Terms of Use
1. Introduction
Welcome to the JustFlow mobile application and any other products or services owned or operated by JustFlow LLP(“Company,” “JustFlow,” “we,” “us,” or “our”) (collectively, the “JustFlow Service”). To access the JustFlow Service, you must at all times agree to and abide by these Terms of Use, including any additional guidelines and any future modifications (collectively, these “Terms”). These Terms are a legal contract between you, a user of at least 18 years of age (“you” or “User”), and JustFlow regarding your use of the JustFlow Services.
By accessing, installing, browsing, using, subscribing to, or registering for the JustFlow Service (including any content created, uploaded, downloaded, copied, published, or shared during use), you acknowledge that you have read, understood, and agree to be bound by these Terms. If at any time you do not agree to these Terms, you must discontinue use of the JustFlow Service.
Although the JustFlow Service strives to continuously improve, it is not perfect. While we make reasonable efforts to ensure that information provided is accurate, we cannot guarantee the accuracy, completeness, or reliability of any and all information, data, or content on the Service.
You agree and understand that during your use of the JustFlow Services, no content or feedback can be used as the sole basis for any civil or commercial activities performed by you and/or others; otherwise, all risks that may arise from such activities and all responsibilities shall be borne by you, not JustFlow.

2. Authorized Users
Your access to and use of the JustFlow Service is subject to all applicable international, national, federal, state, and local laws and regulations.
You represent and warrant that you will not use the JustFlow Service in any manner or for any purposes that are unlawful or prohibited by these Terms.
The JustFlow Service is not for persons under the age of 18. If you are under 18 years of age, you may not use the JustFlow Service.
3. Specific Features and Services
When using the JustFlow Service, you may be subject to additional posted guidelines or terms and conditions applicable to specific services and features which may be posted from time to time (the “Guidelines”). All such Guidelines are hereby incorporated by reference into these Terms.
In addition, your use of the JustFlow Service is governed by the JustFlow Privacy Policy, available within the Application and at our official website. The Privacy Policy is incorporated by reference into these Terms, and by using the Service you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
4. Changes
JustFlow may revise these Terms from time to time. We may post a notice on the JustFlow Service when the Terms have been modified, but such notice may not remain in place indefinitely.
Accordingly, you should review the Terms as posted from time to time. Your continued use of the JustFlow Service after revised Terms have been posted will constitute your acceptance of the revised Terms.
5. Limited License
Subject to these Terms, JustFlow grants you a limited, revocable, non-transferable, non-exclusive, non-sublicensable license to use the JustFlow Services (and all updates or upgrades provided) solely for your personal, non-commercial purposes, in accordance with these Terms.
6. Ownership; Proprietary Rights
The JustFlow Service is owned and operated by JustFlow LLP. The content, visual interfaces, information, graphics, design, compilation, computer code, products, software, algorithms, services, and all other elements of the JustFlow Service that are provided by JustFlow (“JustFlow Materials”) are protected by applicable copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights.
For clarity, JustFlow Materials do not include any User Content (defined in later sections) or content from third-party sites, whether or not the JustFlow Service provides a link to them.
All JustFlow Materials contained on the JustFlow Service are the copyrighted property of JustFlow LLP, its affiliates, or third-party licensors. All trademarks, service marks, and trade names are proprietary to JustFlow LLP or its licensors.
Except as expressly authorized by JustFlow, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, decompile, disassemble, reverse engineer, create derivative works from, or otherwise make unauthorized use of JustFlow Materials.
As a condition of your use of the JustFlow Service, you agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Access to JustFlow Materials and the JustFlow Service from territories where their content is illegal is strictly prohibited. Users are responsible for complying with all local rules, laws, regulations, and policies, including without limitation those related to intellectual property rights, the internet, technology, data, email, and privacy.
Any use by you of JustFlow Materials other than for private, personal use is prohibited.
You will not use the JustFlow Service in any manner that, in our sole discretion, could damage, disable, overburden, or impair it, or interfere with any other party's use of the Service. Specifically, you agree that you will not:
· Take any action that imposes an unreasonable or disproportionately large load on JustFlow’s infrastructure.
