## 1. THIS IS NOT A DROP-OFF CLASS
**A parent or legal guardian must remain physically present with their child for the entire duration of the class.**
This is **not a drop-off class, childcare service, or babysitting service.** Kirsten Tate, the art instructor, is responsible for teaching the art class and providing reasonable class instructions, but does not assume the role of the child's parent, guardian, babysitter, or individual caretaker.
I understand that I am required to remain on the Premises and available to supervise my child from the beginning of the class until the class has ended and we have left the Premises.
I agree not to leave my child at the class without a parent or legal guardian present.
I understand that if I leave the Premises, I must take my child with me.
## 2. PARENT/GUARDIAN SUPERVISION
I understand that I remain responsible for supervising my child throughout the class.
I agree to monitor my child's behavior and promptly intervene if my child:
* Misuses artistic materials;
* Attempts to put materials in or on their body;
* Runs, climbs, or engages in unsafe behavior;
* Throws materials or objects;
* Interferes with another participant;
* Disregards safety instructions; or
* Otherwise behaves in a way that could endanger themselves or another person.
Kirsten Tate may provide instructions and intervene when reasonably necessary for class safety, but the Instructor is not responsible for continuously monitoring one individual child.
## 3. ARTISTIC MATERIALS AND POTENTIAL RISKS
I understand that the class may involve materials and equipment including, but not limited to:
* Paint
* Paintbrushes
* Glue and adhesives
* Clay
* Glazes
* Canvases
* Paper
* Crayons
* Markers
* Pencils
* Other artistic materials or tools
Some materials may cause irritation, allergic reactions, injury, staining, or other adverse effects if misused or if a participant has an individual sensitivity or allergy.
I understand that children are expected to use all materials only as instructed by the Instructor.
## 4. ALLERGIES, SENSITIVITIES, AND INDIVIDUAL REACTIONS
I understand that Kirsten Tate does **not know the complete allergy, medical, or sensitivity history of every participant, parent, guardian, or visitor who may enter the class environment.**
I further understand that the class environment cannot be guaranteed to be completely free of allergens.
For example, another participant may have recently handled or consumed a food containing an allergen, may have been exposed to an animal or pet, or may unknowingly bring an allergen or allergen residue into the class.
Airborne particles, residue on hands, clothing, personal belongings, or surfaces may potentially expose another participant to a substance to which they are sensitive or allergic.
I understand that Kirsten Tate cannot know or control every substance to which another participant has been exposed before arriving at class.
I also understand that artistic materials may cause an unexpected allergic reaction, skin irritation, respiratory reaction, or other adverse response, even if the material has been safely used by other participants.
**I am responsible for informing the Instructor of my child's known allergies, sensitivities, or other relevant restrictions before participation.**
I understand that the Instructor cannot guarantee that the class environment, artistic materials, surfaces, or other participants will be free of substances to which my child may be allergic or sensitive.
If my child has a severe or potentially life-threatening allergy, I understand that I must remain with my child and be prepared to administer or obtain any necessary medication or emergency treatment prescribed for my child.
## 5. UNSAFE OR IMPROPER USE OF MATERIALS
I understand that my child must not intentionally place paint, glue, clay, glaze, or other artistic materials in or on their:
* Mouth
* Eyes
* Ears
* Nose
* Skin
* Hair
* Or any other part of their body
unless specifically instructed to do so as part of a supervised activity.
If my child intentionally misuses materials or ignores the Instructor's safety instructions, I agree to immediately intervene.
Kirsten Tate and the Premises shall not be responsible, to the fullest extent permitted by law, for consequences arising from my child's intentional or improper use of artistic materials contrary to instructions.
## 6. RUNNING AND OTHER UNSAFE BEHAVIOR
Children must remain in the designated class area unless the Instructor or parent/guardian has authorized otherwise.
Running, climbing, roughhousing, throwing materials, intentionally misusing supplies, or engaging in other dangerous behavior is not permitted.
The parent/guardian is responsible for intervening when their child engages in unsafe behavior.
## 7. PERSONAL PROPERTY, CLOTHING, AND BELONGINGS
I understand that paint, glue, clay, glaze, markers, and other artistic materials may accidentally come into contact with clothing, shoes, jewelry, bags, phones, electronic devices, personal belongings, or other property.
