These Terms of Service ("Terms") govern your access to and use of the Growtiful mobile application ("App") provided by Wojtek Pe ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. LICENSE TO USE THE APP

We grant you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-commercial license to download and use the App. This license is for the sole purpose of enabling you to use and enjoy the App as provided by us, in the manner permitted by these Terms.

You may not do any of the following:

Copy, modify, distribute, sell, or lease any part of our App.

Reverse engineer or attempt to extract the source code of the App.

Use the App in any way that violates applicable laws or regulations.

Attempt to hack, manipulate, or exploit any game mechanics, In-App Purchases, or advertising systems.

2. IN-APP PURCHASES AND VIRTUAL ITEMS

Our App may offer virtual items, virtual currency, or premium features ("In-App Purchases") for real-world money.

Payment Processing: All In-App Purchases are handled and processed entirely by the applicable app store provider (e.g., Google Play Store or Apple App Store). We do not collect or store your payment information.

Refunds: Because we do not process the payments, all refund requests must be directed to the respective app store and are subject to their specific refund policies.

No Real-World Value: Virtual items and currencies have no real-world monetary value, cannot be exchanged for real money outside of the App, and are not transferable. We reserve the right to manage, regulate, control, modify, or eliminate virtual items at our discretion.

3. ADVERTISEMENTS AND THIRD-PARTY SERVICES

The App is supported by advertising and utilizes third-party analytics to improve gameplay.

We use third-party services (such as Google AdMob) to serve advertisements.

We use third-party analytics tools (such as PostHog) to monitor app performance and usage trends.

By using the App, you acknowledge that we and our third-party partners may collect certain data as outlined in our Privacy Policy. We are not responsible for the content, products, or services offered by third-party advertisers.

4. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the App (including all gameplay mechanics, code, artwork, animations, sounds, music, and text) are and will remain our exclusive property. These Terms do not grant you any right to use our trademarks, logos, or brand features.

5. LIMITATION OF LIABILITY

The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your access to, use of, or inability to access or use the App.

Any bugs, viruses, crashes, or glitches transmitted to or through the App.

Any unauthorized access to or use of our secure servers and/or any personal information stored therein.

6. TERMINATION

We reserve the right to suspend or terminate your access to the App at any time, without notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms. Upon termination, your right to use the App will immediately cease.

7. CHANGES TO THESE TERMS

We may modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this document. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms.
