A significant development in his early career came in 1980 when he was appointed to lead the damage analysis team in the Uranium Antitrust Litigation (MDL 342). This was one of the most complex commercial antitrust cases of its time. In this role, he managed legal and financial strategy, working closely with experts and other departments to ensure effective execution. The case resulted in a $250 million recovery from Gulf Oil for the agency.
Transition to Colorado and Law Firm Leadership
In 1985, James moved into private practice in Colorado and joined a firm with a strong reputation in commercial litigation. Within a year, he became a partner, handling cases involving construction and commercial disputes that included complex contract and financial issues.
Building Legacy Through Firm Leadership
In 1990, James Bain of Colorado transitioned to another firm, where he continued building a portfolio of commercial and construction law matters. In 2004, he co-founded a new law firm with two colleagues. They aimed to provide high-quality legal services while maintaining a practical and responsive approach to client needs.
In 2009, a fourth partner joined the firm, which by then had established a solid presence in the Denver legal community. All four partners were selected for inclusion in Super Lawyers, a peer-nominated recognition of legal excellence. Alongside his legal practice, he made lasting contributions to legal writing and professional publications. Based in Littleton, Colorado, he served for over 20 years as editor of the “Construction Forum” section in Colorado Lawyer, the official journal of the Colorado Bar Association.
He also authored several widely cited legal articles. In 1986, he wrote Negligence: The Construction Claim Panacea? In 1987, he published two articles discussing the erosion of the caveat emptor principle in state law. In 1988, he examined public construction contract responsibilities and contributed to "Negligence Claims in Construction Litigation" in The Construction Lawyer, a national publication. In 1997, he released Landmark Changes in Colorado Construction Law, which explored key developments in the field.
Service, Speaking, and Arbitration
His contributions extended beyond his writing and firm responsibilities. He served for five years as Chairman of the Legal Advisory Committee for the Associated General Contractors of Colorado. He also served on the National Panel of Arbitrators for the American Arbitration Association, handling matters involving commercial and construction disputes.
He regularly gave presentations for the Colorado Bar Association, the American Bar Association, and the Real Estate Section of the Colorado Bar. He also acted as Seminar Chairman for the Institute for Advanced Legal Study, contributing to the design of educational sessions for practicing attorneys.
