Welcome to Kode: QR Code Scanner App ("the App"). These Terms of Service ("Terms") form a legally binding agreement between you ("User" or "you") and NGH ("Developer", "we", "us", or "our").
Please read these Terms carefully before downloading, installing, or using Kode: QR Code Scanner App. By downloading, installing, or using the App, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms, do not install or use the App.
1. Description of Service
Kode: QR Code Scanner App provides mobile utility features including, but not limited to:
Scanning and decoding QR codes and barcodes using your device’s camera.
Displaying decoded information (e.g., text, URLs, Wi-Fi details, contact info).
Generating QR codes for personal use.
Managing scan history locally on your device.
2. License and Use Restrictions
A. Limited License
Subject to your compliance with these Terms, NGH grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to download, install, and use Kode: QR Code Scanner App on an Android device that you own or control, solely for your personal, non-commercial use.
B. Prohibited Conduct
You agree that you will not:
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
Modify, translate, adapt, or create derivative works based on the App.
Use the App for any illegal purpose or in violation of any local, state, national, or international laws.
Attempt to gain unauthorized access to our servers, networks, or connected analytics tools.
Rent, lease, lend, sell, redistribute, or sublicense the App or its features to any third party.
Use the App to scan or create QR codes containing malicious payloads, phishing URLs, spyware, or illegal content.
3. Scanned Content & Third-Party Links Disclaimer (IMPORTANT)
A. Third-Party Web Links and Data
The App functions as a tool to read and decode information stored inside QR codes and barcodes. NGH does not control, inspect, verify, or endorse the content, safety, or legality of any third-party websites, URLs, or data contained within scanned codes.
B. User Assumption of Risk
When you scan a QR code or click on an external link decoded by the App, you do so at your own risk. NGH is not responsible or liable for:
Malicious software, phishing attacks, malware, or harmful content hosted on external websites opened via scanned QR codes.
The accuracy, reliability, or quality of products or services advertised via scanned barcodes/UPC codes.
Any financial loss, data breach, or device damage resulting from visiting external links decoded by the App.
We strongly advise you to exercise caution and inspect decoded URLs before opening them in a web browser.
4. In-App Purchases and Subscriptions
If Kode: QR Code Scanner App offers premium features, ad-free upgrades, or subscription plans:
Billing: All financial transactions, billing, and payments are processed directly by Google Play Store via Google Play Billing. We do not store or process your payment details.
Subscriptions: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period via your Google Play Account Settings.
Refunds: All refund requests are governed by Google Play’s official refund policies.
5. Intellectual Property Rights
All rights, title, and interest in and to Kode: QR Code Scanner App—including but not limited to software code, UI design, graphics, logos, icons, trademarks, and visual assets—are owned exclusively by NGH or its licensors.
Nothing in these Terms grants you any ownership rights or intellectual property rights in the App beyond the limited usage license explicitly stated in Section 2.
6. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, NGH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, TIMELY, OR SECURE.
THAT THE CAMERA DECODING ENGINE WILL RECOGNIZE 100% OF CODES UNDER ALL LIGHTING OR HARDWARE CONDITIONS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NGH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
LOSS OF DATA, DEVICE DAMAGE, OR SYSTEM MALFUNCTION.
LOSS OF PROFITS, REVENUE, OR GOODWILL.
ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, OR FROM ANY THIRD-PARTY WEBSITES VISITED VIA SCANNED QR CODES.
IN NO EVENT SHALL NGH’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU (IF ANY) TO ACCESS OR USE THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
8. Termination
We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, if we reasonably believe you have violated these Terms or applicable Google Play Developer Policies. Upon termination, your right to use the App will immediately cease.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our App features, legal requirements, or Google Play policies. Any updates will be published within the App or on our Privacy Policy page with an updated "Effective Date." Continued use of the App after any changes constitutes your acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to its conflict of law principles. Any legal disputes arising out of or related to the App shall be resolved in the competent courts of your jurisdiction.
