Rights – protecting the tenants from Property Disputes
The tenants must know their rights so that they can protect themselves from any illegality.
Safe Home
- The tenant has the right to have a house that is safe which means it should be installed with all the safety measures.
Repairs
- It's the right of the occupant to ensure that the home is in good form. He can ask to get the required repairs even after moving in the house.
Privacy
- The landlord doesn't have the right to enter the house any time he wants.
- Even if one is living in a rented house, he is entitled to have privacy.
- The owner can only enter the home if he has a precise reason to do so or have the renter’s permission.
- One is also entitled to the quiet and exclusive enjoyment of his home.
- If the noise from the neighbors disturbs you, one can ask them to stop and then inform the landlord.
Documents and terms of tenancy
- A tenant has the right to ask for a written copy of tenancy agreement along with receipts.
- He is entitled to know all the terms and conditions of the agreement.
- He must be given a particular notice of termination of the tenancy so that he have a reasonable time to vacate the premises.
Reimbursement
- The tenant can ask for compensations for any repairs that he carried out which was originally the owner's responsibility.
Legal Process
- The tenant must make sure to enter a lease deed under tenancy law to protect himself from any dispute or default in future.
- The tenure is up to a period of 11 months the rent agreement doesn't need to be registered, but if it is for more than 11 months, then the deed has to be registered under the law.
Rent and Period of Tenancy
- The agreement should contain the starting and the ending date of the lease along with the date of payment of the rent.
- It should also specify the proposed increase in the rent and how it will be applied.
Rights of legal successors of the tenants
- The heirs of the tenants also get the same rights as of the occupants under the Rent Control Act.
- And the heirs have the right to decide whether they want to renew the rental contract or leave it.
Because one is living in a rented home, it doesn't mean he cannot enjoy his privacy or feel secure in his house. He also has the right to feel the same as the owners do. So it is important for the tenant to know his rights to safeguard himself from any future property disputes and enjoy his time in the house.
