I was not in the USA when the crime was planned (Refer to proof from US embassy & compare initial witness statements Appendix C). The victim identified Schultz shot her. Also Roach on the side walk, saying I wasn’t the other guy. The only people to accuse me are criminals who got plea deals. My own attorney failed (refused) to clear up my identity (I am not WK Dixon), file a witness list or present my evidence of innocence and the phone tapes. Counsel failed to let me testify. Someone threatened my witnesses and told them to leave town and not to come to the trial. This can be shown by facts in my appeal for retrial. The court’s own transcripts verify this.

2004

Feb. I moved back to Ohio with my mother. Mom was helping take care of Tom Biondi. All I knew of Tom Biondi was he was an AID’s patient in a coma after a car ran over him. I was working at Orbis and dating Gina Pena. I spent all my time with Gina and her family.

Mid to late 2004 Deskins found me (Dixon) at Gina Penas house. Out of jealousy Deskins was trying to prevent our relationship. I then asked Gina’s mother, Sheryl, (a retired school teacher in Urbana) if I could marry Gina. I’m at all the town functions & golf outings, also working with a local charity to raise money for sick kids. Gina and I went to Clark State Ccollege. We had a plan to get our CDL trucker licenses and drive over the road five years, then settle down & have kids.

Late 2004 Tom Biondi woke up from the coma. Later I found out Biondi went after the people who ran him over. The people who tried to kill Biondi were friends of the 2 kids that got murdered in 2003 by Tom’s son, Josh Biondi. Biondi found out that Devin Schulz set it up. I had no knowledge of this at the time. I didn’t even know Biondi, other than dude in the coma that woke up.

Late 2004 Deskins found out my Mom knew Tom Biondi, and other drug dealers.

2005

Jan I was in college and working for Power Net in United Way with Grieg Powell. I became a board member and was helping with gang violence prevention, drug and prison re-entry programs.

Feb Deskins locked me up saying I had to tell him all I knew and be straight with him if I wanted to stay married to Gina and be a part of this community. I told him I didn’t have a clue what he was talking about. [History: In 1999 my Mom had been busted in an international drug case [with Biondi]. In 1999 I lived in Arkansas and didn’t speak to my Ohio family at the time. I only spoke with my Florida and Arkansas family at the time.] When Deskins locked me up Arkansas told him that it was illegal to arrest me under a past, one off, Arkansas juvenile case (1996) because I was under no felon foul law. I never reoffended going from 1996 to 2005 without a speeding ticket or any breech of law. Deskins had a Dea cop with him [I don’t know his name]. They held me in a single cell with no phone call, nothing for 2 weeks: specifically so I lost my colleges grant money. Deskins said I had to find out why the Aryan nation and Biondi was moving into the area. Arizona Aryans was moving in to Urbana and Columbus, Ohio. Biondi was tied to them all.

I told Mom what happened. She asked Biondi if he would give me a job to pay for my college since I had lost the grant from being locked up by Deskins. Biondi offered me a job. I told Deskins because he wanted to know about Biondi. He said soon as I know anything to call him. I was thinking these people were pot smokers and that’s it.

March I met Biondi first time at my Moms house. He offered me a lot of money to drive a few trucks to Belize and built a retirement home [to pay for college]. He offered Gina money to be his personal nurse because he needs care [Gina is a nurse].

April Biondi finds out a gang war happens in Columbus and Devein Schulz got arrested so jumps on a plan.

May We all fly to Belize. 2 weeks into Belize I was building a house and meeting people. Biondi tells me he has a retirement plan. His brother cut him off from the family money and gives him 20,000.00 at a time every few months. Biondi lost all his money 2003 on the double murder. [See late 2004 on timeline.]

