1. Introduction
Welcome to InstaOrder, operated by Grabutils Private limited.
By creating an account or placing an order, you agree to these Terms and Conditions (“Terms”).
If you do not agree, please do not use our Platform.
2. Nature of Service
Grabutils Private limited acts as a facilitator between:
Customers (“Users”)
Restaurants preparing food
Independent delivery partners delivering food
We do not prepare, sell, deliver, or control food items.
We only provide a digital platform for placing and managing orders.
3. No Responsibility for Food or Delivery
You acknowledge that:
Restaurants are responsible for food preparation, hygiene, and quality.
Delivery partners are responsible for collecting and delivering orders
Grabutils Private limited is not responsible for:
Wrong items, food taste, quality, freshness, or temperature
Delays, failed delivery, or delivery partner behavior.
Accidents, loss, or health issues due to food consumption
4. User Obligations
You agree to:
Provide accurate delivery and contact details
Pay all charges on time
Check food and allergy information before consuming
Not misuse, resell, or tamper with delivered items
5. Payments & Refunds
Payments are processed through third-party payment gateways.
We do not store or control payment information.
Refunds are processed only in cases approved by restaurant/delivery partner
(except proven technical failure on our platform).
6. Return, Replacement & Cancellation Policy
a) Food Returns
Food items once delivered cannot be returned, due to food safety regulations.
b) Replacement / Issue Reporting
A replacement request may be considered only if:
Wrong item delivered
Damaged/spilled packaging
Missing items
You must report issues within 30 minutes of delivery with photo/video proof through the app support chat provided in contact us section.
c) Cancellations
Before Restaurant Accepts Order: Free cancellation.
After Restaurant Accepts Order: No cancellation & no refund.
After Food is Prepared/Out for Delivery: No cancellation & no refund.
d) Delivery Failure
If delivery partner fails to deliver due to user issue (wrong address, unreachable phone, refusal to accept order), no refund will be issued.
e) Restaurant unavailability
If restaurant cancels or is unable to fulfill the order, you will receive a refund/credit as per the payment gateway timelines.
7. Account Usage
You are responsible for activity under your account.
Do not share login or create fake profiles.
8. Limitation of Liability
Grabutils Private limited is not liable for:
Loss, damage, food issues, health impact
Delays or delivery failure by restaurant/delivery partner
Technical/network failures
9. Indemnification
You agree to indemnify and hold Grabutils Private limited, its directors, and employees harmless against any claim, cost, or loss arising from your use of the platform.
10. Governing Law
These Terms are governed by the laws of India, with exclusive jurisdiction at: Kurnool, Andhra Pradesh
We may update these Terms periodically. Continued use after updates means acceptance of the new Terms.
