These Terms of Use (hereinafter referred to as the “Terms”) constitute a legally binding contractual agreement between you (“you”, “your”, or “User”) and Hynpix AI (“we”, “us”, “our”, or the “Company”). These Terms govern your access to, and usage of, the Hynpix AI mobile application (the “App”) and all associated services, functional features, and original content provided by the Company (collectively, the “Services”).
By accessing, downloading, installing, or otherwise utilizing the Services, you acknowledge that you have fully read, thoroughly understood, and unconditionally agree to be bound by these Terms in their entirety. If you do not accept and agree to these Terms, you are not granted the right to use the Services, and you must immediately discontinue all usage thereof.
We retain the exclusive right to modify, update, or revise these Terms at our sole and absolute discretion. We will notify you of all material amendments through the Services, via registered email communication, or by publishing the revised Terms within the App interface. Your continued use of the Services following the effective date of such revisions shall constitute your voluntary acceptance of the updated Terms.
The Services are designed and intended exclusively for use by individuals who are at least 18 years of age or have attained the legal age of majority in their applicable jurisdiction, whichever age threshold is higher. If you are classified as a minor under local applicable laws, you may access and use the Services only with the explicit consent and continuous direct supervision of your parent or legal guardian. By authorizing your use of the Services, your parent or legal guardian consents to be legally bound by these Terms on your behalf.
Hynpix AI is committed to empowering user creativity through advanced AI-powered image and video generation technology. We endeavor to foster and sustain a safe, respectful, inclusive, positive, and friendly community environment for all registered and active Users of the Services.
You agree to utilize the Services in strict compliance with these Terms, as well as all applicable local, national, and international laws, regulatory provisions, and industry standard specifications. You shall not engage in any behaviors or activities that disrupt, damage, impair, or compromise the user experience of other Users or the normal operational stability of the Services.
To preserve the integrity, security, and compliance of our user community, you expressly agree not to use the Services to create, upload, post, generate, transmit, store, or distribute any content, or engage in any conduct that falls under the following prohibited categories:
Content that contains or promotes sexually explicit material, full or partial nudity, or adult-oriented obscene content;
Content that exploits, endangers, or depicts minors in harmful, inappropriate, abusive, or exploitative scenarios;
Content that incites, promotes, glorifies, or encourages violent acts, self-harm, suicide, animal or human cruelty, or intentional physical injury;
Content that constitutes hate speech, discrimination, harassment, cyberbullying, threats, or targeted harm against any individual or group based on race, ethnicity, religious belief, gender, gender identity, sexual orientation, physical disability, age, or any other legally protected status;
Content or activities that violate or infringe upon third-party intellectual property rights, privacy rights, publicity rights, or any other legitimate legal rights;
Content or conduct that constitutes illegal, harmful, deceptive, fraudulent, or rights-infringing acts and behaviors;
Content or conduct that violates any applicable local, national, or international laws, regulations, or valid court orders.
By uploading images, generating original content, or submitting any materials through the Services, you hereby grant Hynpix AI the full right to review, monitor, scan, and analyze such user-submitted content to verify compliance with these Terms and our community policies. We implement a combination of automated intelligent systems and manual human moderation to enforce all applicable policy provisions.
We reserve the sole and absolute discretion to remove, block, or delete any content that violates these Terms. We may also suspend, restrict, or permanently terminate your user account for any policy violations. All serious or repeated violations may be reported to relevant law enforcement agencies, regulatory authorities, or affected third-party parties for further legal proceedings.
The Services are provided to you on an “as-is” and “as-available” basis, without any express or implied guarantees. We do not warrant continuous, uninterrupted, secure, error-free, or defect-free operation of the Services. You access and use the Services entirely at your own personal risk.
You bear sole and full responsibility for complying with all laws and regulations applicable to your use of the Services. The Services are not developed or configured to comply with industry-specific regulatory requirements, including but not limited to HIPAA, FISMA, GLBA, and other similar specialized compliance laws. If your intended use of the Services is subject to such regulatory constraints, you are strictly prohibited from using the Services.
All intellectual property rights pertaining to the Services, including without limitation software programs, source code, design frameworks, textual content, graphic assets, databases, trademarks, logos, and all platform-related content (collectively, “Our Content”), are the exclusive proprietary property of Hynpix AI or our authorized licensors, and are protected by global copyright, trademark, and other intellectual property laws and treaties.
Subject to your strict and full compliance with all provisions of these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services solely for your personal, non-commercial purposes.
You shall not copy, reproduce, modify, adapt, reverse engineer, decompile, disassemble, distribute, resell, license, or publicly display any part of the Services or Our Content without our prior explicit written consent.
By submitting feedback, suggestions, creative ideas, or any other materials to Hynpix AI through the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable license to use, reproduce, modify, publish, and exploit such user submissions for any legitimate business purpose, without any obligation to provide financial compensation or formal credit to you.
You shall bear sole and full legal responsibility for all of the following matters:
All content that you upload, generate, transmit, or store via the Services;
Verifying and ensuring that you own all legal rights, or have obtained full valid consent, to use all content you submit to the platform;
Complying strictly with these Terms and all applicable laws and regulatory requirements;
Maintaining the absolute confidentiality and security of your account login credentials and access information;
All activities conducted under your registered user account.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. Hynpix AI HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Hynpix AI AND ITS AFFILIATED ENTITIES SHALL NOT BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR ANY OTHER ECONOMIC LOSSES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms shall be governed by and construed in accordance with the laws of the United States of America and the State of California, excluding any conflict of law rules. All disputes, claims, or controversies arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you hereby irrevocably consent to the exclusive personal jurisdiction of such courts.
