subscriptions.

All purchases and subscriptions are processed by Apple through your App Store account. We do not directly process payments or store your payment card details.

Subscription terms, billing, renewal, cancellation, and refund handling are managed by Apple according to Apple's App Store policies.

If you purchase a subscription, it may automatically renew unless you cancel it through your App Store account settings before the renewal date.

You are responsible for managing and cancelling your subscription through Apple.

6. Free Trials and Promotional Offers

The App may offer free trials or promotional subscription offers.

Unless cancelled before the end of the trial period, a free trial may convert into a paid subscription according to the terms shown at the time of purchase.

Apple manages free trials, promotional offers, billing, renewals, and cancellations.

7. Refunds

Payments are processed by Apple through the App Store.

Refund requests must be submitted to Apple according to Apple's refund rules and procedures. We do not control Apple's refund decisions.

8. Premium Access

Some features of the App may be available only with an active paid subscription or in-app purchase.

We may change, add, or remove free or paid features from time to time, as long as this does not violate applicable law or App Store rules.

If your subscription expires, is cancelled, or cannot be verified, access to premium features may be limited or removed.

9. Superwall

The App may use Superwall SDK to display paywalls, manage subscription access, test subscription screens, and analyze interactions with paywalls.

Superwall is a third-party service. Your use of the App may involve processing of certain technical, usage, device, and purchase-related data by Superwall as described in our Privacy Policy.

10. User Content and Feedback

If you send us feedback, suggestions, ideas, comments, or support messages, you agree that we may use them to improve the App without any obligation to compensate you.

You are responsible for any information you choose to provide to us.

Please do not send confidential, sensitive, or unlawful content.

11. App Availability and Changes

We may update, modify, suspend, or discontinue the App or any part of it at any time.

We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.

Some features may depend on third-party services, Apple systems, internet connection, device compatibility, or operating system requirements.

12. Intellectual Property

The App, including its design, text, graphics, interface, features, lessons, software, branding, and other content, is owned by us or licensed to us and is protected by intellectual property laws.

You may not use our content, name, branding, or materials without our prior written permission, except as allowed by these Terms or applicable law.

13. Third-Party Services

The App may rely on or interact with third-party services, including Apple App Store services and Superwall.

We are not responsible for third-party services, their availability, content, policies, or actions.

Your use of third-party services may be subject to their own terms and policies.

14. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how information is collected, used, and shared.

Please review our Privacy Policy before using the App.

15. No Warranties

The App is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not guarantee that:

- The App will meet your expectations

- The App will always be available or error-free

- Any learning result or skill level will be achieved

- Any defects or issues will always be corrected

16. Limitation of Liability

To the fullest extent permitted by law, Maksym Hrechukha shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of access, device issues, or learning outcomes arising from your use of or inability to use the App.

Our total liability for any claim related to the App shall not exceed the amount you paid for the App or subscription during the twelve months before the claim, or 50 USD, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless Maksym Hrechukha from and against any claims, damages, losses, liabilities, costs, or expenses arising from:

- Your use or misuse of the App

- Your violation of these Terms

- Your violation of applicable laws

- Your violation of third-party rights

18. Termination

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, attempt to bypass payment or security systems, or use the App unlawfully.

You may stop using the App at any time.

Termination does not automatically cancel your App Store subscription. To cancel a subscription, you must manage it through your Apple App Store account settings.

19. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.

If any dispute arises, the parties will first try to resolve it informally by contacting each other.

Nothing in these Terms limits any consumer rights you may have under the laws of your country or region.

20. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the Effective Date at the top of this document.

Your continued use of the App after changes are posted means that you accept the updated Terms.
