This Privacy Policy applies globally to all individuals who access or use the Platform in any capacity, including users, clients, therapists, and coaches. By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to the practices described herein.
Hapsmiths operates as a global business-to-consumer digital wellness platform. The Platform enables individuals to access online therapy and wellbeing consultations provided by licensed professionals, as well as nutrition and fitness consultations and longer-term coaching programs delivered by non-medical coaches. All services are provided remotely and are non-emergency in nature. Hapsmiths does not operate as a crisis response service, does not provide emergency intervention, and does not prescribe, dispense, or manage medications. Users are responsible for seeking immediate assistance from local emergency services or qualified medical professionals where necessary.
In order to provide the Platform and its services, Hapsmiths collects certain information directly from users, including name, email address, date of birth, gender, and other details submitted during account registration and onboarding. Prior to therapy or consultation sessions, users may be required to complete intake questionnaires. During consultations and programs, therapists and coaches may record professional notes on the Platform, and users may exchange messages, feedback, images, or other content as part of their engagement. In nutrition and fitness programs, users may voluntarily share photographs depicting body progress or meal plates for the sole purpose of personalized coaching. Such images are visible only to the specific coach assigned to the user.
Certain information is collected automatically through the use of the Platform, including technical and usage data such as IP address, device identifiers, browser or operating system information, timestamps, authentication logs, and general interaction data. Cookies and similar technologies may be used on web-based services to support functionality, security, session continuity, and performance analysis. Automatically collected data may be associated with user accounts where required for service delivery, security, or compliance purposes.
Some of the information processed by Hapsmiths may be sensitive in nature, including information relating to mental wellbeing, lifestyle, nutrition, fitness, consultation content, and user-shared images. Although Hapsmiths’ services are positioned as non-medical and non-emergency, such information may be treated as sensitive or special-category personal data under applicable data protection laws. Users acknowledge that the voluntary digital sharing of such information carries inherent privacy risks, and Hapsmiths applies heightened confidentiality, access control, and security practices to such data.
Hapsmiths processes personal information for lawful and legitimate purposes, including but not limited to: creating and managing accounts; authenticating access; facilitating consultations and coaching programs; enabling secure communications; personalizing services; maintaining continuity and quality of service; processing payments; providing customer support; conducting internal operations, audits, analytics, and troubleshooting; improving the Platform; enforcing applicable terms and policies; protecting the safety, integrity, and rights of users, practitioners, and the Platform; and complying with legal and regulatory obligations. Processing is based on user consent, necessity for contractual performance, legitimate business interests balanced against user rights, or compliance with applicable law, depending on the context.
Users independently select their therapists or coaches on the Platform. All therapists providing therapy services through Hapsmiths are licensed professionals in their respective jurisdictions, including counseling psychologists and therapists registered with the Rehabilitation Council of India (RCI). Nutrition and fitness coaches are non-medical professionals and do not provide medical advice, diagnosis, or treatment. Coaches and therapists access user information solely to deliver assigned services and are subject to contractual confidentiality, platform policies, and access restrictions. Coaches are technically restricted from downloading user data, storing user images locally, or contacting users outside the Platform.
The Platform includes separate, role-based interfaces for users and for therapists or coaches. Access to any interface requires authentication through registered email and one-time password (OTP) verification. OTP-based authentication is required upon registration and subsequent logins, serving as a security safeguard to prevent unauthorized access. Role-based access controls ensure that therapists and coaches may only view information related to users assigned to them, and cannot access data belonging to other users.
Hapsmiths employees do not access consultation content or user communications in the ordinary course of operations. Internal staff may access limited metadata, system logs, or support ticket information for operational, security, or customer support purposes, and may access additional information only where necessary to respond to emergencies, legal obligations, or verified safety concerns.
Hapsmiths does not sell personal information. Personal information may be shared on a limited basis with therapists or coaches providing services to the user, and with trusted third-party service providers that support Platform operations, including cloud infrastructure, payment processing, communications delivery, analytics, and security services. Such service providers act under binding contractual obligations that require confidentiality, data protection, and restricted use of information. Personal information may also be disclosed where required by law, regulation, court order, or governmental authority, or where necessary to protect the rights, safety, or property of users, practitioners, or Hapsmiths. In the event of a merger, acquisition, or corporate restructuring, personal information may be transferred subject to appropriate safeguards.
Payments on the Platform are processed by third-party payment processors, including Razorpay. Users may transact in supported currencies, including Indian Rupees (INR), United States Dollars (USD), British Pounds (GBP), and United Arab Emirates Dirhams (AED), subject to availability. Hapsmiths does not store complete credit or debit card details. Limited transaction-related information may be retained for accounting, reconciliation, fraud prevention, and legal compliance.
Hapsmiths uses cloud infrastructure hosted by third-party providers, including Amazon Web Services (AWS). Personal information is primarily stored on servers located in India. As the Platform operates globally, authorized personnel and service providers may access systems from other jurisdictions as necessary to provide services, support, and system maintenance. Hapsmiths implements appropriate technical and organizational safeguards for cross-border access and processing in accordance with applicable laws.
Personal information is retained only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including service delivery, continuity, dispute resolution, security, and legal compliance. Retention periods vary depending on the nature of the information and applicable requirements. Upon account deletion or closure, personal information will be deleted or anonymized where reasonably possible, subject to legal, regulatory, and operational obligations.
Depending on jurisdiction, users may have rights to request access to their personal information, request correction of inaccuracies, request deletion or restriction of processing, withdraw consent where applicable, request data portability, or object to certain processing such as direct marketing. Requests may be submitted to Hapsmiths, and identity verification may be required. Certain requests may be limited or declined where permitted by law.
Hapsmiths may send communications that are necessary for Platform operation, account management, consultations, and service updates. Marketing or promotional communications may also be sent, and users may opt out of such communications where required by law. Opting out of marketing does not affect receipt of essential service-related communications.
Hapsmiths maintains reasonable and appropriate technical and organizational security measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. However, no system can be guaranteed to be completely secure.
In the event of a personal data breach, Hapsmiths will take reasonable steps to investigate, mitigate, and remediate the incident, and will provide notifications to affected individuals or authorities where required by applicable law.
The Platform may contain links to third-party websites or services. Hapsmiths is not responsible for the privacy practices or content of such third parties.
