CHILD SUPPORT AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This Child Support Agreement ("Agreement") is made and entered into this [Day] of [Month, Year], at [Place of Execution], by and between:
1. [FATHER’S FULL NAME], of legal age, [civil status], [nationality], and residing at [Father’s Address], hereinafter referred to as the "FATHER";
2. [MOTHER’S FULL NAME], of legal age, [civil status], [nationality], and residing at [Mother’s Address], hereinafter referred to as the "MOTHER";
3. [CHILD’S FULL NAME], born on [Child’s Date of Birth], hereinafter referred to as the "CHILD".
WHEREAS, the Parties acknowledge their shared parental responsibility for the welfare and support of the CHILD;
WHEREAS, the Parties wish to formalize their agreement regarding child support, custody, and financial obligations in accordance with the Family Code of the Philippines and other applicable laws;
NOW, THEREFORE, for and in consideration of the mutual covenants herein contained, the Parties agree as follows:
1.1. The MOTHER/FATHER shall have primary custody of the CHILD. The non-custodial parent shall have visitation rights as specified below.
1.2. The non-custodial parent shall have reasonable visitation rights, which include:

1.3. Both parents shall have joint parental authority in making major decisions regarding the CHILD’s education, health, and welfare.

3.2. Any extraordinary expenses (e.g., medical emergencies, special education needs) shall be shared equally/unilaterally by the Parties, subject to prior consultation.
4.1. Child support shall continue until the CHILD reaches the age of majority (18 years old) or until the CHILD completes tertiary education, whichever comes later.
4.2. Support may be extended beyond this period in case the CHILD:
Is physically or mentally incapacitated to support themselves;
Is still enrolled in school and making satisfactory academic progress.
5.1. Either Party may request a review and modification of child support terms in case of:
Change in financial circumstances (e.g., job loss, disability, increase in income);
Significant change in the needs of the CHILD (e.g., medical emergencies, change in educational requirements).
5.2. Any modification must be mutually agreed upon in writing or approved by a court, if necessary.
6.1. Failure to pay child support for [Number] consecutive months shall constitute default, and the receiving parent may:
Seek legal enforcement of this Agreement under the provisions of the Family Code of the Philippines.
File a case for violation of R.A. 9262 (Violence Against Women and Children Act), if applicable.
Seek garnishment of wages or other legal remedies to ensure compliance.
6.2. The defaulting parent shall be responsible for any legal costs incurred in enforcing this Agreement.
7.1. Any disputes arising from this Agreement shall first be settled amicably between the Parties.
7.2. If unresolved, disputes shall be referred to [Mediation/Barangay Conciliation/Family Court] for resolution.
7.3. If legal action is necessary, the dispute shall be resolved in the appropriate Family Court in [City/Province], Philippines.
8.1. This Agreement shall be governed by the laws of the Republic of the Philippines, particularly the Family Code and other applicable laws on child support.
9.1. Binding Effect – This Agreement shall be binding upon the Parties, their heirs, successors, and assigns.
9.2. Severability – If any provision is found invalid, the remaining provisions shall remain in full force and effect.
9.3. Entire Agreement – This Agreement represents the full understanding between the Parties regarding child support obligations.