· Intentionally interfere with or damage the operation of the Service or any user’s enjoyment of it, including by uploading or disseminating viruses, worms, or other malicious code.
· Remove, circumvent, disable, damage, or otherwise interfere with any security-related features of the Service, features that prevent or restrict the use or copying of any content, or features that enforce limitations on use.
· Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service, through hacking, password mining, or any other means.
· Interfere with or attempt to interfere with the proper working of the Service or any activities conducted on it.
· Obtain or attempt to obtain any materials or information through means not intentionally made available through the Service.
· Modify the Service in any manner or use modified versions of the Service for unauthorized purposes.
The JustFlow Service may contain robot exclusion headers. You agree not to use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission, nor to bypass any measures we may use to restrict access.
You may not:
· Use framing techniques to enclose any trademark, logo, or other JustFlow Materials without our express written consent.
· Use meta tags or “hidden text” utilizing JustFlow’s name or trademarks without our express written consent.
· Deep-link to the Service without permission, and you agree to promptly remove any links that JustFlow deems objectionable in its sole discretion.
· Use any JustFlow logos, graphics, or trademarks as part of links without express written consent.
· Send junk mail or spam to other users of the Service, including but not limited to unsolicited advertising, promotional materials, chain letters, bulk mailings, petitions, or charity requests.
You agree not to use the JustFlow Service to create, upload, download, copy, publish, or distribute any content that:
· Violates any law, regulation, or policy
· Harms national interests or security
· Incites ethnic, racial, or religious discrimination or hatred
· Undermines social stability
· Contains obscenity, pornography, gambling, violence, terrorism, or related content
· Defames, insults, or threatens others, or infringes on the rights and interests of others
· Contains abusive, harassing, or otherwise harmful material
By uploading or publishing any content (“Your Content”) to the JustFlow Service, you grant JustFlow LLP a worldwide, non-exclusive, irrevocable, royalty-free, perpetual, fully-paid, sublicensable (through multiple tiers), and transferable license to:
· Use, reproduce, distribute, publish, translate, publicly perform, publicly display, and create derivative works of Your Content in any format or medium now known or later developed.
· Display Your Content in the JustFlow App and in JustFlow’s other products or services.
· Share Your Content with affiliated companies or trusted partners without needing further consent.
JustFlow reserves the right to display advertisements and sponsorships in connection with Your Content.
We may remove Your Content, at our sole discretion and without notice, if it infringes upon the rights of others or violates these Terms. We also reserve the right to suspend or terminate access to users who repeatedly infringe intellectual property laws.
You are solely responsible for any claims or damages arising from Your Content, and you agree to indemnify JustFlow for all losses, damages, or expenses resulting from such claims.
You represent and warrant that:
· Your Content does not infringe any third party’s intellectual property rights, right of publicity, privacy rights, moral rights, or other legal rights.
· You own or otherwise have the necessary licenses, rights, and permissions to use and share Your Content, and to grant JustFlow the rights described in Section 8(b).
JustFlow may use various methods to verify your identity when you register for, access, or use the Service. Such verification is intended only as an indication of increased likelihood that your identity is correct and does not guarantee it.
You authorize JustFlow, directly or through third parties, to make any inquiries we consider necessary to validate your registration.
You agree that all information you provide to JustFlow upon registration, and at all other times, will be true, accurate, current, and complete. You also agree to maintain and promptly update this information to keep it accurate and current.
When you register, you will be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.
You agree to:
· Keep your password confidential and secure.
· Restrict access to your device and account.
· Immediately notify JustFlow if you suspect unauthorized use of your account (e.g., loss, theft, or disclosure of your credentials).
You will be liable for any losses incurred by JustFlow or others due to unauthorized use of your account, whether or not caused by you.
Under these Terms, you consent to receive communications from JustFlow electronically. We will communicate with you by email or by posting notices within the JustFlow Service. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
Except as explicitly stated otherwise, legal notices shall be served on JustFlow’s registered business address or to the email address you provide to JustFlow during the registration process. Notice shall be deemed given 24 hours after an email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to the address you provided during registration. In such case, notice shall be deemed given three (3) days after the date of mailing.
