TERMS OF SERVICE

By interacting with me through trades, exchanges, and commissions; with me, C4RN1V4LCORE, you, the client, affirm to have read and agree to be legally bound by the Terms of Service listed below. Failure to abide by these Terms of Service may result in rejected/cancelled commissions & trades with or without a refund, and a blacklist and/or public service announcement (Depending on the severity of the situation). Please note that the Terms of Service is subject to change without any prior notice. (Unless you are in the process of trading, exchanging, or commissioning items with me.)

These Terms of Service are in effect as of February 10th, 2:46pm, 2025.

Section 1. What I Can & Can't Draw

Section 1.1 what I will draw

I am open to and willing to draw the following content;

• Humans, Humanoids, Ferals, Anthros [Feral and Anthro characters are preferred and will be accepted over Human/Humanoid pieces.]

• Original Characters (OCs) or Fan Characters

• Character Sonas or Kin Sonas

• Real Life People and/or Animals [This is only allowed if the person in question gives you permission to be drawn. The style of the final piece will likely end up being a more cartoon-like art style.]

• Fan-art

• Mild/Medium amount of Gore/Horror [E.g. Excessive blood, detached limbs, guts, ect]

• Characters of any age range

• Closed/Open Species Original Characters (CS/OCs)

• Fandoms [I am open to drawing certain fandoms, espeically WARRIORS, but I may turn this down as I might be uncomfortable with a few]

• Ship/Couples Art [This includes but not limited to; Canon x canon, Canon x OC, OC x Self Insert, OC x OC]

• Custom Characters & Designs

• Designs ranging from simple to medium complexity [Do not ask me to recreate an overly complicated character, you will be turned down.]

• Using any saturated or desatuared colours

• Book/Comic Covers & Pages

Section 1.2 what I will NOT draw

I am NOT open to drawing the following content;

• Not Safe For Work (NSFW) and Sexual Content [I am not okay with doing this sort of thing for clients and I am not comfortable with the topics.]

• Anything harmful such as pedophilia/sexualization of minors, necrophilia, zoophilia, fetishization of the LGBTQ+ community, abuse, rape, glorification of mental illness, racism, etc. 

• Hate/Spite Art [This counts for anything not listed in the second point. But also I will not create hateful/spiteful art of anyone or anything you dislike on purpose.]

• Drug-use Related Art

• Gacha Edits [Gachalife, club, life 2, ect]

• Stolen Characters & Designs [You must have permission to use another's design for my work or you most own the design yourself.]

• Fetish Related Art [Exaggerted feet, bloating, drooling, ect.]

• Anything Relating to Politics. [I am mostly not aware/up to date with any politic related topics and wish to stay out of them.]

• Mecha/Robots [I cannot draw anything past a FNAF inspired Endoskeleton. Please do not ask me to draw your robotic/mecha characters.]

• Fandoms [I am open to drawing certain fandoms but I may turn down a few, please ask about a fandom before commissioning me.]

• Sexualized Underage Characters [This links back to the first two points.]

Section 2. General Terms of Service

• I as the artist reserve the right to refuse/cancel a commission and/or trade for whatever reason.

• You as the client reserve the right to cancel and/or refuse a trade and/or commission for whatever reason.

• I reserve the right to use any comissions/art I make for my clients as examples for my portfolio as well as upload to the work onto any of my social media unless specified and spoken about beforehand by the client to keep the work private.

• Payment is to be made when asked. Until a payment is received the commission is likely to go on hold until further notice unless I have asked you to pay after the work is finish.

• I will not be able to work with deadlines/rush orders unless an agreement is made and there is nothing in the way on my schedule.

• I do not work on a 'first come, first serve' basis no matter how big or small the commission is. I do each piece in my freetime and reserve the right to choose when to work.

• Do not request for me to draw anything in the 'what I will NOT draw' section.

• Please do not request for me to draw any designs or characters created by those in my blacklisted section. You may also not get art or designs from me for those same people.

