ÇEREZ AYDINLATMA METNİ

İşbu Kişisel Verilerin İşlenmesine İlişkin Çerez Aydınlatma Metni (“Çerez Aydınlatma Metni”), 6698 sayılı Kişisel Verilerin Korunması Kanunu’nun (“KVK Kanunu”) 10. maddesi ile Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ kapsamında veri sorumlusu sıfatıyla 3A TEKNOLOJİ HİZMETLERİ tarafından hazırlanmıştır.

Mobil uygulamamızda, kullanıcı deneyiminizi iyileştirmek, performansı izlemek, uygulamanın teknik işleyişini sağlamak ve reklam faaliyetlerini yürütmek amacıyla çerez benzeri teknolojiler (SDK'lar, cihaz tanımlayıcıları, log verileri vb.) kullanılmaktadır. Kullanılmakta olan çerez ve piksellerin cihazınıza yerleştirilmesi aracılığıyla otomatik yolla elde edilen kişisel verilerinizin işlenmesine ilişkin olarak sizlere bilgi vermektir. İşbu metinde sitemizde ve uygulamamızda hangi amaçlarla hangi tür çerezleri kullandığımızı ve bu çerezleri nasıl kontrol edebileceğinizi sizlere açıklamak istiyoruz.

Çerezler, pikseller, gifler gibi takip teknolojileri (“Çerezler”) uygulama kullanımınız esnasında tablet, telefon ya da bilgisayarlarınız gibi cihazlarınıza yerleştirilen küçük metin dosyaları ya da tarayıcınız üzerinde çalışan kodlardan oluşmaktadır. Çerezler sayesinde uygulamada veya internet sitesinde size ait cihazları tanıyarak örneğin dil tercihlerinizi veya site üzerindeki trafiğin yönetilmesini sağlar. Çerezler ayrıca uygulamanın ziyaretçi sayısını ve kitlesini analiz ederek yazılımlarımızı sizlere daha iyi bir deneyim sunabilmek için geliştirebilmemize ve tercih etmeniz halinde, internet kullanımınız esnasında görüntülediğiniz reklamları kişiselleştirmemize yardımcı olur.

KVK Kanunu uyarınca, internet sitesi veya uygulama üzerinde kullanılan çerezlere ilişkin olarak kişisel verileriniz; veri sorumlusu olarak tarafımızca aşağıda açıklanan kapsamda işlenebilecektir.

Kişisel Veri Toplamanın Yöntemi

Kişisel verileriniz, internet sitesini ziyaretiniz kapsamında veya mobil uygulamamızı kullanmanız dolayısıyla elektronik ortamda çerezler yoluyla tarafımızın/şirketimizin meşru menfaatine yönelik hukuki sebebe dayalı olarak toplanmaktadır. Hedefleme ve profilleme vasıtasıyla gerçekleştirilen pazarlama ve reklamcılık faaliyetleri ise yalnızca açık rızanız olması halinde gerçekleştirilmektedir. Toplanan kişisel verileriniz KVK Kanunu’nun 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları ve amaçları kapsamında işbu Çerez Aydınlatma Metni’nde belirtilen amaçlarla da işlenebilmektedir.

Kişisel Verilerin Hangi Amaçlarla İşleneceği ve Hukuki Sebebi

Toplanan kişisel verileriniz, aşağıda yer verilen amaçlar (“Amaçlar”) ve hukuki sebepler ile KVK Kanunu’nun 5. maddesinde belirtilen kişisel veri işleme şartları ve amaçları dâhilinde işlenecektir. İnternet sitesi/uygulama üzerinde farklı amaçlarla çerezler kullanılmaktadır. Kullanılan ilgili çerezin türüne göre veri işleme amaçları ve ilgili çerezi kullanırken dayandığımız KVK Kanunu kapsamındaki veri işleme şartı değişebilmektedir.

Zorunlu Çerezler (Her Zaman Etkin)

Zorunlu çerezler, internet sitesini/uygulamayı görüntülemeniz esnasında cihazınıza yerleştirilen ve sunulan çevrimiçi servislerin düzgün şekilde çalışabilmesi için gerekli olan çerezlerdir. Bu çerezlerin kullanımı esnasında gerçekleştirdiğimiz veri işleme faaliyetleri için KVK Kanunu m.5 kapsamında “Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması” ve “İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması.” veri işleme şartlarına dayanmaktayız.

Performans ve Analitik Çerezleri (İsteğe Bağlı)

Performans ve analitik çerezleri, internet sitesi/uygulama ziyaret ve trafiğini takip ve analiz etmemizi sağlar. Bu çerezler sayesinde internet sitesi/uygulama üzerindeki alanlardan hangilerinin en sık ya da seyrek ziyaret edildiği gibi bilgileri edinebilir ve internet sitesinin/uygulamanın trafiğini en uygun duruma getirebiliriz. İlgili bilgi toplama hizmetini açıkça talep ettiğiniz hallerde söz konusu olan çerezlerin ve genel istatistiksel bilgi elde edebilmek gibi kullanıcıların mahremiyetine önemli ölçüde etki etmeyecek amaçlarla kullanılan ve istatistiksel ölçüm araçları olan birinci taraf analitik çerezlerinin kullanımı esnasında gerçekleştirdiğimiz veri işleme faaliyetleri için KVK Kanunu m.5 kapsamında “İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması” ve “Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması” veri işleme şartlarına dayanmaktayız. İlgili bilgi toplama hizmetini açıkça talep etmediğiniz hallerde söz konusu olan çerezlerin ve üçüncü taraf analitik çerezlerinin kullanımı esnasında gerçekleştirdiğimiz veri işleme faaliyetleri için KVK Kanunu m.5 kapsamında söz konusu olması halinde “açık rızanıza” dayanmaktayız.

Kişiselleştirilmiş Reklam ve Pazarlama Çerezleri (İsteğe Bağlı)

Kişiselleştirilmiş reklam çerezleri, sizlere internet sitesinde/uygulamada veya internet sitesi/uygulama haricindeki mecralarda görüntüleme geçmişinize ve ziyaretçi profilinize uygun olarak kişiselleştirilmiş ürün ve hizmet tanıtımı yapmak için kullanılır. Bu çerezlerin kullanımı esnasında gerçekleştirdiğimiz veri işleme faaliyetleri için KVK Kanunu m.5 kapsamında veri işleme şartı olarak “açık rızanıza” dayanmaktayız.

This Personal Data Processing Cookie Disclosure Text (“Cookie Disclosure Text”) has been prepared by 3A TEKNOLOJİ HİZMETLERİ in the capacity of data controller within the scope of Article 10 of the Personal Data Protection Law No. 6698 (“KVKK Law”) and the Communiqué on the Procedures and Principles to Be Complied with in Fulfilling the Obligation to Inform.

Cookie-like technologies (SDKs, device identifiers, log data, etc.) are used in our mobile application to improve your user experience, monitor performance, ensure the technical functioning of the application, and carry out advertising activities. The purpose of this text is to inform you regarding the processing of your personal data obtained automatically through the placement of the cookies and pixels currently in use on your device. In this text, we would like to explain to you what types of cookies we use on our website and application, for what purposes, and how you can control these cookies.
