Introduction
These Terms and Conditions ("Terms") govern your access to and use of the Heroes mobile application ("App" or "Service") provided by the Armed Forces of the Philippines Pension and Gratuity Management Center (AFPPGMC) ("we," "us," "our," or "AFPPGMC").
By creating an account, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND AFPPGMC.
By accessing or using the App, you represent and warrant that:
You are at least 18 years of age, or if you are a minor beneficiary, your parent or legal guardian has consented to these Terms on your behalf
You have the legal capacity to enter into a binding agreement
You are an eligible pensioner, beneficiary, or authorized representative with a legitimate interest in accessing pension services
All information you provide is accurate, current, and complete
The Heroes App provides pension management services, including but not limited to:
Viewing pension account information
Submitting pension claims and applications
Uploading required documents and forms
Verifying location for form submissions
Tracking application status and approvals
Receiving notifications and updates
Accessing pension-related resources and information
Communicating with AFPPGMC staff
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for maintenance, updates, or other operational reasons.
3.1 Account Creation
To use the Service, you must create an account by providing:
Your AFP Serial Number
Personal information (name, date of birth, branch of service)
Contact information (email address, phone number)
Location permission (for form submissions)
A secure password meeting our requirements
3.2 Account Responsibilities
You are solely responsible for:
Maintaining the confidentiality of your login credentials (email and password)
All activities that occur under your account, whether authorized by you or not
Immediately notifying AFPPGMC of any unauthorized access or security breach
Ensuring your contact information is current and accurate
Not sharing your account credentials with any third party
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time if:
You violate these Terms
We detect fraudulent or suspicious activity
You provide false or misleading information
Required by law or government directive
Your pension eligibility status changes or terminates
You agree to use the Service only for lawful purposes. You must NOT:
Submit false, fraudulent, or misleading information
Provide false or spoofed location data
Upload forged, altered, or counterfeit documents
Impersonate another person or misrepresent your identity
Attempt to gain unauthorized access to other accounts or systems
Introduce viruses, malware, or malicious code
Use automated tools (bots, scrapers) to access the Service
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or extract source code
Use the Service for any illegal or unauthorized purpose
Harass, abuse, or threaten AFPPGMC staff or other users
Violation of this policy may result in immediate account termination and potential legal action, including criminal prosecution for fraud.
When uploading documents through the App, you agree that:
All documents are genuine, unaltered, and accurate
You have the legal right to submit the documents
Documents are clear, legible, and in acceptable formats (PDF, JPEG, PNG)
You will provide accurate location data when submitting forms
You understand that submitting false documents is a criminal offense under Philippine law
We reserve the right to:
Request additional verification or original documents
Reject incomplete, illegible, or suspicious documents
Report suspected fraud to appropriate authorities
Submitting falsified or fraudulent documents may result in criminal prosecution under Republic Act No. 10175 (Cybercrime Prevention Act) and other applicable laws.
By using the Service, you consent to receive communications from us through:
Push notifications on your mobile device
Email messages to your registered email address
SMS text messages to your registered phone number
In-app messages and announcements
These communications may include:
Application status updates and approvals
Required document requests
Service updates and maintenance notices
Important policy changes
Security alerts
While you may disable certain non-essential notifications in your device settings, you acknowledge that doing so may cause you to miss critical information regarding your pension benefits. We recommend keeping notifications enabled.
The App and all its content, features, and functionality (including but not limited to software, design, text, graphics, logos, and images) are owned by AFPPGMC or its licensors and are protected by Philippine and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App solely for your personal pension management purposes. You may not:
Copy, modify, or distribute any part of the App
Create derivative works
Remove copyright or proprietary notices
Use AFPPGMC trademarks without written permission
Your privacy is important to us. Our collection, use, and protection of your personal data, including location data, is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the collection, processing, and storage of your personal data, including location information when submitting forms, as described therein.

9.1 "As Is" Service
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 No Guarantee of Availability
We do not warrant that:
The Service will be uninterrupted, timely, secure, or error-free
Results obtained from the Service will be accurate or reliable
Defects will be corrected
The Service will meet your specific requirements
9.3 Technical Issues
You acknowledge that the Service may experience temporary disruptions due to:
System maintenance and updates
Internet connectivity issues
Third-party service provider failures
Force major events (natural disasters, power outages, etc.)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFPPGMC, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
System downtime or service interruptions
Delays in processing applications due to incomplete or incorrect information submitted by users
Unauthorized access to your account resulting from your failure to maintain credential security
Decisions made by you based on information provided through the Service
However, this limitation does not apply to liability that cannot be excluded under Philippine law, including liability for gross negligence or willful misconduct.
Your sole remedy for dissatisfaction with the Service is to stop using it.
You agree to indemnify, defend, and hold harmless AFPPGMC, its officers, employees, agents, and affiliates from and against any, and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
Your use or misuse of the Service
Your violation of these Terms
Your violation of any law or regulation
Your violation of any third-party rights
Any false or fraudulent information you provide
Your negligence or willful misconduct
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
12.2 Jurisdiction
Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Quezon City, Metro Manila, Philippines, and you irrevocably consent to the jurisdiction of such courts.
12.3 Dispute Resolution
Before filing any legal action, you agree to first attempt to resolve any dispute through good faith negotiations with AFPPGMC by contacting us at isu.pgmc@gmail.com.
We reserve the right to modify or update these Terms at any time. When we make material changes, we will notify you by:
Displaying a prominent notice in the App
Requiring you to accept the new Terms before continuing to use the Service
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.
We encourage you to review these Terms periodically to stay informed of updates.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AFPPGMC regarding your use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction.
