COMMONLY USED MUNICIPAL ORDINANCE CHARGES
(This is NOT a complete list)
PURPOSE: To provide an easy to use reference for law enforcement of the most commonly used City of Tampa municipal ordinance violations.
DISCUSSION: Under Section 18.1, Tampa Code, Tampa Police Officers have the primary responsibility of the enforcement of municipal ordinances within the City of Tampa. The City of Tampa uses Municode to store its ordinances electronically. A complete listing of ordinances can be found with a Google search or “Tampa Municode” or at https://library.municode.com/fl/tampa
In order to provide a quick reference guide, the following list of commonly used ordinances was created by an Assistant City Attorney. Any questions can be directed to the municipal prosecutor, currently Jerrod Simpson at (813) 274-8796 or Jerrod.Simpson@tampagov.net.
Where no specific penalty is provided, municipal ordinance violations may be punished under Section 1-6, Tampa Code, which allows for, up to a $500 fine and/or up to 60 days in jail. Officers should use the NTA process in-lieu of full custodial booking when appropriate. If the violation is punishable by arrest, the Municipal Ordinance NTA Calendar should be used.
However certain violations have been classified under Tampa City Code, to be punishable by a civil citation instead of arrest. If the violation is punishable by citation, a municipal citation book should be used and the appropriate “Class” checked in accordance with Section 23.5-5. Citations should be immediately sent to Records to be scanned, after which they will be handled by the City Attorney’s Office, municipal prosecutor (See Legal Bulletin #’s 12-07, 12-06, & 12-05).