You may, but are not required to, provide suggestions, comments, ideas, or know-how, in any form, to JustFlow related to the JustFlow Services (“Feedback”).
Any Feedback you provide shall not be considered confidential information, and JustFlow shall be free to use, disclose, reproduce, license, or otherwise distribute and exploit such Feedback in any manner, without obligation to compensate you.
The JustFlow Service may include links to other websites or services solely as a convenience to users (“Linked Sites”). JustFlow does not endorse any Linked Sites or the information, materials, products, or services contained on or accessible through them. Furthermore, JustFlow makes no express or implied warranties with regard to the information, materials, products, or services contained on or accessible through Linked Sites.
Access and use of Linked Sites, including the information, materials, products, and services available through them, is solely at your own risk.
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the JustFlow Service are solely between you and such advertiser. You agree that JustFlow will not be responsible or liable for any loss or damage incurred as the result of any such dealings, or as the result of the presence of such advertisers on the JustFlow Service.
JustFlow may make changes to, or discontinue, any of the content or services available on the Service at any time, without notice. The content or services on the JustFlow Service may be out of date, and JustFlow makes no commitment to update them.
14. User Content
You acknowledge and agree that:
a. Content is provided to you AS IS, and JustFlow is not responsible for examining, moderating, or evaluating content created, uploaded, published, shared, or otherwise made available by end users through the JustFlow Services (“User Content”).
b. JustFlow does not guarantee the accuracy or reliability of any such User Content, nor that such User Content will continue to be available.
c. By using the JustFlow Services, you may encounter User Content that you deem offensive, indecent, or objectionable, and such User Content may not be labeled as such.
d. JustFlow has no liability to you for any such User Content.
15. Termination
You agree that JustFlow, in its sole discretion and for any or no reason, may terminate any account (or any part thereof) you may have with JustFlow.
JustFlow also reserves the right to discontinue any aspect of the JustFlow Service at any time, including but not limited to:
The display of licensed content
Linked or embedded content
Your Content
Third-Party Content
For the avoidance of doubt, JustFlow shall in no event be responsible for the deletion, loss of, or failure to store Your Content.
You agree that any termination of your access to the JustFlow Service or any account you may have, or any portion thereof, may be effected without prior notice, and you agree that JustFlow will not be liable to you or any third party for such termination.
Any suspected fraudulent, abusive, or illegal activity may be grounds for termination of your use of the JustFlow Service and may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies JustFlow may have at law or in equity.
16. Disclaimers; No Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JUSTFLOW EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, AND THOSE ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
JustFlow makes no warranty that:
The Service will meet your requirements
The Service will be uninterrupted, timely, secure, or error-free
The results obtained from using the Service will be accurate or reliable
You acknowledge that the JustFlow Service may be subject to operating errors or defects, including but not limited to:
Loss of data
Delays
Non-deliveries or misdeliveries
System downtime or outages
File corruption
Service interruptions
No such event shall constitute a breach of these Terms or any other contract by JustFlow, even if caused by negligence or gross negligence of JustFlow or its affiliates, employees, agents, licensors, or subcontractors.
Certain state or national laws may not allow limitations on implied warranties or exclusions of certain damages. If such laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply, and you may have additional rights.
17. Indemnification
You agree to indemnify and hold harmless JustFlow LLP, its affiliates, suppliers, and partners from any claims, losses, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of:
Your use or misuse of the JustFlow Service
Your violation of these Terms
Your violation of the rights of any other person or entity
Any breach of the representations, warranties, and covenants made by you herein
JustFlow reserves the right, at its own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate fully with our defense of these claims.
18. Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL JUSTFLOW LLP OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PARTNERS OR SUPPLIERS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES arising out of or related to your use or inability to use:

Any other interactions with JustFlow
Even if JustFlow or an authorized representative has been advised of the possibility of such damages, we will not be responsible for them.
Applicable law may not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
In such cases, JustFlow’s liability will be limited to the fullest extent permitted by law.
