Pocket Office Terms and Conditions
Welcome to Pocket Office and Pocket IMG (hereafter referred to as "the Service"). The Service offers users access to a web and mobile application that allows for the manipulation of documents and/or images through online software.
These Terms and Conditions establish the legally binding terms between you (the "User") and the websites, services, and applications of Pocket Office and Pocket IMG (hereafter referred to collectively as "Pocket Office").

1. Use of Our Service
1.1 General
This section outlines the terms under which you may use our online and/or mobile services, website, and software provided by the Service. By accessing or using Pocket Office, you agree to comply with this Terms and Conditions agreement ("Agreement"), whether or not you have registered with our services. If you disagree with any part of these Terms and Conditions, you must refrain from using the Service.
By accepting these Terms and Conditions, the User agrees to the following:
- You have read and understood the Terms and Conditions.
- You agree to all obligations stated herein.
- You will use the Service solely for lawful purposes and will not infringe on the rights of third parties.
- You will not use the Service for any illegal activities or violate any laws.
- You will not generate content that constitutes SPAM or provide instructions for illegal activities.
- You will not collect, handle, or store personal information about other users or third parties without adhering to the current data protection regulations.
If the Terms and Conditions conflict with the Privacy Policy, the Terms and Conditions shall prevail.
Failure to comply with these rules may result in the termination of the agreement, as outlined in Clause 9.

1.2 Service Rules
Your use of the Service and Pocket Office Desktop is subject to this Reasonable Use Policy, which is designed to ensure fair usage for all users and developers.
The following activities are prohibited in connection with Pocket Office services and the Desktop App:
- Using any automated or non-automated scraping tools (such as bots, scrapers, or spiders) with Pocket Office Desktop.
- Converting or editing documents with Pocket Office Desktop at a rate exceeding what a human could reasonably accomplish manually.
- Sharing your password with another person or using someone else’s username and password to access Pocket Office Desktop.
- Excessively using Pocket Office Desktop beyond reasonable limits for legitimate personal or business purposes. Pocket Office may investigate any account registering over 1,000 tasks per month to ensure compliance with these terms.
If Pocket Office determines that you have violated this policy, we may temporarily or permanently suspend or terminate your account or subscription.
1.3 Cookies
Pocket Office websites operate as Software as a Service (SaaS) and use cookies, which are essential for the proper functioning of the service. A minimal number of non-essential cookies may also be used, subject to your consent. If you do not accept, manage, or reject the use of cookies, consent will still be implied by using our software. You can manage your cookie preferences anytime via our Cookie Policy page.
2. Accounts
2.1 General
Pocket Office accounts provide users access to services and functionality as determined by us at our sole discretion. We may offer different account types with varying file size and number limitations. Our account types include:

- **Premium**
You are solely responsible for the activity on your account and must ensure your password is secure.
Pocket Office reserves the right to fully or partially discontinue its services at any time and will notify Premium users in advance. Any applicable taxes will be charged to users, with the payment responsibility falling on the user in accordance with current regulations.
3. User Content
3.1 General
Pocket Office does not analyze the content of files while processing them, and only Users will have access to the edited files once Pocket Office has processed them. If chosen by the user, this link can be shared with someone else. Pocket Office will automatically delete processed files from its servers after a defined period of time depending on the tool used. Users bear sole responsibility for the usage of their own files.
Pocket Office is limited to offering users access to their own processed files. These files will only remain stored on our servers during the time that the download link is available.
3.2 Content manipulation
Pocket Office provides all the necessary information to assist the user in processing files, and only the User is responsible for contacting Pocket Office in case of technical problems. Pocket Office is highly concerned about file security, thus its servers have limited access, are secured, and strategically placed. The user can modify their user type or cancel their account at any time, by means of the contact form.
3.3 Responsibility for the content of the files
Pocket Office does not analyze the content of processed files and is not responsible for misuse of its tools nor copyright infringements that may affect third parties. The User will be responsible before Pocket Office for any penalty, sanction, and/or fine issued against Pocket Office for noncompliance with any part of this Agreement.
In particular, users agree to use the Service in conformity with current laws and the rules aforementioned in section 1.1.
We don’t access or analyze your content. In case of any technical issues, it's your responsibility to contact us. We are not responsible for the content of your files. You are the only person responsible for whatever they may contain.
4. Signature
4.1 How it works
Pocket Office Signature permits documents to be signed electronically by the signatory or allows one to request signatures from other signatories by means of email delivery. Signatories will have the ability to review the document before proceeding with applying an electronic signature. "Signatory" means a natural person who creates an electronic signature.
Signatories have two electronic signature options:
- **Simple electronic signature** ("data in electronic form which is attached to or logically associated with other data in electronic form and is used by the signatory to sign; in sum, it allows the signer to be digitally identified with their data but does not offer a minimum level of security").
- **Advanced electronic signature** (which meets the following requirements: (a) it is uniquely linked to the signatory; (b) it is capable of identifying the signatory; (c) it is created using electronic signature creation data that the signatory can, with a high level of confidence, use under their sole control; and (d) it is linked to the data signed therewith in such a way that any subsequent change in the data is detectable).
The requester can send a simple electronic signature request or activate the advanced electronic signature option in order to place an EIDAS-listed TimeStamp for added legal validity.
In addition to the final version of the document, the advanced electronic signature provides an Audit Trail, including details gathered from the requester and signers, for greater transparency throughout the process.
All documents with advanced electronic signatures are stored in Pocket Office’s servers for safekeeping.
Please note that once the signature process is complete, you alone have the authority to safeguard the documents.
4.2 Legal Guarantees
The electronic signature services provided by Pocket Office are regulated by Spanish and European Laws, particularly, by EU Regulation 910/2014 ("eIDAS Regulation"), directly applicable in all EU member countries, and Spanish Law 6/2020 (trusted electronic services) where Pocket Office is located. Services may also comply with the requirements of the U.S. Electronic Signature in Global and National Commerce Act of 2000 (ESIGN) and the Uniform Electronic Transactions Act (UETA) or other laws in many jurisdictions. However, Pocket Office disclaims any liability in this regard, and it is the signatory’s sole responsibility to confirm and ensure the suitability of the Signature service for its purposes and legal requirements.
Pocket Office provides a detailed audit trail, timestamps, and signature biometric tracing for advanced signatures, which can be used in legal proceedings. Pocket Office is willing to provide the advanced electronically signed document and audit trail to a court of law if required (and if Pocket Office still has this information).
4.3 Pricing
Pocket Office offers two types of signatures: simple electronic signatures (which are free to use) and advanced electronic signatures. Signatures may be subject to size or quantity limitations. We offer a certain number of advanced electronic signatures at no extra cost for our Premium users each month. Prepaid packs of advanced electronic signatures are available for purchase.
4.4 Collected Information
For full transparency throughout the signature process, Pocket Office may collect the following information:
- Name of requester, signer, validator, and witness
- Email and phone number of requester, signer, validator, and witness (with SMS code validation)
- Name of file(s) being signed
- IP address and biometric data of requester, signer, validator, and witness
