## 1. Acceptance of Terms
By downloading, installing, or using HYMS Max (“the App”), you agree to these Terms. If you do not agree, do not use the App.

## 2. Description of Service
HYMS Max assists with neurological assessments and documentation, including:
- Neurological assessment scales: NIHSS, mRS, EDSS, ASIA, ICH
- AI Scribe: on-device voice-to-text clinical documentation (default on-device)
- Patient profile management (premium)
- Assessment reports and PDF export (premium)
- Analytics and trends (premium)
- Reference library (premium)
- Optional iCloud sync (premium)

## 3. User Eligibility
For licensed healthcare professionals, medical trainees, and researchers. You represent you are qualified to interpret clinical data and will follow applicable regulations.

## 4. Subscription Terms
- **Free Tier:** Single profile; all scales; basic calculations.
- **Premium (Monthly/Yearly):** Unlimited profiles; AI Scribe; analytics; PDF export; iCloud sync; reference library.
- Billing via Apple ID; auto-renews unless canceled ≥24h before period end. Manage in iOS Subscriptions. Trials (if offered) bill at trial end unless canceled before expiry. No refunds for partial periods.

## 5. Medical Disclaimer and Limitations
The App is a documentation/scoring tool only. It must not be the sole basis for diagnosis or treatment and must not be used for emergencies. Scores (NIHSS, mRS, EDSS, ASIA, ICH) require clinical interpretation.
**AI Scribe:** You must verify all AI-generated text, maintain confidentiality, and use professional judgment.

## 6. AI Processing (On-Device by Default; Optional Cloud by User Choice)
- Default path: **On-device** (Gemma Medical and Apple Foundation Models where available). Audio and text stay on-device.
- Speech: Whisper.cpp and/or Apple Speech run on-device; audio never leaves the device.
- Optional cloud AI (e.g., Claude, OpenAI GPT-4, Gemini) is used **only if you select it and provide your own API key**. Cloud AI receives only text you send; audio never leaves the device. You can switch back to on-device anytime.
- Device requirements: iOS 18.2+ and compatible hardware for on-device models; sufficient storage for model weights.

## 7. Accuracy and Reliability
We make no warranties about accuracy, completeness, or fitness. You are responsible for verifying all information and AI-generated content.

## 8. User Responsibilities
You agree to:
- Comply with laws and regulations (including HIPAA and local privacy laws).
- Use de-identified subject codes and obtain consent where required.
- Review and verify all AI-generated text before clinical use.
- Secure your device (passcode/biometrics) and manage your API keys.
- Not use the App in emergencies.
- Not reverse engineer or misuse the App.

## 9. Data Privacy and Security

- Data stays on-device; optional iCloud sync is user-controlled.
- Audio never leaves the device; cloud AI (if chosen) only sees text you send.
- We do not access your data.

## 10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages (including medical errors, data loss, reliance on content or AI output). Total liability will not exceed fees paid in the prior 12 months.

## 11. Indemnification
You will indemnify and hold the developers harmless from claims arising out of your use, your violation of these Terms, laws, or reliance on AI outputs.

## 12. Updates and Changes
We may modify these Terms, features, or pricing. Continued use after changes constitutes acceptance.

We may suspend or terminate access for violations, misuse, or unlawful activity.

## 14. Third-Party Services
- Apple services: App Store billing, iCloud (if you enable), Apple Speech, Apple Intelligence/Foundation Models.
- On-device speech: Whisper.cpp / Apple Speech.
- Optional cloud AI (if you enable and key): Anthropic Claude, OpenAI GPT-4, Google Gemini — text only; audio stays local.
Your use of Apple or cloud providers is subject to their terms and privacy policies.

The App and its content are owned by the developers of HYMS Max and protected by IP laws.
