While using Our Services you may be asked to provide personal data or information that can be used to identify you. Data can also be collected automatically or from third party services that you use and agree to their terms and conditions and privacy policy.

This is data, information that let us and third party providers tailor the provided experience. Identifiers may be used for advertising purposes, authentication and similar technologies required for the Services, Software to be available to the user. We may collect information such as email addresses or contact information provided in online forms, throughout any support contact.

Device information and usage

Some anonymous device information can be sent to Us (More about usage in Usage of data), type of the device, operating system, used resolutions, device identifiers like device ID, system language, time zone, IP address. Information about usage can be automatically collected and sent to third party providers to analyze it and provide better experience for users.

Usage of data

We may collect and process some anonymous information about usage data, like your activity through our Software, Services, Apps to improve provided products. Data collected may include history of purchased products, in-app purchases, game progress.

We and third party providers may use cookies and similar technologies to provide personalization of Our Software, Services, also synchronize this data and information across other devices and platforms you use.

Age limit

We do not knowingly collect personal information from children under 16 years of age.

END USER LICENSE AGREEMENT

SOFTWARE LICENSE AGREEMENT

PLEASE READ THE TERMS AND CONDITIONS CAREFULLY. BY USING THE JAIBA SOFTWARE, THIS SOFTWARE, OUR SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE.

This is a legal agreement between Licensee ((“Licensee”, “You”, “Your”) and Paweł Franitza (“JaibaBoat”, “Jaiba Boat”, “Paweł Franitza”, “Us”, “Our”). By installing or accessing or using any services provided by Us, You confirm Your consent to be bound by the terms and conditions of this EULA including the Policy. If You do not agree to any of the terms and conditions of this EULA, do not use, download, install, access any Apps and Services provided by Us.

1. Definitions

“Content” is multimedia product including but not limited to text, information, data, links, graphics, photographs, videos, 2d and 3d materials.

“Software” is a product, or any part of the downloaded, installed, accessed component or service, including provided documentation, add-ons, extensions, libraries, fixes, updates, modifications.

“App” is a specialized software product, mobile, desktop, web application that runs on Licensee’s device (mobile phone, tablet, phablet, mobile device, desktop, pc, computer, web browser, multimedia device with a touchscreen).

“You” or “Licensee” is referring to the adult person or a person who acquired permission to use the software from their legal guardian, parents, to whom this End User License Agreement - EULA was presented and permission to use this Software was granted by accepting this EULA, or business entity who has acquired this license to use the Software.

“Third party components” are software components that include Open Source Software, or accompanying the Software and provided under separate license terms.

“Mobile Platform Store” is a third party Software managing downloading Apps on Licensee devices. It is either Google Play on Android, operated by Google, or App Store on iOS, operated by Apple.

“Permitted content” is any content that is against Our End User License Agreement, or End User License Agreement of Mobile Platform Store (Google Play or App Store) or against local laws or is legally prohibited by governor laws or against Your home country laws or against laws of countries where Mobile Platform Stores are registered. Also content that promotes use of illegal activities, harmfull, dangerous, false, misleading, abusing, promoting discrimination and intolerance, pornographic, offensive, vulgar, sexually explicit, promoting use of illegal substances, infriging intellectual property rights, morally unacceptable.

2. License Grant and License Termination

The software is owned by Jaiba Boat and licensed to You (Not sold). License is valid only on behalf of acceptance and subject to Licensee’s compliance with the terms and conditions of this agreement and available in undisclosed time or as long as it is available on the Mobile Platform Store. License can be terminated if Licensee breaks this EULA - End User License Agreement or Licensee withdraws from purchases made or when provided Service, App, Software is terminated, disabled, no longer in development.

Jaiba Boat, JaibaBoat, Us, reserves the right at any time and from time to time to modify, update or discontinue, temporarily or permanently the Services, Software, App (or any part thereof) with or without notice. You agree that Jaiba Boat (Us) shall not be liable to You or to any third party for any suspensions, discontinuance or modifications of provided Services, Software, App.

Jaiba Boat, JaibaBoat, Us, reserves the right to change, modify, limit usage of, charge for continued usage (after notice) or discontinue any Service, Software, App at any point in time.

