Terms of Service

These Terms of Service ("Terms") govern your use of ScriptPad Korean, ScriptPad Japanese, ScriptPad Chinese, and any other ScriptPad-branded mobile applications (collectively, "the Apps") developed by Hugo Garza ("we", "us", or "our"). By downloading, installing, or using the Apps, you agree to these Terms. If you do not agree, do not use the Apps.
1. License to Use the Apps
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial language-learning purposes, subject to these Terms and the terms of the Apple App Store or Google Play Store from which you downloaded the App.
2. In-App Purchases
The Apps offer a one-time premium purchase that unlocks additional features. Purchases are processed by Apple or Google and are subject to their respective refund and purchase policies. We do not directly process or store payment information. Premium status is recorded locally on your device and is tied to your App Store or Play Store account.
3. User-Created Content
Some features of the Apps allow you to create your own content, including custom lessons made from text you input or paste into the App ("User Content"). All User Content is stored locally on your device and is not transmitted to us or any third party.
You are solely responsible for the User Content you create. By using these features, you represent and warrant that:
You own the User Content, or you have permission to use it; and
Your User Content does not infringe any copyright, trademark, or other intellectual property right of any third party, and does not violate any applicable law.
You agree not to use the Apps to copy, store, or reproduce copyrighted material (such as song lyrics, books, articles, or other protected works) that you do not own or have permission to use. Because User Content is stored only on your device and is not shared with us or other users, you are solely responsible for ensuring your use complies with applicable copyright law.
4. Repeat Infringer Policy
If we become aware that a user is repeatedly using the Apps to infringe the intellectual property rights of others, we reserve the right to take appropriate action, which may include refusing to provide further support or services to that user.
5. Acceptable Use
You agree not to:
Use the Apps for any unlawful purpose;
Reverse-engineer, decompile, or attempt to extract the source code of the Apps, except as permitted by applicable law;
Use the Apps to harass, harm, or violate the rights of others; or
Attempt to circumvent the in-app purchase system or premium feature gating.
6. Intellectual Property
The Apps, including all design, code, audio, lesson content (excluding User Content), and branding, are owned by Hugo Garza and are protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
7. Disclaimer of Warranties
The Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Apps will be uninterrupted, error-free, or free from inaccuracies. Language-learning content is provided for educational purposes and may contain errors or simplifications.
8. Limitation of Liability
To the maximum extent permitted by law, in no event shall Hugo Garza be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Apps. Our total liability to you for any claim arising out of these Terms or the Apps shall not exceed the amount you paid for the App in the twelve months preceding the claim.
9. Changes to These Terms
We may update these Terms from time to time. Any changes will be reflected on this page with an updated revision date. Continued use of the Apps after changes are posted constitutes acceptance of the updated Terms.
10. Termination
We reserve the right to discontinue any of the Apps or features at any time. You may stop using the Apps at any time by uninstalling them from your device.
11. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located in Texas.
