These Terms of Service ("Terms") govern your access to and use of the KitchenDesk mobile application and related services (the "Service"), operated by Rafael Yanez ("we", "our", or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is intended for professional service technicians and business owners aged 18 or older. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes, subject to these Terms. You may not copy, modify, reverse-engineer, resell, or create derivative works of the Service.
KitchenDesk offers a free plan and an auto-renewable paid subscription ("KitchenDesk Pro"), available as a monthly or annual plan.
Payment is charged to your Apple ID (iOS) or Google Play account at confirmation of purchase.
Auto-renewal: subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
Free trial (if offered): any unused portion of a free trial is forfeited when you purchase a subscription.
Managing and canceling: you can manage or cancel your subscription in your App Store or Google Play account settings after purchase. Cancellation takes effect at the end of the current billing period.
Price changes: we may change subscription prices; changes apply to future billing periods and, where required, will be communicated in advance.
Subscription pricing and plan details are shown in the app before purchase.
The Service lets you send invoices to your customers and accept card payments through Stripe, Inc. Those payments are processed by Stripe and are subject to Stripe's terms. We are not a party to the transaction between you and your customer, and we are not responsible for disputes, chargebacks, refunds, or taxes arising from those payments.
You retain ownership of the business data and content you enter into the Service (customers, equipment, tickets, reports, photos, etc.). You grant us a limited license to host, process, and display that content solely to provide the Service to you. You are responsible for the accuracy and lawfulness of the content you enter, including having the right to store any customer information you input.
You agree not to use the Service to violate any law, infringe any third party's rights, upload malicious code, attempt to gain unauthorized access, or interfere with the operation of the Service.
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Reports, health scores, cost estimates, and AI-assisted insights are provided for informational purposes only and do not constitute professional, legal, or financial advice. You are responsible for verifying any output before relying on it.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
You may stop using the Service and delete your account at any time from Settings → Delete Account in the app. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ends; data deletion is handled as described in our Privacy Policy.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute shall be brought in the state or federal courts located in Florida.
We may update these Terms from time to time. When we do, we will update the effective date above and, where appropriate, notify you within the app. Continued use of the Service after changes take effect constitutes acceptance.