Biondi had a black guy who was in good with these Jewish people who sent money to Israel. They kept cash at any place from a half million to a full million. Biondi had recently found out Devin Schulz set his son up, which got him run over and he almost died. He was going to use Schulz to rob the Jewish people then kill her and retire in Belize; use a chunk of money to butt cocaine and keep Josh Biondi and the kids plugged with all the cocaine they could sell. My role was to build the house, drive the trucks, and put the money in the merchandise to hide it and drive it through customs to Belize.

I called Deskins and told him the entire plan. He said he had to contact FBI since Belize was involved and get the big boys. [The courts have copies of all the phone calls and they have the tapes. The prosecutor says my attorney was supposed to use them. The law is clear the prosecutor can’t submit testimony he knows to be false, yet at trial Deskins lied about the context of the phone calls. Each call was me reporting full details of Biondi’s (then future) plan before any crime happened. If Deskins had shared my evidence tapes before the crime the criminals should have been arrested at the crime scene.]

Early June Biondi tells my wife and me to fly to Ohio. I stop building the house and get on a plane. We stop in Texas for a few days as the flights got screwed up. We land in Ohio in the beginning of June. Biondi picks us up & we go to see Gina’s mom in Urbana. We go to Springfield. Days pass then we go to Columbus for the first time to meet the entire gang. Devin is still in jail, but everyone else is there: drugs, guns and gangs all hyped up over the war they are having. I tell Biondi I refuse to keep my wife around these people. So Biondi calls Toby, the biker, to come and get us. We stay at Toby’s house 2 weeks. I call Deskins and tell him, “Hey this is the plan.” I give Deskins a cell phone number and say call me soon as you get the undercover agent ready. I was told they would get an undercover to act like one of my friends from Arkansas, he would be coming in to help me do my job, load trucks, muscle etc.

June 22 Toby was told to take me to Columbus. Tom Biondi bonded Devin Schulz out of jail.

June 22 We are all at Biondi condos and that was when the plan changed for me to go in the house with Schulz. Biondi was testing me; he wanted me to do something illegal. So far I had smoked cannabis and built a house and nothing illegal. I refused to even stay at his condos because he had drugs and guns there. I used my wife as the way to even get away from the gangs (to Toby’s house).

June 23 Biondi and gang were having Devin’s coming home (from jail) party. That night my wife and I went to sleep in Biondi’s condo as we were told we were leaving for Belize in a few days. I waited on Deskins calling him, again, to hurry up.

June 24 Biondi woke me up with an AK in his hand said we had to take a ride to get the truck. We end up in Dayton Ohio. They all jump out of Angie's car. Biondi, me and Devin were in his truck. Angie had Pete Roach, Tim Dean and Angie in her car. They met in a parking lot. They all asked me to go to the door with Devin to rob the people. I refused so they took off to rob the lady. I called my mom said, “Come pick me up. Your dude Tom (Biondi) just took me to a robbery and wanted me to help Pete and Devin do a house. Come get me.” Devin jumped in the car half naked covered in blood. I jumped out the car. Biondi said, “Get in the car the cops are coming.” I said I’d wait on my mom. They drove off.

I headed toward the neighborhood, stopped a van, and said “call 911 someone got shot up the street”. Angie pulled up said she would take me to my mom’s car. I meet my mom at a restaurant and Tom was talking to her on the phone. She tells me Biondi wants me in Columbus now. Mom said I will deal with the robbery thing as I didn’t know Biondi was doing that, I told him you wasn’t into that kind of stuff.

We get to Columbus Biondi tells me I have to kill Angie and Devin. He says I have to prove myself and he would pay me to kill them. I said, “Yes.” I picked up my wife and Angie and Devin. I told them Biondi told me to kill you. I take them to the truck stop, call Deskins and tell him a lady was killed. [I thought Devin had shot the lady with a 357 and killed her. That’s why the tapes talking to Deskins say they shot and killed a woman. I wasn’t there so didn’t know that she was wounded and would survive.] Biondi wants these two dead and I’m trying to turn them to witnesses against him. Deskins still has my number and says I’ll call you back.

