TERMS OF SERVICE

MEMO

While I understand that this Terms of Service is not legally binding in certain cases, I ask that anyone who considers commissioning me read it thoughtfully as misunderstanding can thus be avoided. 

Please keep in mind that my commissions are geared towards creative freedom, meaning I do require all of that artistic license to streamline the process for better results. 

By ordering a commission you are confirming that you are have read and agreed with the terms listed on this page.

THEMES OF ART

First of all, I am more than willing to work with you! 

However, I take a great deal of pride in my work and therefore you shouldn't be surprised if I might disregard your offer. I mainly do this for one or two reasons: either I can't do the job within the offered budget or the project is of a scope that doesn't fit within the nature of the work I can do. 

For a better understanding and ensuring you have the best experience working with me, I have established a list of themes I might consider taking into work.

The art I do for commissions tends to be on the SFW side of things, so I can only make it look suggestive if you're considering commissioning something in that vein. Keep in mind that artistic nudity is an option that is billed separately, as I can't stream that type of content on Twitch.

I strongly encourage you to familiarize yourself with the content of my galleries if it's the first time you are sending a commission inquiry. Best thing to do is to look at the stuff I uploaded in the past year or two. When in doubt of course ask right away! I'm happy to answer any message that comes my way.

COMMISSION PENDING

PAYMENT

Notice that you are paying for digital good, which is a service I provide, therefore, you are paying for a service.

The only currencies I accept are USD and EUR. Feel free to ask for payment in RUB if you are from my home region.

I work only with the invoices that I issue through PayPal, meaning PayPal is my preferred method of payment. No E-Checks.

[11.03.2022] Due to PayPal's recent restrictions, I work only with the invoices that I send through Payoneer or by issuing a commission through Buy Me A Coffee unless otherwise stated.

[15.11.2022] As of Decemeber 2022, Payoneer is no longer be to provide its services hence the payment is issued through Telegram Donate bot/Boosty unless otherwise stated.

Payments must be made in full within 48 hours of an invoice before any work is done, otherwise your inquiry gets terminated and replaced by another person. Granted by special cases, which are usually discussed prior the invoice is issued, payment can be postponed to a later date.

Once your payment has cleared, you will receive a short notice via your preferred method of contact, coupled with your commission added to the queue.

PAYMENT PLANS 

Depending on the medium of your commission, I'm willing to accept a payment plan in which a non-refundable half is required upfront, while the other half is received at a later date (usually after I send a set of rough thumbnails). Work will not progress beyond the pre-production stage until the other half is received. 

REFUNDS

[11.03.2022] Due to the complications of international transactions in my home region, refund policy is as follows: all orders are final, and refunds can only be executed if no work has begun. Sorry for the inconvenience caused.

Refund, if granted, will be applied via the original PayPal invoice used to collect payment for the commission/s.

Refunds requested during the pre-production stage and beyond will most likely cause an inconvenience fee (10% of the total cost of your commission + the service fees of PayPal) and a work fee (based on the amount of hours spent on pre-production/production of your commission) being deducted from the refund total. 

No refunds will be issued if you cancel your commission during production stages, or after the commission is complete.

You can only get a full refund excluding the amount PayPal charges for its service if I, the performing artist, terminate the commission myself. I reserve the right to refuse my service and issue a refund due to poor communication, rude or inappropriate behavior, or sometimes unforeseen incapability to complete the commission.

Once you have gained a refund, your piece will not be sent to you, regardless of how much of it has been completed. I hold all of the rights to use the image that is left as I deem fit.

COMMERCIAL USE

By default, commissions are strictly not for commercial use. I will not hold any rights to the characters portrayed unless they are a creation of mine originally. The rights of the characters will stay with the respective rights owner.

Your commission falling under not for commercial use provides you with, uncluding but not limited to the following: prints for personal use (display in your home), resizing or cropping (not altering the atwork itself) the picture to create icons, wallpapers or other graphics to be used in non-commercial digital format, upload of the commission (it must not be any high resolution or unwatermarked version of the artwork) to your socials accompanied by a credit line.

In any case, you may not profit from the artwork unless a separate commercial use agreement has been made. Image rights can be negotiated for an added fee: it comprises x1.5 of the original price and it can be applied to all listings on Illustrations, Characters and Environments pages.

I, as the performing artist, retain ALL the intellectual property pertaining to the commissioned artwork, including the right to use it in any form of publication or promotional value, coupled with to make prints and merchandise of it.

Under no circumstances you are allowed to sell digital files of your commission and/or rights to the finished artwork, mint NFTs (Non-Fungible Tokens), or any blockchain/cryptocurrency related technology. 

POSSIBLE FEES (NOT AFFECTED BY COMMISSION MEDIUM)

Commissioning implies agreement to my own timings; however, if you would like to have your commission by a certain date, please inform me in advance. Keep in mind that commissions with deadlines always include a fee as I postpone other work to stay focused on yours at my whole best. 

Commission work is typically livestreamed on twitch.tv/HitmoreArt from day to day until it is completed. Requiring me to work off-stream will be subject to extra costs.

Private commissions include an inconvenience fee, too. If you wish for your commission/s to remain private (not uploaded to any of my galleries, publicly streamed, etc.), please let me know beforehand. 

