The 16th edition of Standards for Relationship Testing Laboratories features new and revised requirements in areas such as employee qualification, facility monitoring of potentially fabricated documents, and the identification of non-chain of custody cases.

In very general terms, previous guideline figures have risen by around the RPI increase since the last guidelines at 6.56% although there are increases below and above this level as can be seen from the comparative table below. It is to be noted that the previous Minor Type (ii) Back injury figure has been subdivided and a new Type (iv) created which equates to the old Type (iii). In these comparisons, figures are compared to the nearest previous figure if there is one.

Richard Wilkinson is one of the team of Editors responsible for producing the latest (16th) edition of the Judicial College Guidelines for the Assessment of General Damages in Personal Injury Cases which was published today (11th April). The new edition features a new chapter on Work Related Limb Disorders, including cold injuries, a new section dealing specifically with sexual and/or physical abuse and a revised section on damages for injury to reproductive systems.

The inclusion of new guidelines for sexual and physical abuse provides direction as to how awards for damages should be assessed in this area and provides greater certainty to all parties in ensuring there has been an appropriate assessment made.

While the Guidelines are not binding in Scotland, they are regularly heavily relied on in submissions, and viewed as persuasive, always disregarding the 10% uplift applicable for cases involving a conditional fee arrangement. The Guidelines have now incorporated the previous 10% uplift to provide a single range of figures. So will the approach of the revised guidelines be followed in Scotland?

The APA reference page, also called reference list, is where all sources that are cited in the text are listed. The citations differs for each source type. Aside from the references itself the reference page as a whole also has specific APA formatting guidelines.

APA format citations consist of parenthetical citation in the text (APA 6 in-text citations) and the full reference in the reference list. For each webpage, journal article, book or any other source specific citation guidelines apply.

02/11/22. Following my earlier article concerning Work-related Limb Disorders, this article concentrates on changes relevant for assessing damages for Noise Induced Hearing Loss under the 16th Edition of the JC Guidelines.

The new edition of the JC guidelines was published in hard copy this week and, as expected, makes across-the-board adjustments for RPI inflation to the recommended guidelines for all categories of all personal injuries.

 

The headlines from this new edition are that:

 

(i) The RPI adjustment to allow for the period between the new and previous edition is 6.56%

(ii) The pre-Simmons v Castle column (for cases funded by pre-LASPO CFAs) has now been omitted (save that the guideline figures for mesothelioma claims are still on a pre-LASPO basis because the Act was not commenced for those cases)

In respect of injuries of the utmost severity - both tetraplegia and very severe brain injuries - the upper bound of the relevant guidelines has risen to over 400,000. We believe this is the first time that general damages in England & Wales have breached that figure.

It should be noted that although there are some cosmetic changes to the chapters in the guidelines, the relevant figures generally remain consistent with the overall RPI adjustment. These are the main such changes.

The aerobic plate count (APC) is intended to indicate the level of microorganism in a product. Detailed procedures for determining the APC of foods have been developed by the Association of Official Analytical Chemists (AOAC) (3) and the American Public Health Association (APHA) (1). The conventional plate count method for examining frozen, chilled, precooked, or prepared foods, outlined below, conforms to AOAC Official Methods of Analysis, sec. 966.23, with one procedural change (966.23C). The suitable colony counting range (10) is 25-250. The automated spiral plate count method for the examination of foods and cosmetics (5), outlined below, conforms to AOAC Official Methods of Analysis, sec. 977.27. For procedural details of the standard plate count, see ref. 2.Guidelines for calculating and reporting plate counts have been changed to conform with the anticipated changes in the 16th edition of Standard Methods for the Examination of Dairy Products (2) and the International Dairy Federation (IDF) procedures (6).

Official Methods of Analysis (3) does not provide guidelines for counting and reporting plate counts, whereas Standard Methods for the Examination of Dairy Products, 16th ed. (2) presents detailed guidelines; for uniformity, therefore, use APHA guidelines as modified (6,8). Report all aerobic plate counts (2) computed from duplicate plates. For milk samples, report all aerobic plate (2) counts computed from duplicate plates containing less than 25 colonies as less than 25 estimated count. Report all aerobic plate counts (2) computed from duplicate plates containing more than 250 colonies as estimated counts. Counts outside the normal 25-250 range may give erroneous indications of the actual bacterial composition of the sample. Dilution factors may exaggerate low counts (less than 25), and crowded plates (greater than 250) may be difficult to count or may inhibit the growth of some bacteria, resulting in a low count. Report counts less than 25 or more than 250 colonies as estimated aerobic plate counts (EAPC). Use the following guide:

The first (this) part aims to provide the context necessary to fully understand the significance of the changes in the 16th edition. That context consists of the way in which parties and courts have approached general damages arising from abuse to date under various heads of general damages. It also looks at how the JCG has approached the circumstances of abuse in relation to PSLA and considers the practical difficulties that arise from the inconsistency of approach to date.

It is relatively unsurprising that there has been confusion and inconsistency as to how to pursue general damages arising from abuse given the lack of guidance or binding authority on the correct approach (the only formal guidelines being the JCG for PSLA). However, the extent of the inconsistency is alarming as demonstrated below.

The JCG were introduced in 1992 to encourage consistency of awards and settlements by incorporating known data into guidelines to be applied to individual cases. They have been regularly updated ever since to allow them to keep pace with socio-economic factors (e.g. inflation and public perception), updates in the law (e.g. the Heil v Rankin uplift) and developments in medicine and science (e.g. newly recognised conditions or symptoms). It is because of these regular updates that they are such an invaluable and relevant resource for practitioners and judges alike.

In the 15th edition, the overall introduction to the JCG stated that the editorial board was considering a designated section for claims arising from sexual abuse. That suggests that it was aware that there were still issues with the guidance as drafted. That change of course came with the 16th edition and is discussed in Part 2 of this blog available here.

Lastly, please be aware of the changes to the guidelines in respect of injuries to both male and female reproductive systems. The introductions to each of these sub-sections in Chapter 6 recognise a need for parity between these brackets and places importance on factors beyond the physical aspects of loss of fertility or reproductive capacity.

The Guidelines are periodically reviewed and updated, based on decisions in law, developments in medicine, science and socio-economic factors. On 11 April 2022, the 16th edition to the Guidelines was published.