I drive to little rock Arkansas to Seth and Ron’s house. Ron is an ex-cop so I debrief him, he calls his cop friends. We call Deskins on speaker phone and I tell Deskins we got the girls and all that. Arkansas tells me its Ohio beef and they want no part of it. Ron tells me Deskins is a liar as when his Feds in Arkansas checked he didn’t have a case open and it’s a set up. They tell me to put the girls on a bus and walk away and hide. My wife was worried about the Columbians we met in Belize as they knew her entire families address and names. So we went to South Carolina then Florida. We spoke to Agent Albert in West Palm Beach, he said if Devin and Angie won’t witness then we haven’t got a case. He tells me I need to find a ‘smoking gun’ to get the big boys involved.

July My wife and I met Biondi in Ft Smith Arkansas. We drive back to Belize. I take the truck and tell Biondi the girls are dead. We get to Belize I give them the ‘smoking gun’. I call in the location of 5000 pounds of cocaine, they get it. 7 days later my wife and I get kidnapped & tortured. The US embassy gets involved so they investigate. Cindy Craig verifies I broke no laws (see appendix). Tom Biondi gets busted for drugs and we get sent back to America.

Oct I was taken to international airport hospital in Humble, Texas, where Gina is treated for a miscarriage and both of us for bad PTSD (from the torture). Seth and Ron come get us, give us a place to live; they put us in their witness protection. We start over.

2006

January 1st Seth marries Shelly his wife. The next weekend we have a double couples honeymoon at my place. I lived in the Oklahoma boarder area Ft. smith. After the honeymoon Seth went back to green brier Arkansas. That night I was at work when I got the call. Biondi had Seth killed. Tried to make him give up my address. I call Ron so we all know. Shelly comes to live with us. Tom Biondi was on her phone on voice mail, “Hey Billy, give Seth and Shelly my love.” He had their phone numbers as Shelly was a veterinarian and had a business. So it wasn’t hard to find them. Biondi found out who Seth and Ron were because Devin and Angie got arrested.

Flashback 2005

Flashback: Oct 2005 Tom Biondi had called Det. Ward and reported that Angie Walton and Devin Schultz and Pete Roach robbed the house in Dayton. When Biondi went to jail in Belize he knew I didn’t kill the girls.

The crime happened June 24 2005. Det. Ward closed the case June 26 2005, He arrested Ashlie Amous and Mathieu Keffer: two local drug addicts. They had no connection to the crime or Biondi. Det. Ward just wanted to close the case and bust those two. So he falsified a confession and locked them up.

Oct 2005 Biondi calls Det. (Detective) Daughtery and Det. Ward and says, you can find Walton Schultz and Roach at Urbana Ohio 609 North Julia, they did the crime. Now that was my mom’s house. I notified the police of Biondi’s crime in July 2005 so Biondi wanted to kill me. Biondi was trying to flush me out. Everyone got arrested by the end of October 2005. Angie and Devin were in Baltimore, Maryland. Pete was at his house in Springfield. They all admitted to the crime. In Oct 2005 when they got busted not one person accused me of the crime. Biondi started visiting them in jail and that was how he found out who Seth was. Devin and Angie got back in with Tom who said he wouldn’t kill them but he was going to kill me because I was working with the cops.

2006 - Resumed

January 2006 Biondi got Seth killed. Biondi still couldn’t find me. Still no one still accused me of the crime.

No one accused me of the crime until March 2006, after Biondi got Seth killed but still couldn’t find my hide out. Biondi got the criminals to accuse me so all their false statements agreed.

March 2006 I later found out William Kenneth Dixon was an early suspect re Harbor. I am William Robert Dixon NOT WK Dixon. Now the story changed and a warrant went out for me. Now Ohio wanted me. Deskins reported to everyone I was an anti-Semitic gang banger, Ohio ex convict. [William Kenneth Dixon]. That was his original profile to Dayton police in 2005 when they came to mom's house. So when the cops first came to Urbana Deskins told the cops in Dayton all these lies. No charges. I get to Ohio and to find I was on the news as an Ohio, ex con, anti-Semitic gang banger who was on parole. They called me a native of the Dayton area [William Kenneth Dixon]..