3. Restrictions.

You may not decompile, reverse engineer, disassemble or use any means to make any modifications to the provided Software (including multimedia content, translations, graphics, videos). License is exclusive, non-sub-licensable, limited to one person. Creating copies of the software is prohibited (excluding ability to create backup or archive copy). Every created copy must be unmodified and contain all original data and notices including this EULA. You may not distribute, rent, sell, resell or provide access to third party users to Our software. You may not use the Software, App, to create, distribute or promote any of mentioned in “Permitted content”.

YOU MAY NOT USE ANY MEANS TO CHANGE LICENSE TYPE, ACQUIRE PRODUCTS, UPGRADES OR ANY CONTENT THAT IS AVAILABLE TO SUBSCRIPTION USERS, ALSO PAID FEATURES.

4. Liability and warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

JAIBABOAT, JAIBA BOAT, PAWEŁ FRANITZA, WILL NOT TAKE ANY RESPONSIBILITY FOR INTERRUPTIONS OF SERVICES, TERMINATIONS INFRINGED FROM LICENSE GRANT AND LICENSE TERMINATION, USER DISSATISFACTION, SOFTWARE DEFECTS, CHANGE IN PROVIDED SERVICE, NOT MEETING YOU, YOUR, LICENSEE EXPECTATIONS.

JAIBABOAT, JAIBA BOAT, PAWEŁ FRANITZA, OR ANY PERSON ENGAGED IN CREATION OF THIS SOFTWARE DIRECTLY OR INDIRECTLY, UNDER NO CIRCUMSTANCES WILL NOT BE LIABLE FOR ANY LOSS, INJURY, HEALTH INJURIES OF LICENSEE, NEITHER LOSS OF PRIVACY, REVENUE, PROFITS, BUSINESS INTERRUPTION, FAILURES, UNAUTHORISED ACCESS, NEGLIGENCE. JAIBABOAT, JAIBA BOAT, PAWEŁ FRANITZA WILL NOT TAKE ANY RESPONSIBILITY FOR ACTIONS, PRODUCED MULTIMEDIA CONTENT, OR ANY ILLEGAL OR AGAINST LAW ACTIVITIES OR ACTIONS MADE BY LICENSEE.

TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW YOU AGREE TO DEFEND ALL JAIBA BOAT, JAIBABOAT, PAWEŁ FRANITZA, ITS EMPLOYEES, CONTRACTORS, LICENSORS, 3RD PARTY SOFTWARE PROVIDERS FROM ANY CLAIMS, SUITS, LOSSES, LIABILITY, DAMAGE COSTS AND OR EXPENSES AND FEES OR ANY INFRINGEMENT BY YOU OR ANY THIRD PARTY OF ANY INTELLECTUAL PROPERTY RIGHTS.

5. Export controls and restrictions

ANY SOFTWARE SHALL BE IN COMPLIANCE WITH RELEVANT INTERNATIONAL EXPORT, IMPORT RESTRICTIONS AND REGULATIONS INCLIDING BUT NOT LIMITED TO U.N USA, EU SALES. YOU AGREE TO COMPLY WITH THEM.

You can not be located in a country that violates any of mentioned above, including but not limited to government embargos, terrorist countries, prohibited or restricted parts of the World, not complying with sanctions and embargoes mentioned above.

6. Collecting personal information and privacy

By accepting this EULA - End User License Agreement you give consent that we may collect certain personal information including but not limited to email addresses, identifiers, cookies and You accept our Privacy Policy.

Use of Our Services, Apps, Software, Product of any kind made by Us is subject to our Privacy policy which is incorporated into this EULA by reference.

7. Promotions, pre registration rewards

Items that are acquired via promotional routes (Google Play store, Apple App Store) shall be given to the user. Rewards and promotional items are distributed by the platform store and we do not take any responsibility for delivery errors that should be handled by the given distribution channel. Promotional or reward items can not be refunded by Us. By taking part in promotion you accept that you know Our privacy policy and content of this EULA, also corresponding documents provided by the distribution channel.
