Terms of Use

General

These Terms of Use govern, together with the Privacy Policy, your use of Habster (Habit Loop - Atomic Habits) mobile application (the ”Application”) and related services provided by IP Marina Aliakseichyk (”Us”, ”We”).

By downloading the Application you agree to be bound by these Terms of Use and by continue using, you confirm and affirm that you have read, understood and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use the Application.

You may not use the Application for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Application and your Content (defined below), including but not limited to, copyright laws. 

You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials  (collectively, "Content") that you submit, post or display on or via the Application. 

You must not interfere or disrupt the Application, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature. 

You must not create accounts with the Application through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper. 

Intellectual Property Rights

The Application and all related trademarks, logos, software and other intellectual property rights are and shall remain our exclusive property. Your right to use the Application and its content is personal, non-exclusive, non-sublicenseable and non-transferable. Any copying, republication or redistribution of the Application or any of its content is strictly prohibited.

Disclaimer of Warranty

The Application and all of its content is provided on an ”As Is” and ”As available” basis and We do not provide any assurances of the availability or usability by you of the Application.

Limitation of Liability

We shall not be liable for any errors in any content or for any actions taken in reliance thereon. Furthermore, we shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data or compatibility conflicts).

Subscription

Dreamer has an optional Premium subscription. 

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. 

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Application cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Application customer support team. 

A valid payment method, including credit card or PayPal or to iTunes Account, is required to process the payment for your Subscription. You shall provide Application with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Application to charge all Subscription fees incurred through your account to any such payment instruments. 

Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. 

Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal 

Subscriptions and auto-renewal may be turned off by going to Account Settings after purchase.

Should automatic billing fail to occur for any reason, Application will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice. 

Free Trial 

Application offers a Subscription with a free trial for a limited period of time 3 or 7 days (“Free Trial”). 

You may be required to enter your billing information in order to sign up for the Free Trial. 

If you do enter your billing information when signing up for the Free Trial, you will not be charged by Application until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected. 

At any time and without notice, Application reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer. 

Any unused portion of a free trial will be forfeited when a subscription is purchased 

Fee Changes 

Application, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then- current Billing Cycle. 

Application will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. 

Your continued use of the Application after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Miscellaneous

We reserve the right to, from time to time, in our sole discretion amend these Terms of Use. It is your responsibility to review these Terms of Use from time to time to understand the extent of changes. Your continued use of the Application constitutes your agreement to the amended and updated Terms of Use.

These Terms of Use were written in English. To the extent any translated version of these Terms of Use conflicts with the English version, the English version controls.