POSSIBLE FEES (AFFECTED BY COMMISSION MEDIUM)

Here's a list of things which might affect your commission cost:

Detailed outfits and props (including but not limited to the following: armor, jewelry, weapon, various augmentations)

Extra body parts (including but not limited to the following: tails, heads, arms, etc.), long hair and elaborate hairstyles, wings

Detailed backgrounds and surface rendering (including but not limited to the following: interiors, lush flora, elaborate architecture, crowds)

COMMISSION SLOTS

Commission slots can only be claimed via Google Forms unless otherwise stated. These are usually not First Come First Serve, but the Artist's Choice. Mind that filling the Google Form does not grant you with a commission spot. Applying for a commission or a quote is always free and you won't be charged anything if I have to decline your commission.  

In case you're looking for something that is not listed in the forms, please feel free to contact me directly. 

I also reserve the right to refuse any commission inquiry, at any time, for any reason without explanation of reason or bias. I don't normally do that, providing my commissioners with reason as to why their inquiry is declined whenever I can, so it is more of a precaution.

COMMISSION DETAILS

I work both with human (and human-like) and anthro characters, including but not limited to various beasts (werewolves, vampires, demons, you name it!) and quadropedal creatures. 

I'm not particularly picky with character designs, but as any other artist out there, I prefer them balanced in terms of color and clothing. Natural looking characters are characters after my heart, but I don't mind working with others if their appearance isn't overrun with wild patterns and color schemes. Hard pass on eyestraining characters.

I require that all relevant information be provided upfront. This includes all reference material, descriptions, and ideas. I do not accept written descriptions of characters/props as references. Any references provided for specific characters/props/etc. involved in the commission must have pictures for me to work off of as my vision might differ from yours. However, I don't mind designing required prop/environment/etc. off your written description for a fee.

If it happens that your commission idea is based on a copyrighted franchise, I'm most likely to disregard your inquiry unless you are fine with me altering the design/s in question. A small list of franchises exempted from this prohibition: Elder Scrolls, Fallout, Dragon Age, The Witcher, Red Dead Redemption, Star Wars (only if your character is originated from said franchises, not just an anthro character wearing well-known armor or wielding a lightsaber). Naturally, there are certain franchises I don't put up with as I'm not a fan of their design choices: Final Fantasy, Monster Hunter, Genshin Impact, World Of Warcraft.

WORKFLOW

COMMUNICATION

My inbox is always open and I do my best to respond to commissioner concerns, but please mind the time zones -- mine is GMT+3

I may not be available to answer your messages on holidays, scheduled days off work, or emergencies. I keep my schedule posted over Discord. If you do not receive a reply within 5 business days, I strongly encourage you to poke me again. I receive a lot of messages on a daily basis on different platforms both related to work and life stuff so it might get lost in the shuffle.

Сommunication about commissions will take place solely through your preferred method of contact for the purpose of record-keeping. I will not discuss anything related to your piece using any other means except the one you have provided in the Google form. 

If you fail to respond to my message within 5 business days, your commission will be pushed back in the queue until other commission (provided if I have other commissioners waiting) has been completed.

PRODUCTION

I work with a commission queue of usually around 2 or 3 slots for illustrations, the rest is usually small works or whatnot. 

Commissioning an illustration from me implies the following workflow: pre-production (thumbnails, refined thumbnail, value exploration), production (line, values+ao, color, render) and postproduction (touch ups, post-processing). You are free to monitor the progress of your commission over my Discord, I tend to keep it updated daily.

Once again, commissioning implies agreement to my own timings. I prefer taking my time and do my job thoughtfully. On average it takes me less than one or two weeks to deliver a set of thumbnails. This also will vary depending on the size of my queue and the complexity of the work requested. 

You will recieve updates on your commission whenever it's necessary, usually while I am on pre-production stage of your piece or on production stage if it happens to be an extra detailed project, so the amount of back-and-forth communication is desired. You are free to check in whenever you feel it is necessary for updates or any questions you might have. 

Commissioning a character piece from me implies the following workflow: research (figuring out the pose and composition), rough sketch (the one I send to get a feedback from my commissioners), sketch, line, color, touch-ups. You are free to monitor the progress of your commission over my Discord, I tend to keep it updated daily.

REVISIONS

Unless discussed prior your commission inquiry, any rejected sketch and other forms of preliminary visual work stays with me, with the understanding that I may reuse any thumbnail for future artwork at my discretion.

Once my work on your commission has started, free corrections may be implemented along the duration of pre-production stage. Requested revisions that diverge from your initial inquiry description/references may increase the length of time production takes, and most likely will be billed separately.

No more work or changes will be applied to the commission if it is fully approved. Be aware that the post-process alterations might look off.
I will remove the PSD from my drive/cloud space eventually, so when receiving your commission, please make sure to look over the artwork before approving it. 

I accept free changes based on things that I have forgotten or missed, but only if that information was included in your initial inquiry, otherwise you will be additionally charged on top of the original commission cost. 

I reserve the right to refuse alterations that I feel compromise my style. With that in mind, I will also take liberties where necessary while interpreting your character in my art features, including but not limited to the following: human-like feet (if your character has a digitigrade feet by their origin, I have no problem with that, just keep in mind that they will be depicted shoeless), average body size (no hypers).

These Terms of Service are subject to revisions, editing, and additions without notice.
