These Terms of Service govern your access to and use of the HotoraNight application and related services (collectively, the “Service”). Please read these Terms carefully before using the Service.

By accessing or using HotoraNight, you confirm that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, you must not access or use the Service.

1. Eligibility

You must be at least 18 years old to access or use HotoraNight.

By using the Service, you represent and confirm that you meet this age requirement. HotoraNight does not knowingly permit anyone under the age of 18 to use the Service.

Your use of the Service must also comply with all laws and regulations applicable to you in your jurisdiction.

2. The Service

HotoraNight is an application provided by HotoraNight and may be accessed through supported electronic devices, including mobile phones, tablets, and computers.

The Service may be downloaded or accessed through third-party application distribution platforms, including the Apple App Store and Google Play Store. Your use of such platforms may also be subject to their respective terms and policies.

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time. We may make changes for operational, technical, legal, security, or other legitimate reasons.

3. Your Responsibilities

You are responsible for ensuring that your use of the Service is lawful and complies with these Terms.

• use the Service in violation of any applicable law or regulation;

• use the Service to distribute malicious software or harmful content;

Third-party services are not owned or controlled by HotoraNight. We do not control and are not responsible for their content, availability, privacy practices, security, products, or services.

HotoraNight will not be responsible for any loss or damage arising from your access to, reliance on, or use of third-party services.

6. Suspension and Termination

We may suspend or terminate your access to the Service, with or without prior notice, where we consider it necessary, including if you breach these Terms or use the Service in an unlawful, abusive, fraudulent, or unauthorized manner.

If your access is terminated or suspended, your right to use the Service will cease immediately unless otherwise required by applicable law.

Termination does not affect any rights or obligations that arose before termination or any provisions that are intended to survive termination.

7. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by applicable law, HotoraNight makes no warranties or representations, express or implied, regarding the Service, including its availability, reliability, accuracy, suitability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

We do not guarantee that:

• the Service will always be available or operate without interruption;

• the Service will be free from errors, defects, or technical problems;

• information provided through the Service will always be accurate, complete, or current;

• the Service will meet your particular requirements; or

• the Service or its servers will always be free from viruses, malware, or other harmful components.

Nothing in these Terms excludes or limits any warranty, right, or protection that cannot legally be excluded or limited under applicable law.

8. Limitation of Liability

To the fullest extent permitted by applicable law, HotoraNight and its affiliates, licensors, service providers, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Service.

This includes, without limitation, loss of profits, loss of data, loss of business opportunities, business interruption, loss of privacy, or other intangible losses, even if we have been advised that such damages may occur.

To the extent permitted by applicable law, the total liability of HotoraNight and its suppliers arising out of or relating to the Service or these Terms will not exceed the amount you actually paid through the Service during the relevant period, or USD 100 if you have not made any purchase through the Service.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

9. Privacy

Your use of HotoraNight is also governed by our Privacy Policy, which explains how personal information may be collected, used, stored, and disclosed.

By using the Service, you acknowledge that you should review the Privacy Policy before using HotoraNight.

10. Governing Law

These Terms and your use of the Service are governed by the laws applicable in Egypt, without regard to its conflict-of-law principles.

Your use of the Service may also be subject to mandatory laws and regulations applicable in your location.

Where applicable law provides you with mandatory consumer protections that cannot be waived by contract, those protections will remain unaffected by these Terms.

11. Dispute Resolution

If you have a complaint, concern, or dispute regarding the Service, you agree to first contact us and make a reasonable effort to resolve the matter informally.

Nothing in this section prevents you from exercising any rights or remedies that cannot legally be excluded under applicable law.

12. European Union Users

If you are a consumer residing in the European Union, nothing in these Terms is intended to deprive you of any mandatory rights or protections granted to you under the laws of the country in which you reside.

Where applicable, mandatory consumer protections will prevail over any conflicting provision of these Terms.

13. United States Compliance

You represent that:

1. you are not located in a country or territory subject to applicable United States government embargoes or designated as supporting terrorism under applicable United States law; and

2. you are not listed on any applicable United States government list of prohibited or restricted parties.

You must not use the Service in violation of applicable export control, sanctions, or trade restrictions.

14. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable while preserving its original purpose as far as legally possible.

The remaining provisions will continue in full force and effect.

15. No Waiver

If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right or provision.

A waiver of one breach does not constitute a waiver of any subsequent breach.

16. Language

These Terms may be made available in languages other than English for convenience.

If there is any conflict or inconsistency between the English version and a translated version, the English version will prevail to the extent permitted by applicable law.

17. Changes to These Terms

We may update these Terms from time to time.

If we make a material change, we will make reasonable efforts to provide notice before the updated Terms take effect. The revised Terms will become effective on the date stated in the updated version.

By continuing to access or use HotoraNight after the revised Terms become effective, you agree to be bound by the updated Terms.

If you do not agree with the revised Terms, you should stop using the Service.

19. Entire Agreement
