1. General

1.1 Definitions and Acceptance

These Terms of Use (also referred to as the “Terms of Service,” “Terms,” “User Agreement,” or “Agreement”) form a legally binding agreement between you and Kashish. You may access or use Kashish in an individual capacity or on behalf of a business, company, organization, or other legal entity.

Throughout these Terms, Kashish may be described as the “Website,” “Application,” “Platform,” “Service,” or “Services,” depending on the context.

The terms “Kashish,” “we,” “us,” and “our” refer to the entity responsible for providing and operating Kashish. The terms “you,” “your,” “user,” and “visitor” refer to any individual or entity that accesses, visits, registers for, or uses the Website, Application, Platform, or Services.

Unless a specific provision indicates otherwise, “Content” and “Materials” include information, communications, text, images, audio, video, data, software, and other materials or content that are provided, displayed, uploaded, transmitted, or otherwise made available through Kashish.

1.2 Age Requirement

By accessing, registering for, or using Kashish or any of its Content, Materials, or Services, you represent and confirm that you are 18 years of age or older, or that you have reached the applicable legal age of majority in your country, state, or region where such age is higher.

Kashish is intended solely for users who satisfy the applicable minimum age requirement. If you are below the required age, you are not permitted to access, register for, or use Kashish or any related Services.

2. Content and User Conduct

When using Kashish, you agree not to engage in any activity that violates these Terms or applicable laws. Prohibited activities include, but are not limited to:

(i) Defaming, libeling, harassing, or otherwise violating the privacy, publicity, intellectual property, or other rights or interests of another person.

(ii) Using the Products or Services in any way that may damage, disable, overload, interfere with, or otherwise impair the normal operation of the Application, Platform, or Services.

(iii) Uploading, displaying, transmitting, distributing, or sharing any text, sound, audio, image, photograph, video, or other material that we reasonably determine to be hateful, threatening, obscene, abusive, discriminatory, racially or ethnically offensive, defamatory, or otherwise inappropriate.

(iv) If you submit or share Content that is protected by intellectual property rights, you represent and warrant that you are the lawful creator or owner of such Content, or that you have obtained all rights, permissions, and authorizations necessary to use and provide the Content to us. You further agree to be responsible for all royalties, fees, compensation, or other amounts that may be owed to any third party in connection with your Content.

(v) Attempting to gain unauthorized access to, hack, disrupt, damage, or destabilize the Website, Application, Services, or their source code, or falsely representing that any third-party website, application, product, or service is affiliated with or officially associated with Kashish.

(vi) Accessing or using the Products or Services through any interface, method, software, or system that has not been provided, authorized, or required by us.

(vii) Using the Products or Services to distribute worms, viruses, malware, or any other code, files, or programs designed to be harmful, destructive, or disruptive.

(viii) By submitting, transmitting, displaying, or otherwise making Content available through the Application or Services, you grant Kashish a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, transmit, publish, display, distribute, modify, or otherwise utilize such Content for the operation, promotion, and marketing of our products and services.

(ix) Submitting, transmitting, displaying, or distributing any Content or other material that depicts physical violence, promotes violence, encourages criminal conduct, or could otherwise result in criminal or civil liability.

(x) When you voluntarily share information with other users through the Application, including photographs, text, screenshots, videos, or other communications, you acknowledge that you may no longer have complete control over how such information is used or distributed. Depending on your actions and the actions of the users with whom you share the information, such Content may become accessible to others or publicly available.

You are responsible for all Content that you submit, transmit, display, or otherwise make available through Kashish and for ensuring that your use of the Products and Services complies with these Terms and applicable laws.

3. Third-Party Technology

The Application may include, use, or depend on software, technical solutions, components, libraries, or other materials provided or controlled by third parties. These third-party technologies may be incorporated into the Application itself or used to support certain features and functions of the Services.

Unless we expressly indicate otherwise, any third-party software or technology incorporated into or used by the Application may be subject to these Terms to the extent that such provisions are applicable to its use.

For convenience and to provide additional functionality, the Services may contain links, references, integrations, or other means of accessing websites, applications, products, or services that are operated independently by third parties (collectively, “Reference Sites”).

The availability of a Reference Site through the Services does not mean that Kashish endorses, sponsors, recommends, approves, or otherwise supports the relevant third party or any of its products, services, content, or activities.

Any decision to access or use a Reference Site is made at your own discretion and risk. This includes any information, content, materials, products, or services obtained through such third-party resources.

Kashish does not control and, to the maximum extent permitted by applicable law, assumes no responsibility for the availability, accuracy, security, quality, content, policies, or business practices of any Reference Site or other third-party service. Your interactions with third-party websites or services are governed by the terms and policies established by those third parties.

4. Payment Policy

Certain features, products, or services available through Kashish may require you to pay fees. By making a payment, you agree to comply with all applicable payment terms, conditions, and requirements provided by Kashish.

You are solely responsible for any fees, charges, duties, or taxes associated with your purchases or other payments made through Kashish, unless otherwise required by applicable law.

Prices, product availability, service availability, and other commercial terms may be modified at any time without prior notice, subject to applicable laws and regulations.

Except where a refund is required by applicable mandatory laws or regulations, or where Kashish has expressly provided a specific refund policy for a particular product or service, all purchases made through Kashish are final and non-refundable.

Any item, virtual item, product, or service purchased through Kashish is non-refundable regardless of whether it has been used, consumed, or remains unused, except where a refund is required by applicable law or expressly permitted under a specific Kashish policy.

5. Account Termination

You may stop using the Application and/or Services at any time by deleting your Kashish account.

