LEASE CONTRACT
KNOW ALL MEN BY THESE PRESENTS:
This Lease Contract ("Agreement") is made and executed this [Day] of [Month, Year], at [Place of Execution], by and between:
[LESSOR'S FULL NAME], of legal age, [civil status], [nationality], and residing at [Lessor’s Address], hereinafter referred to as the "LESSOR";
AND
[LESSEE'S FULL NAME], of legal age, [civil status], [nationality], and residing at [Lessee’s Address], hereinafter referred to as the "LESSEE";
The LESSOR and LESSEE are collectively referred to as the "Parties."
WHEREAS, the LESSOR is the lawful owner of a [describe the leased property, e.g., house, condominium unit, apartment, commercial space, office, etc.], located at [Complete Address of the Property];
WHEREAS, the LESSOR agrees to lease the said property to the LESSEE, and the LESSEE agrees to rent the same, subject to the following terms and conditions:
1.1. The LESSOR leases to the LESSEE the property located at [Full Address], consisting of [describe the space, e.g., number of bedrooms, floor area, amenities, etc.].
2.1. The lease shall commence on [Start Date] and shall end on [End Date], unless renewed or terminated earlier in accordance with this Agreement.
2.2. Upon expiration of the lease term, the LESSEE may request renewal subject to the LESSOR’s approval and negotiation of new terms.
3.1. The monthly rental fee shall be PHP [Amount in Words] ([PHP Amount in Numbers]), payable on or before the [Due Date] of each month.
3.2. The rent shall be paid via [payment method, e.g., bank deposit, cash, check, online transfer] to the LESSOR’s designated account or personally delivered.
3.3. A late payment penalty of [Penalty Amount] shall be imposed for payments delayed beyond [Number] days from the due date.
4.1. The LESSEE shall pay a security deposit equivalent to [Number] months’ rent, amounting to PHP [Amount], upon signing this Agreement.
4.2. The LESSEE shall also pay [Number] months' advance rent, amounting to PHP [Amount], upon signing this Agreement.
4.3. The security deposit shall be refundable upon lease termination, subject to deductions for unpaid rent, damages, or unpaid utilities.
The LESSOR agrees to:
5.1. Ensure that the leased premises are in good and habitable condition at the start of the lease.
5.2. Allow the LESSEE peaceful enjoyment of the premises without unnecessary disturbances.
5.3. Perform necessary structural repairs (excluding those due to the LESSEE’s negligence).
The LESSEE agrees to:
6.1. Use the leased premises exclusively for [residential/commercial] purposes and not for illegal or hazardous activities.
6.2. Maintain the premises in good condition, avoiding any unnecessary damage.
6.3. Pay for utilities (electricity, water, internet, association dues, etc.), unless otherwise agreed upon.
6.4. Not sublease, assign, or transfer this lease without the LESSOR’s written consent.
6.5. Permit the LESSOR or authorized agents to inspect the property with prior notice.
7.1. The LESSEE shall not make alterations to the premises without prior written consent from the LESSOR.
7.2. Pets [are/are not] allowed on the property.
7.3. Noise levels must be kept at a reasonable level to avoid disturbing neighbors.
7.4. Smoking is [allowed/not allowed] within the leased premises.
8.1. The LESSOR shall be responsible for major repairs affecting the structure and habitability of the property.
8.2. The LESSEE shall be responsible for minor repairs, such as plumbing leaks, electrical issues, and damages caused by negligence.
8.3. The LESSEE shall notify the LESSOR immediately of any needed repairs.
9.1. This lease may be terminated under the following conditions:
By the LESSEE, with [Number] days' written notice.
By the LESSOR, if the LESSEE fails to pay rent for [Number] consecutive months.
If either Party violates any provision of this Agreement.
9.2. If the LESSEE vacates the property without notice, the security deposit shall be forfeited.
10.1. Neither Party shall be liable for failure to perform obligations due to natural disasters, war, or unforeseen government actions.
10.2. If the property becomes uninhabitable, the lease may be terminated without penalty.
11.1. This Agreement shall be governed by the laws of the Republic of the Philippines.
11.2. Any disputes shall first be resolved amicably. If unresolved, disputes shall be submitted to the proper courts in [City/Province], Philippines.
12.1. Binding Effect – This Agreement shall be binding upon the Parties, their heirs, successors, and assigns.
12.2. Severability – If any provision is found invalid, the remaining provisions shall remain in full force and effect.
12.3. Entire Agreement – This Agreement represents the full understanding between the Parties.