In no event shall JustFlow LLP’s total liability to you for all damages, losses, and causes of action exceed one hundred U.S. dollars (USD $100).
These limitations also apply to damages caused by:
Any products or services provided by third parties other than JustFlow, and
Any products or services received through or advertised on the JustFlow Service, or through any links provided in the Service.
For all disputes arising out of or relating in any way to the JustFlow Service, you must first send a written description of your claim to JustFlow LLP to allow us an opportunity to resolve the dispute. You and JustFlow each agree to negotiate your claim in good faith.
If we cannot resolve the dispute within 60 days, you may request arbitration. Please read this section carefully: it affects your legal rights. It provides for resolution of disputes through individual arbitration instead of court trials and class actions.
Arbitration is more informal than a lawsuit in court, uses a neutral arbitrator instead of a judge or jury, and discovery is more limited. Arbitration is final and binding and subject to only very limited review by a court. This arbitration clause shall survive termination of these Terms.
By using the JustFlow Service, you agree that the statutes and laws of the Republic of Kazakhstan, without regard to conflict of laws principles, will apply to all matters relating to the use of the JustFlow Service.
1. Any dispute, controversy, or claim arising out of or relating to these Terms, including their existence, validity, interpretation, performance, breach, or termination, or any dispute regarding non-contractual obligations, shall be referred to and finally resolved by arbitration administered under the rules of the International Arbitration Centre (IAC) at the Astana International Financial Centre (AIFC), which are deemed to be incorporated by reference into this clause. The seat of arbitration shall be Astana, Kazakhstan.
2. The parties agree that the arbitrator(s) shall have authority to issue interim orders for provisional relief, including orders for injunctive relief, attachment, or other provisional remedies, as necessary to protect either party’s proprietary rights. Such interim orders shall be enforceable in any court of competent jurisdiction.
Nothing in this section shall prevent either party from seeking conservatory or interim relief from any court of competent jurisdiction.
a. Waiver. A provision of these Terms may be waived only by a written instrument executed by the party entitled to the benefit of such provision. Failure to enforce any provision shall not be deemed a waiver of future enforcement of that or any other provision.
b. Severability. If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be severable and will not affect the validity or enforceability of the remaining provisions.
c. Assignment. These Terms, and any rights or licenses granted hereunder, may not be transferred or assigned by you but may be assigned by JustFlow LLP without restriction.
d. Survival. Sections 6, 8(b), 10, 11, 13, 16, 17, 18, 19, and 20 shall survive any termination of these Terms.
e. Headings. The section headings are for convenience only and do not affect the interpretation of these Terms.
f. Entire Agreement. These Terms are the entire agreement between you and JustFlow relating to your use of the Service and supersede all prior written or oral agreements. They may not be modified except in writing signed by both parties or by an updated version posted by JustFlow pursuant to Section 4.
g. Claims. YOU AND JUSTFLOW AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE JUSTFLOW SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
h. End-User Terms Required by Apple. If you have downloaded the JustFlow App from the Apple App Store or are using it on an iOS device, you acknowledge and agree that:
· These Terms are between you and JustFlow only, not with Apple.
· Apple is not responsible for the JustFlow Service or its content.
· Apple has no obligation to furnish any maintenance or support services with respect to the App.
· In the event of any failure of the App to conform to any warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligations with respect to the App.
· Apple is not responsible for addressing any claims relating to the App or your use of it, including product liability, regulatory compliance, or consumer protection claims.
· Apple is not responsible for investigating or defending any third-party claims that the App infringes intellectual property rights.
· You agree to comply with applicable third-party terms when using the App.
· Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

j. Copyright / DMCA. If you believe that anything on the JustFlow Services infringes a copyright you own or control, you may file a notice with our designated agent:

If you file a notice, it must comply with the requirements set forth at 17 U.S.C. § 512(c)(3). This means your notice must include:
1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the infringing material and information sufficient to locate it;
4. Your contact information (address, phone, email);
5. A statement of good-faith belief that the use is not authorized by the copyright owner, agent, or law;
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
