1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and MASHAL SOFT ("we," "our," or "us"), the developer of Face Swap & Outfit Change — AI Headshot, Avatar & Makeover (the "Application").
By downloading, installing, or using the Application, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall and discontinue all use of the Application.
We reserve the right to modify these Terms at any time. Continued use of the Application after any changes constitutes your acceptance of the revised Terms.
2. Eligibility
By using the Application, you represent and warrant that:
You are at least 13 years of age, or the minimum age required in your jurisdiction to enter into a binding agreement
If you are under 18, you have obtained consent from a parent or legal guardian
You have the legal capacity to enter into this agreement
Your use of the Application complies with all applicable local, national, and international laws
We reserve the right to suspend or terminate accounts of users who do not meet eligibility requirements.
3. License to Use
3.1 Grant of License
Subject to your compliance with these Terms, MASHAL SOFT grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Application on an Apple iOS device that you own or control, solely for your personal, non-commercial purposes.
3.2 Restrictions
You agree that you will not:
Copy, modify, distribute, sell, or lease any part of the Application or its content
Reverse engineer, decompile, or attempt to extract the source code of the Application
Use the Application for any commercial purpose without prior written consent from MASHAL SOFT
Use automated tools, bots, or scripts to access or interact with the Application
Attempt to gain unauthorized access to any part of the Application or its related systems
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
4. User Content and Uploaded Images
4.1 Your Content
The Application allows you to upload photographs ("User Content") for the purpose of AI-powered face swap, outfit change, and headshot transformation. You retain full ownership of all User Content you upload.
4.2 Your Responsibility
By uploading any image or photograph, you represent and warrant that:
You are the subject of the photograph, or you have obtained explicit consent from all individuals depicted in the image
You have the legal right to use and upload the image
The image does not violate any third-party intellectual property rights, privacy rights, or publicity rights
The image does not contain nudity, graphic violence, hate symbols, or any illegal content
4.3 Prohibited Content
You must not upload images that:
Depict minors in any inappropriate context
Are sexually explicit or pornographic in nature
Depict or promote violence, terrorism, or illegal activity
Impersonate or misrepresent another real person with intent to deceive or harm
Violate the privacy or rights of any third party
We reserve the right to refuse processing of any image that we reasonably believe violates these Terms, without notice or liability.
5. AI-Generated Transformations
The Application uses artificial intelligence to generate transformed images. By using this feature, you acknowledge and agree that:
AI-generated results are provided for personal, creative, and entertainment purposes only
Transformation results may not always be perfectly accurate or realistic
You will not use AI-generated images to deceive, defraud, defame, or harm any individual or organization
You will not use generated images to create misleading content, deepfakes intended for deception, or any content that violates applicable laws
MASHAL SOFT is not responsible for how you choose to use or share your generated images
The misuse of AI-generated content — including using it to impersonate others, spread misinformation, or cause harm — is strictly prohibited and may result in permanent account termination and legal action.
6. In-App Purchases and Subscriptions
6.1 Purchases
The Application may offer in-app purchases, credits, or subscription plans (collectively "Purchases"). All Purchases are processed securely by Apple Inc. through the App Store. MASHAL SOFT does not collect or store your payment information.
6.2 No Refunds
All Purchases are final and non-refundable, except as required by applicable law or Apple's standard refund policy. If you believe you are entitled to a refund, you must submit your request directly through the Apple App Store.
6.3 Subscription Terms
If you purchase a subscription:
Your subscription will automatically renew at the end of each billing period unless cancelled
You may cancel your subscription at any time through your Apple ID account settings
Cancellation takes effect at the end of the current billing period — no partial refunds are issued
Price changes will be communicated in advance through the App Store
7. Intellectual Property
All content within the Application — including but not limited to templates, artwork, graphics, design elements, software, code, branding, and text — is the exclusive property of MASHAL SOFT or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You are granted no ownership or intellectual property rights over any content within the Application. You may not use, reproduce, or distribute any Application content without our express written permission.
Any feedback, suggestions, or ideas you provide to us may be used by MASHAL SOFT without compensation or obligation to you.
8. Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MASHAL SOFT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
That the Application will be uninterrupted, error-free, or free of viruses or harmful components
That the results obtained from the Application will be accurate, reliable, or meet your expectations
That any defects in the Application will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MASHAL SOFT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Loss of data, revenue, profits, or business opportunities
Personal injury or property damage arising from your use of the Application
Unauthorized access to or alteration of your data
Any conduct or content of third parties within the Application
In no event shall MASHAL SOFT's total liability to you for all claims exceed the amount paid by you, if any, for accessing the Application in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless MASHAL SOFT and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Your use or misuse of the Application
Your violation of these Terms
Your violation of any rights of a third party, including privacy or intellectual property rights
Any User Content you upload through the Application
11. Termination
We reserve the right to suspend or terminate your access to the Application at any time, without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users, third parties, or our business interests.
Upon termination, all licenses granted to you under these Terms will immediately cease. You may also terminate your use at any time by uninstalling the Application from your device.
All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MASHAL SOFT operates, without regard to its conflict of law principles.
Any dispute arising from or related to these Terms or the Application shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
13. Third-Party Services and Links
The Application may integrate with or contain references to third-party services, including Apple's App Store and payment infrastructure. These third-party services are governed by their own terms and privacy policies.
MASHAL SOFT is not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is entirely at your own risk.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, legal requirements, or Application features. When we make material changes, we will update the Effective Date at the top of this document and notify you through an in-app notice.
Your continued use of the Application after any modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
15. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MASHAL SOFT regarding the Application and supersede all prior agreements or understandings.