We reserve the right to restrict, suspend, or terminate your access to the Application, Services, account, or these Terms, immediately and without prior notice, if we reasonably believe that you have violated, or may violate, any provision of these Terms or otherwise engaged in conduct that may adversely affect Kashish, its users, or the Services.

Upon termination or suspension of your account, you will not be entitled to receive a refund for any paid content, products, items, or services associated with the period before the termination of your account, except where otherwise required by applicable law.

6. Your Data and Feedback

Your personal information and other data will be collected, processed, stored, and handled in accordance with our Privacy Policy.

We may retain or otherwise store Content and other materials that you provide in connection with your use of the Products and Services, to the extent permitted by applicable law.

If you provide suggestions, comments, ideas, recommendations, or other feedback regarding Kashish, the Application, Products, or Services ("Feedback"), you agree that Kashish may use such Feedback without restriction.

You grant Kashish an exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, or otherwise utilize your Feedback for any purpose, whether commercial or non-commercial, without any obligation to provide you or any other person with compensation, credit, or attribution.

We are not obligated to keep your Feedback confidential or to use any Feedback that you provide.

You acknowledge and agree that providing Feedback does not grant you any ownership, intellectual property rights, or other rights in the Products, Services, or any resulting changes, modifications, improvements, or corrections.

You are solely responsible for all materials and Content that you submit or provide through Kashish, including their legality, accuracy, reliability, appropriateness, originality, and compliance with applicable copyright and other intellectual property laws.

By submitting Content or Feedback, you represent that you have the necessary rights and authority to provide such materials and to grant the rights described in these Terms.

7. Limitation of Liability

Certain features of the Application require a functioning internet connection. This connection may be provided through Wi-Fi or through your mobile network provider. Kashish does not assume responsibility for any interruption, restriction, or loss of functionality resulting from an inadequate or unavailable internet connection, including circumstances where you have used all or exceeded the data allowance provided by your network operator.

If you access the Application using mobile data, your existing agreement with your mobile network provider will remain applicable. You may therefore incur charges for data usage, network services, or other related services supplied by your network operator or third parties. You are solely responsible for any such costs. This includes roaming or other additional charges that may apply when using the Application outside your normal country or region, particularly where mobile data roaming remains enabled.

You are also responsible for ensuring that the device you use meets the requirements necessary to access and operate the Application. This includes keeping your device sufficiently charged and maintaining the device in working condition. Kashish will not be responsible for your inability to access or use the Services because your device is powered off, has insufficient battery capacity, has become unavailable, or is otherwise unable to operate properly.

Kashish makes reasonable efforts to maintain the accuracy and currency of information and functions available through the Application. Nevertheless, some content, information, features, or services may originate from or depend upon third-party sources. As a result, Kashish does not guarantee that such information or functionality will always be complete, accurate, reliable, current, or continuously available. To the maximum extent permitted by applicable law, Kashish shall not be liable for any direct, indirect, incidental, consequential, or other losses resulting from your use of or reliance upon such information or functionality.

The Application may be modified, enhanced, updated, or otherwise changed periodically. Requirements relating to supported operating systems, devices, or other technical environments may also change over time. You may therefore be required to install updates in order to maintain access to certain features or continue using the Application.

Although Kashish may release updates when considered appropriate, we do not guarantee that every part of the Application will always receive updates or remain compatible with every device, operating system, or operating system version. You are responsible for installing available Application updates and accepting applicable update requirements when necessary to continue using the Services.

Kashish may also suspend, discontinue, or permanently end the Application or any portion of the Services at any time, subject to any notice requirements imposed by applicable law or otherwise communicated by Kashish.

Unless Kashish expressly states otherwise, when the Application or your access to the Services is terminated:

(a) any rights, permissions, or licenses granted to you under these Terms will end immediately; and

(b) you must cease all access to and use of the Application and, where applicable, uninstall or remove the Application from your device.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kashish, together with its employees, representatives, affiliates, and other related parties, from and against any third-party claims, demands, liabilities, losses, damages, costs, or expenses arising from or connected with:

(a) your actions, omissions, or conduct in connection with your use of the Website, Application, or Services; or

(b) any Content, information, materials, or other items that you submit, upload, transmit, publish, display, or otherwise make available through the Services.

This obligation applies to claims and losses arising from your use of the Services or materials you provide through them, to the extent permitted by applicable law.

8. Changes to These Terms

Kashish may revise, amend, or update these Terms of Use from time to time in response to changes in our Services, business practices, applicable laws, or other relevant circumstances.

When changes are made, the updated version of the Terms will be published on this page. We encourage you to review these Terms periodically so that you remain aware of the latest applicable provisions.

Your continued access to or use of the Application or Services after the revised Terms become effective will constitute your acceptance of the updated Terms.

If you do not agree with any revised provision, you should stop using the Application and Services.

9. Arbitration

Kashish specifically draws your attention to the provisions of these Terms that may limit or exclude Kashish's liability or otherwise affect your rights and interests. You are encouraged to carefully review these provisions and independently assess the potential risks associated with using the Application and Services.

If any dispute, controversy, or claim arises between you and Kashish in connection with these Terms or your use of the Application or Services, the parties should first attempt to resolve the matter through good-faith negotiation.

If the dispute cannot be settled through negotiation or mediation, the dispute shall be referred to the Hong Kong International Arbitration Centre ("HKIAC") for arbitration in accordance with the arbitration rules applicable at the time the arbitration is commenced.

The seat and place of arbitration shall be Hong Kong.

The arbitral award shall be final and binding upon both parties, subject to any rights or remedies that cannot legally be excluded under applicable law.