I go to John Rion, my attorney, and say, “That isn’t me. I never did Ohio time, I’m not from Dayton. My family are Jewish free masons. We are not criminals.”

Rion (my attorney) said he would clear it up. I later found out Deskins gave them the profile of William Kenneth Dixon, Ohio ex convict who was an Aryan brother, paroled for smashing a lady with a sledge hammer and stealing her purse.

NOTE: In court of law legally they can’t mention this in trial or in the record. But in chambers they all can talk about how bad someone is. I wanted Rion to correct the profile because courts cops and prosecutors can be influenced by believing you are a dishonest ex convict. I tried to tell them who I am William Robert Dixon NOT William Kenneth Dixon. They said I was lying. They used William Kenneth Dixon's PSI report for mine. At sentencing I was told I was anti-Semitic. My sentence was illegally lengthened to 21 years. No courts cared to listen to me because they thought I was the guy who beat a lady with a sledge hammer. I was judged for WK Dixon’s SPI report and what he had done, but I am William Robert Dixon. My files are all under William Dixon and don’t include my middle name. No one was allowed to hear my evidence including tapes of phone calls with Deskins. Everyone thought I was a bad guy. Deskins persuaded me and my wife into thinking law enforcement was with us all along. He never reported what I told him. He hid all I reported to him. We got kidnapped, tortured, and Gina lost our baby.

July 2006 The witnesses gave new (false) statements which all accuse me – 6 months after the crime.[I later found out Tom Biondi phoned Deskins accusing me. He wanted me dead from telling officials about his cocaine haul.]

August 2006 I was forced to go on trial a month after the entire witnesses statements and case changed. My counsel never notified the court that the PSI of William Kenneth Dixon [in a gang and an Ohio ex convict] was wrong. Rion didn’t correct it. Was he paid off by Biondi who wanted to kill me. Biondi hired a PI and told witnesses to leave town. They were all in on it. The court had medical file records from the government to authenticate my kidnapping story, but at trial they said it never happened. July 2006 the false witnesses said I lived with them in Columbus Ohio from April 2005 until June 2005 robbing people and planning this crime.

I never met Biondi’s gang until June 2005. We were at Toby’s for 2 weeks of June 2005, so we had 3 to 4 days total around Biondi and gang in 2005. We never came back until June 22 2005: the day Schultz got out. false witnesses told the jury I was there planning for months. They said I was with Pete Roach walking down the street as a look out. Pete Roach says it wasn’t me. The only two who said I was there were Angie and Devin: they both changed their written statements 3 times and admit they lied for plea deals. They got deals: Angie got 6 years, Devin 9 years. Devin shot the victim. The victim said Devin alone shot her. The victim identified everyone but me. She said she never saw me or heard of me or met me.

August 2006 I went to trial. In my case the counsel, prosecutors and judge worked as one. Counsel is supposed to check out the client. The people controlling the case ran the false facts. My attorney [Rion] didn’t tell the court who I was and what really happened. My attorney let the false profile Deskins built [WK Dixon] stand as fact. Deskins knew my mom knew Biondi, was arrested in 99 and knew Aryans moved guns and drugs for Biondi. I never knew Aryans.

Main Facts

The victim identified Schulz & Roach. She said I wasn’t at her house. That’s a clear ID it wasn’t me. The witnesses changed their story almost 6 months after their initial statements (which didn’t implicate me). After contact with Biondi they gave false witness blaming me. Every fact they gave to show my role in the crime is easily impeached by undisputed facts in my proof of evidence. I was not with Biondi when the crime was planned. I was not in the USA (see US embassy proofin appendix) . The only people to accuse me are criminals who got plea deals. 2020: I am still in prison. Those who committed the crime are released.
