Terms of Service

Its important to read and look over this page before commissioning me! If you have any questions, especially in regards to the application of these terms on specific commissions (adoptables, sketches, etc.), feel free to email me over at Kagehkins@gmail.com. This document is where the artist lays out their rights and the patrons rights to the product being delivered. A TOS is a set of official rules in which one must agree to abide by in order to use a service. By buying artwork, arpg things (imports, genos, items, and ect) designs and ect from me, you are agreeing to the TOS automatically.


The Basics


What can you draw?

I can draw just about anything! I pride myself in my ability to draw anything from humans to animals and anything in between. I’m willing and open to new challenges. Although, my human skills are improving, I am still willing to draw them


What I will NOT draw

  • Anything Illegal

  • NSFW things at this time.


About deadlines

When commissioning me, please understand that, deadlines can be somewhat ambiguous due to circumstances in life! I do not do this as a living this is for some extra cash. Sometimes I will set a deadline, but that’s entirely on my terms. If, for any reason, a deadline I set is missed, I will contact my clients and let them know! I can possibly offer a rush commission for a fee of course.

**I generally do not work on holidays


Please have your ideas and information ready.

It is a lot better if you have ideas on what you'd like. Being detailed as possible will help me figure out what to draw exactly. That will go from designs, to poses, and ect! It will result in less edits from me. The more concise you are, the happier I am. I love working with direction and I aim to please! You are paying me money and I want it to be as perfect as possible.


I have the right to choose what commissions I post to my pages/social media platforms/websites.

It’s nothing personal and it t does not mean I do not like your piece. Sometimes I simply like to showcase some commissions while I’d rather keep others private. If you do not want me to we can discuss this at the time of commissioning but if you don't ask or bring it up, I do not have to take it down when you ask me to.


Payments

  • I send invoices via PAYPAL. You do not need a paypal account to purchase, however by commissioning me, buying a design (character), or an arpg critter, the client agrees to be of legal age (18 Years or Older) to utilize PayPal services.

  • Payment is expected up front unless otherwise negotiated or stated! Payment plans can be negotiated for pieces that exceed $50.00 USD. With payment plans, I at least will require a down payment which is non-refundable

  • Failure to pay will result the commission to be terminated. This will result in the contract being voided. I retains all rights to the supplied approved artwork created prior to billing and is permitted to do with as they please.

Payments with dA points

  • Your commission will be completed once the process of points to money have been converted. This process currently takes about 14 days. This is due to people sending artists money then taking the points right back after their commission's have been complete and it takes that long to process the payments to PayPal. So with this option you will have to wait a small while to get your commission.

  • I will make a commission widget for you so please wait before you send the points or I will just send them back!

Refunds

  • If the rules on the journal/thread where I have posted what I'm offering at the time says "no refunds at this time" means it does not qualify for a refund at that time. Please keep that in mind.

  • If the commission has not been started and termination is requested, the client is subject to a full refund.

    • Payment plans will have a non-refundable deposit which is not refundable (the client won't get this back)

  • If work has begun, the client is subject to a partial (50%) refund up to the lining and coloring stage.

    • Past this stage (lining and coloring) refunds are negotiable on a circumstantial basis but a full refund is no longer permitted.

  • If the commission is COMPLETED it is not eligible for a refund!

    • Once artwork is paid off, completed, and supplied refunds are non negotiable. All refunds are a case-by-case basis prior to artwork being completed.

  • If Arpg Bulk commissions- this will depend on how many rolls I have done and what stage the rest are in since the different stages of sketching, lining, coloring, and ect will be different from a normal commissioned piece.

  • Charge-backs are ABSOLUTELY forbidden! You MUST contact me if you want a refund, I do not bite and I will refund you if you need to cancel it. I understand that emergencies happen! Just let me know

PAYPAL SHIPPING DISCLAIMER
Please note that most of my sales are "Digital Artwork" who's "Intellectual Property" is purchased by the client, and in most cases, nothing is ever intended by either me or client, to be physically shipped to them. Occasionally, the pay method provided by the client will mark a transaction as 'not shipped', however, I am not required ever to ship any item unless it was explicitly discussed within the correspondence between the Client and I.

