These Terms of Use ("Terms") govern your access to and use of this application (the "Service"), provided by Layer 9 Data Centers Holdco LLC ("we", "us", or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 13 years old and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You may not:
Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or disassemble the Service
Rent, lease, sell, or sublicense the Service
Use the Service for any unlawful purpose
3. Description of Service
The Service provides the following features:
Fitness and physical activity tracking (steps, distance, active minutes) via device sensors
Location-based content and services
A file sharing feature, using access to your device's shared storage
Display of installed applications, used to recommend compatible updates and features
Optional in-app purchases and subscription plans
Display of advertisements provided by third-party ad networks (AdMob)
We do not guarantee uninterrupted or error-free operation of these features.
4. Fitness and Activity Data
The Service uses your device's sensors (e.g., accelerometer, pedometer) to track physical activity such as step count, distance, and active minutes. This data is used solely to provide fitness tracking features within the app. You are responsible for verifying the accuracy of any fitness data before relying on it for health-related decisions. The Service is not a medical device and should not be used as a substitute for professional medical advice.
5. Storage Access and File Sharing
By granting storage access permissions (including MANAGE_EXTERNAL_STORAGE where applicable), you authorize the Service to access, read, and manage files on your device's shared storage solely for the purpose of enabling the file sharing feature, such as selecting files and sending them to other apps or users. We do not use this permission to collect, store, or transmit your personal files for any other purpose.
6. Installed Applications List
With your consent, the Service may access the list of applications installed on your device (via the QUERY_ALL_PACKAGES permission) in order to recommend relevant updates, identify compatibility issues, and improve your experience. This data is not used for advertising or analytics purposes, and is never sold or shared with third parties beyond what is described in our Privacy Policy. You may revoke this permission at any time in your device settings.
7. Location Data
If you enable location permissions, the Service may use your precise or approximate location to provide location-based content and features. You may disable location access at any time in your device settings, which may limit certain features of the Service.
8. In-App Purchases
The Service may offer optional in-app purchases ("IAP") for additional features, content, or removal of ads.
All purchases are processed through the app store platform (Google Play or Apple App Store), and payment is governed by that platform's own terms and payment policies.
Prices are displayed in the app and may vary by region or promotional offer.
All purchases are final. Refunds are subject to the policies of Google Play or the Apple App Store, and we do not directly process refunds.
We reserve the right to modify, discontinue, or change the pricing of in-app purchases at any time, without prior notice, though such changes will not affect purchases already made.
9. Subscriptions
If the Service offers subscription plans ("Subscriptions"):
Subscriptions provide access to premium features for a recurring billing period (e.g., weekly, monthly, or yearly), as described at the time of purchase.
Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the renewal date.
Payment will be charged to your app store account (Google Play or Apple App Store) upon confirmation of purchase and again upon renewal.
You can manage or cancel your subscription at any time through your app store account settings. We do not have the ability to cancel your subscription on your behalf.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
We reserve the right to change subscription prices. Any price changes will be communicated in advance, in accordance with the applicable app store's requirements, and will apply to subsequent billing cycles.
10. Advertising
The Service may display advertisements provided by third-party advertising networks (e.g., Google AdMob).
Ads may be personalized or non-personalized, depending on your consent choices as described in our Privacy Policy.
We are not responsible for the content of third-party advertisements, and the appearance of an ad does not constitute our endorsement of the advertised product or service.
Clicking on ads may direct you to third-party websites or apps outside of our control; we are not responsible for the content, privacy practices, or terms of those third parties.
You may opt out of personalized advertising as described in our Privacy Policy.
Some app features may offer an option to remove ads through an in-app purchase or subscription.
11. User Conduct
You agree not to use the Service to:
Violate any applicable law or regulation
Infringe the intellectual property or privacy rights of others
Transmit malware, spam, or engage in any harmful or fraudulent activity
Attempt to gain unauthorized access to our systems or other users' data
Interfere with or manipulate advertising, including fraudulent clicks or impressions
Use the file sharing feature to distribute unlawful, infringing, or harmful content
12. Intellectual Property
All content, trademarks, logos, and intellectual property associated with the Service are owned by us or our licensors. Nothing in these Terms transfers any ownership rights to you.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, AND WE MAKE NO WARRANTY REGARDING THE ACCURACY OF FITNESS OR ACTIVITY DATA.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS ARISING FROM IN-APP PURCHASES OR SUBSCRIPTIONS, OR RELIANCE ON FITNESS OR LOCATION DATA.
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
16. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or engaged in unlawful or harmful conduct. Termination does not entitle you to a refund of any purchases already made, except as required by applicable app store policy or law.
17. Third-Party Services
The Service uses third-party services, including Google AdMob (advertising), Firebase (crash reporting and analytics), Google Play Services (core Android functionality), and app store payment processors. We are not responsible for the practices or content of these third parties, which are governed by their own terms and policies.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable to the data controller's jurisdiction, without regard to conflict of law principles.
19. Changes to These Terms
We may update these Terms from time to time. Changes will be posted here with a new "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
