This Agreement, the Terms, the Services and any modifications thereto may not be assigned or in any way transferred by you without the prior written consent of Grand Canyon Burials. Whereas Grand Canyon Burial may assign this Agreement, the Terms, and any information you provide including without your consent and without limitation, in connection with a sale of its business, assets, a merger or other similar transaction, and also third-party transactions in the performance or promotion of services. Grand Canyon Burial and Customer/Client represent “the Parties.”
Governing Law
The terms of this Agreement shall be construed in accordance with the
substantive laws of the State of Nevada and Arizona, United States of America,
without giving effect to the principles of conflict or choice of law of such
state. The original form of this Agreement has been written in English. The
parties hereto waive any statute, law, or regulation that might provide an
alternative law or forum or might require this Agreement to be written in any
language other than English. This Agreement expressly excludes the United
Nations Convention on Contracts for the International Sale of Goods and, or
Services.
General
Compliance with Laws. You shall comply with all applicable laws, statutes,
ordinances and regulations regarding your use of the Services including
understandings expressed within the Grand Canyon Burial website.
Choice of Forum
and Venue. Should the parties fail to resolve disputes, You hereby consent to
the exclusive jurisdiction and venue of courts in Las Vegas Nevada, U.S.A., in
all disputes arising out of the Terms or relating to the use of the Service.
Changes or Cancellation by Grand Canyon Burial
We will do our best to provide the contracted services, occasionally we may have to make a change to your service selection of which the parties will be notified. The arrangements for
ash scattering locations are made in advance of performing the service(s) and
it is sometimes inevitable that changes may become necessary due to area
closures, national parks closure, roads and highway closures or force of
nature/acts of God/force majeure events. The ash scattering of cremated remains are
conducted at the western base of the Grand Canyon outside of the limits of the
National Park boarder. Ashes are scattered outside of Native nations where it is legal and allowed by the Bureau of Land Management. We reserve the right to make such changes/adjustments
should they become necessary in the performance of our service.
Any monies transacted between parties to secure a service option are non-refundable and
represent a contractual agreement. Any agreed upon payment returns will exclude
credit card transaction fees, as well as, any shipping and handling fees as
applicable.