Legal Things

The client (YOU) must be 18+ to order a commission

Plain and simple. Whoever is buying the art must be of the legal age to utilize PayPal’s services. In the USA, the legal age to have a PayPal is 18+, I have the right to ask for ID!


The commissioner may upload the work done for you to your site as long as it is credited and linked back to any of my galleries. Once a piece is commissioned, you may use it for any personal use that you please, including but not limited to icons, signatures, layouts, wallpapers, themes and personal site display. You cannot resell it to reproduce into shirts, keychains, mugs, and ect without permission. Contact me if you plan on doing so.


Harassment, bullying, blackmail, and/or stalking is not taken lightly or kindly. Please understand this. I really enjoy keeping an up-beat semi-professional vibe when engaging with you guys!


Editing the images are a big no no. I own right to the art! I may use any art I have produced for advertisements, examples, and/or publicity. Any art that has been produced by me is not permitted to be altered or edited without permission by anyone else. Any art that has been produced by me is not permitted to be altered or edited without permission by anyone else; This means, if you get a sketch YOU MAY NOT color it/finish it yourself or have another artist finish it for you without my consent! Customers are only granted a print release. That means you can only PRINT it for yourself, not modify it. If you purchase a sketch, and later decide you want it colored or finalized, please contact me!


About Getting Edits


Clients are allowed up to 4 edits. These edits are permitted and free of charge when they are four three phases. Any additional edits will be considered a complete image re-draw and may be subjected to additional charges at my discretion. Once the image as reached the coloring stage there are no more edits unless the color is not correct on a case by case basis.


Please do not ask me to draw in a certain style, you are commissioning me for my style. Please trust my judgement, I have the right to decline any edits that I feel is not following the parameters of my illustration style.


Once you have given me permission to publish your commission, I can not (and will not) change something because you have either- changed your mind, your character, broke up with that person in the image, etc. I have the right to deny your request to take down the art as well.


If you have opted for the no WIP or artistic freedom, edits are only allowed by a case-by-case basis and may be declined. I am assuming you trust my judgement and want me to take full control of your commission/project. I normally work right through these well into the completion phase.


Regarding ARPG items

First here are a list of definitions in case some of you do not know what these mean when I mention them. This section will include genos, imports, and items since they work differently than regular commissions. It will also include if they are eligible for refunds are the bottom of each section.


What is an arpg?

An ARPG - short for art role playing game - is a type of game where you use art and literature to progress and advance in the game.


What is a geno?

A geno is is the recipe for what your arpg creature it will look like! The particular order of letters tells you what genes the arpg creature has, and by layering these markings on top of each other you'll end up with an arpg creature. Here is an examples of a geno

What is an Import?

An import is the design that you have of an arpg creature. They are basically adoptables of certain closed species. Here are some examples of my arpg creature imports

What are arpg items?

Arpg items range from activity rewards to modifying your arpg creature. These help boost your arpg creature in some way, shape, or form.

What are slots?

Slots are the permissions of breeding my arpg creatures to others within that arpg group. These are also my breeding rules.

  • Once the slot permission is made it cannot be refunded.

  • You can resell this for the price that you have bought it for. Notify me if you want to trade/sell the slot.

  • To be used by you, or to be split with you and another person otherwise.

  • Other Breeding rules will be in with the permission comment within the group.

  • If purchased with points, I will not write the transfer until it is cleared. (refer to the payment section about points)

I may use any art I have produced for advertisements, examples, and/or publicity. I own the right to the art! Any art that has been produced by me is not permitted to be altered or edited without permission by anyone else; This means, if you get a sketch YOU MAY NOT color it/finish it yourself or have another artist finish it for you without my consent! Customers are only granted a print release. That means you can only PRINT it for yourself, not modify or resell it. If you purchase a sketch, and later decide you want it colored or finalized, please contact me!


I also have the right to deny your request. This means if I say no, it means no and I will not draw it.