**I am responsible for protecting my child's belongings, clothing, and personal property, as well as my own.**
Kirsten Tate, the Instructor, and the owner, operator, or responsible party of the Premises shall not be responsible or liable, to the fullest extent permitted by law, for stains, damage, loss, or destruction of clothing, shoes, jewelry, bags, electronics, personal belongings, or other property brought into or used during the class.
**Anything my child or I are wearing, carrying, holding, or otherwise have on our persons is our responsibility.**
## 8. RESPONSIBILITY FOR MY CHILD'S ACTIONS
I understand that I am responsible for supervising my child and for taking reasonable steps to prevent my child from intentionally or recklessly misusing artistic materials or engaging in unsafe behavior.
I understand that Kirsten Tate is not providing childcare or individual one-on-one supervision.
I acknowledge that my child's actions, including intentional misuse of materials, failure to follow instructions, running, or other prohibited behavior, may create risks to themselves or others.
## 9. RELEASE AND LIMITATION OF LIABILITY
To the fullest extent permitted by Florida law, I acknowledge the ordinary risks associated with participation in an art class and the use of artistic materials.
I understand that Kirsten Tate, the Instructor, and the owner, operator, or responsible party of the Premises cannot guarantee that my child will never be injured or experience an allergic reaction, skin irritation, or other adverse response while participating in an activity involving artistic materials or sharing a space with other participants.
I agree that Kirsten Tate and the Premises shall not be responsible, to the fullest extent permitted by law, for consequences arising from my child's own actions, intentional or improper use of materials, failure to follow safety instructions, or my failure to disclose known allergies or sensitivities.
Nothing in this agreement is intended to waive or eliminate any right or claim that cannot legally be waived under Florida law.
## 10. REMOVAL FROM CLASS FOR UNSAFE BEHAVIOR
Kirsten Tate reserves the right to require a child and/or parent or guardian to leave the class if the child or parent/guardian repeatedly:
* Disregards safety instructions;
* Misuses artistic materials or equipment;
* Runs, climbs, throws objects, or engages in dangerous behavior;
* Creates a risk of injury to themselves or another participant;
* Intentionally damages property;
* Refuses to follow reasonable class rules; or
* Otherwise behaves in a manner that materially interferes with the safety or operation of the class.
This may include requiring the parent/guardian and child to leave the Premises.
Removal from class for unsafe or seriously disruptive behavior may occur without a refund, to the extent permitted by the applicable class or registration terms.
## 11. ACKNOWLEDGMENT AND CONSENT
By signing below, I confirm that:

# ART CLASS LIABILITY WAIVER & PARTICIPANT AGREEMENT

By signing this agreement, I acknowledge that I am **18 years of age or older** and that I am voluntarily participating in an art class or activity conducted by **Kirsten Tate** ("Instructor") at the location designated for the class ("Premises").
## 1. Acknowledgment of Risks
I understand that art classes may involve the use of various artistic materials, tools, and equipment, including but not limited to:
* Acrylic or other paints
* Paintbrushes and other painting tools
* Glue and adhesives
* Clay and clay-related materials
* Glazes
* Canvases
* Paper
* Crayons
* Markers
* Pencils and other drawing materials
* Other artistic materials or tools used during the class
I understand that these materials may cause injury if they are misused, handled improperly, used contrary to the Instructor's directions, or used carelessly. Risks may include, but are not limited to, cuts, scrapes, irritation, allergic reactions, stains, accidental ingestion, eye or skin contact, slips, trips, or other accidental injuries.
I voluntarily accept responsibility for using all materials and equipment in a safe and reasonable manner and for following the Instructor's instructions.
## 2. Personal Property, Clothing, and Personal Items
I understand that art materials, including paint, glue, clay, glaze, markers, and other materials, may accidentally come into contact with clothing, shoes, jewelry, bags, phones, electronic devices, personal belongings, or other property.
**I am solely responsible for protecting my own personal property and clothing.**
Kirsten Tate, the Instructor, and the owner, operator, or other responsible party for the Premises shall not be responsible or liable, to the fullest extent permitted by law, for stains, damage, loss, or destruction of any personal property, clothing, accessories, electronic devices, or other items I bring into or use during the class.
