HydraGuard Terms of Use (EULA)

Welcome to HydraGuard! These Terms of Use ("Terms") govern your use of the FlexFit app and any related services provided by FlexFit Technologies LLC ("FlexFit," "we," "us," or "our"). By accessing or using the FlexFit app, you agree to be bound by these Terms, including the Privacy Policy incorporated herein by reference.

1. Acceptance of Terms By creating an account, downloading, installing, accessing, or using the HydraGuard app, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the HydraGuard app.

2. Changes to Terms HydraGuard reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the HydraGuard app and updating the "Last Updated" date at the top of these Terms. Your continued use of the app after such changes have been posted will constitute your consent to the amended Terms.

3. Privacy Policy Your access to and use of the HydraGuard app is also subject to the HydraGuard Privacy Policy, which informs you of our data collection, use, and sharing practices.

4. Use of the App The HydraGuard app is intended for personal, non-commercial use. You agree to use the app only for lawful purposes and in compliance with these Terms.

5. User Accounts To access certain features of the HydraGuard app, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

6. Intellectual Property All intellectual property rights in the app and its content, including text, graphics, logos, icons, images, and software, are owned by HydraGuard or our licensors and are protected by intellectual property laws.

7. User Content You may be able to submit content to the app. You retain all rights to any content you submit, but you grant HydraGuard a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content in connection with the app.

8. Prohibited Conduct You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the app in any medium; (ii) using the app for any commercial solicitation purposes; (iii) interfering with the proper functioning of the app.

9. Disclaimers The app and its content are provided "as is" without warranty of any kind, either express or implied. HydraGuard does not guarantee the accuracy, timeliness, or completeness of any content on the app.

10. Limitation of Liability To the maximum extent permitted by applicable law, HydraGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Indemnification You agree to indemnify and hold harmless HydraGuard and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the app not in accordance with these Terms.

12. Termination HydraGuard may terminate or suspend your access to the app immediately, without prior notice or liability, for any reason, including if you breach these Terms.

13. Governing Law These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HydraGuard is established, without regard to its conflict of law provisions.

14. Changes to the App HydraGuard reserves the right to modify or discontinue, temporarily or permanently, the app (or any part thereof) with or without notice.