• The client reserves the right to contact me for progress updates on the social media they ordered from or were requested to speak on. If you cannot get through to me on that media please contact me through email. [Icestarzcommissions@gmail.com]

Section 3. Designs & Images

• Please do not resell my character designs if you never brought them for $ and only traded for them and have not gotten art of them. [This includes having commissioned art on the character added value.]

• The client may only resell a brought character design from me if it's for the same price. [Unless you have commissioned art and paid more money for it.]

• There is no cool-down period for selling, trading, or gifting my character designs.

• You are not allowed to trade my designs to anybody featured on the blacklist. [You will be blacklisted from my art and designs.]

• Please do not use my designs for Draw To Adopts (DTAs) as I am uncomfortable with my premade designs being used this way.

• Do not claim my design as your own work.

• The client is allowed to make minor edits to their completed commission. [e.g. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation…]

• The client may use and/or reupload the completed commission for personal/non-commercial use as long as credit is given and visible at all times.

• The client may not use the completed commission for commercial use unless discussed beforehand. [Commissions for commercial use will be charged more than personal/ non-commercial commissions, Prices are negotiable. If the commission includes characters that do not belong to the Client, the Client can not use the commission for commercial use unless explicitly written permission from the owner(s)/ creator(s) of said characters is provided.]

• The client may not claim the completed commission as their own work. [Even if minor edits are made.]

• All subjects, characters, and designs featured in my work all belong to their respective owners and creators.

Section 4. Client & Commission Information

Section 4.1 Delivery & turnaround times

• All works will be done on the requested medium. [E.g. traditional paper, traditional canvas, digital canvas.]

• I as the artist reserve the right to work in whatever art style I wish to work in at the time. [My art style is constantly changing and developing. I however can work in a requested style.]

• All commissions and requested works will be uploaded/exported as .PNG , .GIF , or .MP4. Actual canvas sizes will vary from piece to piece.

• The client is allowed to request for a specific canvas size as long as it's within reason and won't crash my program/s.

• All Animated Music Video/Picture Music Video commissions will be uploaded to Youtube for easy viewing. Anything else will be posted to the site the client has ordered from OR to Google Drive.

• Unless specified and spoken about beforehand to not post the finished work online, I as the artist reserve the right to post the finished work and use it in my portfolio. [The client may choose to be credited or remain anonymous.]

• All commissions I do have different turnaround and completetion times as it depends on my motivation and how busy I am. 

• I will deny most requests for commissions with a deadline unless I am sure I can meet it.

Section 4.2 Payment

• Payment is to be given when requested during one of the following phases. [Before the work is started, After the sketch is done, Before the final work is completed.]

• Payment is only taken VIA PayPal and/or DeviantArt.

• Payment through PayPal must be paid in USD (American dollars) or the NZD (New Zealand dollars) equivalent.

• Payment through DeviantArt must be paid using the gift feature on my profile with points.

• All confirmed prices must be paid within 48 hours of confirmation. 

Section 4.3 Refunds

• Unfortunately at this time I do not have full control of my PayPal which means refunds may not be instant so please be patient. If payment was done through DeviantArt it will be pretty much an instant refund if refunded.

• If I have already started work on a commission I will only refund up to half of the payment unless agreed upon other terms. If I have not started I will refund up to 80% of the payment. (The 80% only counts for PayPal, DeviantArt payments get an 100% refund.)

• I will only refund a user if I am completely sure that I cannot finish the commission and if they are sure they no longer want the commission.

• Cancelling a commission after payment but still wanting the finished product and a refund will result in me giving you neither.

Section 4.4 Ordering and commissioning

• Upon contacting for a commission please be ensure to state exactly what you're after and how much you can spend on that commission so I can properly calculate a final price while also considering how much you can spend.

• Please be sure to have reference sheets/images on hand if possible or a detailed description of the character/s you want drawn.

• When making contact for a commission please also be sure to state what type of payment you'll be making (USD PayPal OR Points DeviantArt).

• At any time I am allowed to deny a commission request if I believe it oversteps my boundaries or breks my T.O.S

• Payment must be made within 48 hours of confirming the commission unless agreed otherwise.
