I examine the impact of patent litigation on firms’ post-litigation intellectual property (IP) strategies in response to the opposing litigants. Using a plaintiff-defendant pairwise dataset of 1,278 patent litigation cases from the United States (1995-2015), I provide empirical evidence that litigants refine their IP strategies by reducing the technology overlap with their competitors.
We investigate international M&As among firms involved in the same litigation event and provide empirical evidence that firms acquire the opponent firms to grasp subsequent business opportunities in product markets.
