DEED OF DONATION

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Donation ("Deed") is made and executed this [Day] of [Month, Year], at [Place of Execution], by:

[DONOR'S FULL NAME], of legal age, [civil status], [nationality], and residing at [Donor’s Address], hereinafter referred to as the "DONOR";

IN FAVOR OF

[DONEE'S FULL NAME], of legal age, [civil status], [nationality], and residing at [Donee’s Address], hereinafter referred to as the "DONEE";

WITNESSETH, that:

WHEREAS, the DONOR is the absolute and registered owner of a [Type of Property, e.g., parcel of land, house and lot, condominium unit, motor vehicle, personal property, etc.], more particularly described as follows:

WHEREAS, the DONOR, out of love, liberality, and generosity, freely and voluntarily donates, conveys, and transfersto the DONEE, his/her heirs, successors, and assigns, the above-described property, subject to the following terms and conditions:

1. ACCEPTANCE BY THE DONEE

1.1. The DONEE hereby accepts this donation wholeheartedly and unconditionally, and expresses gratitude for the DONOR’s generosity.

2. TRANSFER OF OWNERSHIP

2.1. Upon execution of this Deed, the DONOR irrevocably transfers all rights, interests, and ownership of the donated property to the DONEE.
2.2. The DONEE may take possession of the property immediately upon execution of this Deed.
2.3. The DONOR guarantees that the property is free from any liens, encumbrances, or legal claims.

3. TAXES AND EXPENSES

3.1. The following expenses shall be borne by the DONEE:

• Donor’s Tax (if applicable)

• Documentary Stamp Tax (DST)

• Transfer Tax and Registration Fees

• Notarial and legal fees

3.2. The DONOR shall assist in the execution of all necessary documents for the title transfer.

4. REVOCATION OF DONATION

4.1. This donation may be revoked under the following circumstances:

• If the DONEE commits acts of ingratitude toward the DONOR, including serious misconduct or harm.

• If the DONEE fails to comply with conditions (if any) specified in this Deed.

• If the DONEE predeceases the DONOR (in which case, the donation shall revert to the DONOR).

5. WARRANTIES AND REPRESENTATIONS

5.1. The DONOR guarantees that:

• He/she is the legal owner of the property.

• The property is not subject to any pending litigation or claims.

• The DONOR has the full legal right and authority to donate the property.

5.2. The DONEE acknowledges that he/she has inspected the property and accepts it in its current condition.

6. GENERAL PROVISIONS

6.1. Governing Law – This Deed shall be governed by the laws of the Republic of the Philippines, including the Civil Code of the Philippines.
6.2. Binding Effect – This Deed shall be binding upon the heirs, successors, and assigns of both Parties.
6.3. Severability – If any provision is found invalid, the remaining provisions shall remain in full force and effect.
6.4. Entire Agreement – This Deed represents the full understanding between the Parties regarding the donation.
