MOTOR TRAFFIC (JERSEY) LAW 1935
Article 2 - Appointment of Inspector of Motor Traffic - to enforce ONLY Laws & Duties imposed on DVS by Minister – i.e. DVS cannot make up own rules & Regulations!
Article 4 - Traffic Officers to report offences - Motor Traffic Officers (at DVS) required to report all offences (Criminal and other) they know of to Honorary or States Police (would include Passenger "Misbehaviour"!, which is an Offence with a Level 2 Fine).
Article 9 - Grant of PSV Licences (for Cab Vehicles)
Article 9(3) - Vehicle Licence Conditions - Minister can impose any PSV Licence operating Conditions on the Owner / Operator.
As per the Ministerial Decision 6 January 2016 (Delegation of Functions - to DVS) PSV Licences are issued by DVS, however these are "subject to the Minister approving polices for granting licences" (i.e. numbers in issue) and "approving standard conditions of licence" (i.e. any variations subject to Ministerial approval). In practice means DVS alone cannot issue PSV Licences on any terms they want to.
Article 28 – Authority to Drive a PSV (PSV Badge holder only)
Article 38 – Minister to ensure adequate Cab Services - “Adequate”, “Efficient” and “Reasonably Priced” but only "as far as practicable. "Cab Services" include both Taxis and Limos.
