Hemlighet-Deer Shika (hereinafter, the “Licensor”)

0.Licensed Data

The data covered by these Terms (the “Data”) consists of all 3D-model data created and provided by Hemlighet-Deer (hereinafter “Licensor”).
 All copyright in the Data remains vested in the Licensor.
No ownership rights are transferred to the purchaser.

1. Eligible Users

・Individual Use: Permitted (commercial and non-commercial).
・Corporate Use: Strictly prohibited.

※ For the purpose of this Terms of Use, “corporate use” refers to use by any legal entity (company, organization, or institution).※ Sole proprietors and freelancers are treated as individual users.

2. Uploading to Online Services

・Uploading to social communication and online game platforms (e.g., VRChat) is permitted.
・Sharing with third parties or use by anyone other than the purchaser or gift recipient is prohibited.
※If you intend to use this asset for streaming or video content,
you must also review the “Additional Terms for Streamers.”

⚠️Proxy updates / setup:
If setup or updates are performed by anyone other than the purchaser or gift recipient, a separate license is required for each individual. This rule exists to prevent unauthorized data sharing.

3.Redistribution / Distribution

・Redistribution of unmodified data: Prohibited
・Distribution of modified data: Prohibited


⚠️ Redistribution includes, but is not limited to:
・Sharing data with friends or third parties・Reselling or re-distributing even if modified・Including assets in another avatar/model for resale
・Assets from this shop may only be used by the purchaser or gift recipient.  
⚠️Violations may result in license termination and legal liability, regardless of the user's country of residence.


4.Editing (Adjustment/Modification/Reproduction)

・Adjustments:　Permitted
・Modifications:　Permitted
・Outsourcing modifications or sharing data for updates: Not permitted
※Outsourcing modification or setup work requires each participant to hold a valid license.
⚠️ Same redistribution restrictions apply as above.
⚠️ Each person assisting with setup must purchase their own license.


5. Sensitive Expressions 

・Sexual expressions:　Allowed, with proper age/content separation
・Violent expressions :　Allowed, with proper age/content separation
・Political or religious activities :　Prohibited


6. Use in Media / Products

For streaming/recorded video use
・Please review “The Additional Terms for Streamers.”
・Publications / paid products: Contact required
・Use in software for product development: Contact required

Examples:✅ Inclusion in personal/corporate articles → Allowed✅ Snapshots taken and compiled in articles → Allowed✅ An individual purchaser using the asset in streaming or content creation → Allowed❌ Corporate use of purchased assets for streaming or content creation → Not allowed❌ Corporate use of 3D data shared from an individual → Not allowed※ Coverage or mention of these assets in articles/media by third parties is allowed.

7. Secondary Creations

・Creating derivative data using meshes/weights: Not permitted
・Clothing / accessories / textures using only morphs: Allowed for private personal use only
・Integrating data into models for distribution: Contact required

8. Credit & Hashtags

・Recommended hashtag:  #HemlighetDeer
・Suggested credit: Hemlighet-Deer ( https://ray-0.booth.pm/ )
　Credit is optional but greatly appreciated — it supports future creations.
　

9.Special Notes

Copyright:

The copyright in this data shall remain the sole property of the creator, Hemlighet-Deer Shika.
No rights are transferred to the purchaser other than the limited license expressly granted herein.  


Legal Notice – Governing Law and Jurisdiction:


These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. These restrictions apply regardless of the user’s country of residence.


This shop’s assets can only be obtained from the Hemlighet-Deer BOOTH page.
If obtained from any other source, necessary legal action may be taken against the distributor or users.