I understand that **anything I am wearing, carrying, holding, or otherwise have on my person is my responsibility.**
## 3. Safe Use of Materials
I agree to use all artistic materials only for their intended purpose and in accordance with the Instructor's directions.
I will not intentionally place artistic materials or tools in my mouth, eyes, ears, nose, on my skin, or on any other part of my body in a manner that is unsafe or contrary to the Instructor's instructions.
I understand that failure to follow safety instructions may increase the risk of injury to myself or others.
## 4. Release and Limitation of Liability
To the fullest extent permitted by Florida law, I release and agree not to hold **Kirsten Tate, the Instructor, and the owner, operator, or responsible party of the Premises** liable for injuries, losses, or damages arising from my voluntary participation in the class, including injuries or damages resulting from my own actions, misuse of materials, failure to follow instructions, or failure to exercise reasonable care.
I understand that this agreement does not release liability to the extent such a release is prohibited or unenforceable under applicable law, including liability that cannot legally be waived.
## 5. Rules and Removal From Class
I agree to follow all reasonable class rules and safety instructions given by the Instructor.
I understand that Kirsten Tate reserves the right to require me to leave the class or Premises if I:
* Repeatedly disregard safety instructions;
* Intentionally misuse artistic materials or equipment;
* Engage in behavior that creates a danger to myself or another person;
* Damage property through reckless or intentional behavior;
* Disrupt the class to the point that the safety or ability of others to participate is affected; or
* Refuse to follow reasonable instructions concerning the safe use of materials.
Removal from class for unsafe or seriously disruptive behavior may occur without a refund, to the extent permitted by the applicable class or registration terms.
## 6. Personal Responsibility
I understand that I am responsible for my own actions and decisions while participating in the class.
I agree to immediately inform the Instructor if I am injured, experience an adverse reaction, or believe that a material or activity presents an immediate safety concern.

# TERMS OF CONSENT

I understand that photographs and/or video taken under my selected option may be used to promote:
* Future art classes;
* Art workshops and events;
* Art-related services offered by Kirsten Tate;
* Class registration and advertising;
* Social media pages and posts;
* Websites;
* Flyers and printed promotional materials;
* Online advertisements; and
* Other reasonable advertising or promotional materials relating to Kirsten Tate's art business.
### 2. No Payment or Compensation
I understand that I will not receive payment, royalties, or other compensation for photographs or video used under this release.
### 3. Editing and Cropping
I understand that photographs and video may be reasonably cropped, resized, edited, or otherwise formatted for use in advertising and promotional materials, provided that such editing remains consistent with the option I selected above.
### 4. No Guarantee of Publication
I understand that granting permission does not require Kirsten Tate to use any photograph or video.
The Instructor may choose whether, when, where, and how an authorized photograph or video is used.
### 5. Name and Personal Information
Unless separately authorized in writing, **this release does not automatically authorize the publication of my/my child's full name, address, telephone number, email address, or other private personal information.**
Photographs may be used to promote the art classes without identifying the participant by full name.
### 6. Group Photography
I understand that art classes may involve multiple participants in the same room.
Kirsten Tate will make reasonable efforts to follow each participant's selected photography preference. I understand, however, that completely preventing a person's incidental appearance in every photograph or video taken during a group activity may not always be possible.
### 7. My Selection Controls
I understand that the option I select above represents my permission regarding the intended use of my/my child's image.
**Kirsten Tate agrees to honor the selected level of consent to the extent reasonably practicable.**
If I select Option 1, I am not granting permission for intentional promotional photography of me/my child.
If I select Option 2 or Option 3, I am granting permission only within the limitations described in that option.
If I select Option 4, I am granting broader permission for promotional photography and video.
### 8. Voluntary Consent
I understand that participation in an art class does not require me to grant photography or promotional consent.
I am voluntarily selecting the option above.
### 9. Duration and Withdrawal of Consent
This consent applies to photographs and video taken during the class/event identified above and may be used for the purposes described in this form.
I may withdraw my consent for **future use** by providing written notice to Kirsten Tate.
I understand that withdrawal does not require the removal of promotional materials that were already printed, distributed, published, or otherwise created before the withdrawal was received, and that previously published social-media posts or other materials may not be capable of being completely removed from third-party platforms or from copies that have already been distributed.
