COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Compromise Agreement ("Agreement") is made and entered into this [Day] of [Month, Year], at [Place of Execution], by and between:

1. [PARTY 1’S FULL NAME], of legal age, [civil status], [nationality], and residing at [Party 1’s Address], hereinafter referred to as "PARTY 1";

2. [PARTY 2’S FULL NAME], of legal age, [civil status], [nationality], and residing at [Party 2’s Address], hereinafter referred to as "PARTY 2".

WHEREAS, a dispute exists between the Parties regarding [briefly describe the nature of the dispute, e.g., financial obligation, property ownership, contract breach], and both Parties wish to settle the matter amicably;

WHEREAS, the Parties, without admitting fault or liability, agree to enter into this Compromise Agreement to avoid further legal action and amicably resolve their differences;

1. TERMS OF SETTLEMENT

4. CONFIDENTIALITY

4.2. Neither Party shall make defamatory or harmful statements about the other in relation to the dispute.

5. BREACH AND REMEDIES

5.1. If either Party fails to comply with the terms of this Agreement, the non-breaching Party may:

• Seek specific performance of the obligations stated herein;

• Demand liquidated damages of PHP [Amount];

• Initiate legal proceedings for enforcement, with the defaulting Party liable for legal costs.

6. GOVERNING LAW AND DISPUTE RESOLUTION

6.1. This Agreement shall be governed by the laws of the Republic of the Philippines, particularly the Civil Code.

6.2. Any disputes arising from this Agreement shall first be resolved amicably. If unresolved, the dispute shall be submitted to [Mediation/Arbitration/Court in [City/Province]].

7. GENERAL PROVISIONS

7.1. Binding Effect – This Agreement shall be binding upon the Parties, their heirs, successors, and assigns.

7.2. Severability – If any provision is found invalid, the remaining provisions shall remain in effect.

7.4. No Admission of Liability – This Agreement does not constitute an admission of guilt or fault by either Party.
