Apps offered through the App Store are provided to you under a license, not sold outright. Your right to use each app depends on your acceptance of either this Licensed Application End User License Agreement (“Standard EULA”) or a separate agreement between you and the app provider (“Custom EULA”), if one exists. For Apple-developed apps, the license is granted by Apple; for third-party apps, it is granted by the respective provider. Any app governed by this agreement is referred to as the “Licensed Application,” and all rights not expressly granted remain with the applicable licensor (“Licensor”).
1. Scope of License
The Licensor grants you a non-transferable license to use the Licensed Application on Apple-branded devices you own or control, in line with the Usage Rules. This agreement also applies to any content, services, or updates related to the app unless a Custom EULA is provided. You may not distribute the app across multiple devices via a network, resell or sublicense it, or transfer it without removing it from your device first. You are also prohibited from copying (except as allowed), modifying, reverse-engineering, or creating derivative works from the app, unless permitted by law or applicable open-source terms.
2. Consent to Use of Data
You agree that the Licensor may collect technical data—such as device details, system information, and usage diagnostics—to support updates, maintenance, and related services. This information may be used in a non-identifiable form to improve products or services.
3. Termination
This agreement remains in effect until terminated by you or the Licensor. Your rights will automatically end if you fail to comply with any of its terms.
4. External Services
The Licensed Application may provide access to third-party or Licensor-operated services (“External Services”). Your use of these services is at your own risk. The Licensor does not guarantee their accuracy or reliability and is not responsible for their content. Information provided through such services is for general purposes only and may not always be accurate. You agree not to misuse these services or violate any intellectual property rights. Availability may vary by region, and the Licensor may modify or restrict access at any time without notice.
5. No Warranty
You acknowledge that use of the Licensed Application is entirely at your own risk. To the fullest extent allowed by law, the app and related services are provided “as is” and “as available,” without any warranties—express, implied, or statutory—including fitness for a particular purpose, accuracy, or non-infringement. Any advice or information provided does not create a warranty. If issues arise, you are responsible for any repair or correction costs, except where prohibited by law.
6. Limitation of Liability
To the extent permitted by law, the Licensor is not liable for any indirect, incidental, or consequential damages, including loss of data, profits, or business interruptions, arising from your use or inability to use the app. Even if advised of such risks, liability remains limited. In all cases (except where required by law, such as personal injury), the Licensor’s total liability will not exceed $50. Some jurisdictions may not allow these limitations, so they may not fully apply to you.
7. Export Compliance
You agree to comply with all applicable export laws. The Licensed Application may not be used or exported in violation of U.S. laws, including to embargoed countries or restricted individuals. By using the app, you confirm that you are not subject to such restrictions and will not use it for prohibited purposes, including the development of weapons.
8. U.S. Government Use
The Licensed Application and related documentation are classified as “Commercial Items” under U.S. regulations and are provided to government users with the same rights granted to all other users.
9. Governing Law
Except where otherwise specified, this agreement is governed by the laws of the State of California, and disputes will be handled in the courts of Santa Clara County, California. If you are located outside the U.S., applicable local laws may govern, and disputes may be resolved in courts within your region. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this agreement.
