Terms of Use for GPHC Exam App

Welcome to the GPHC Exam App. These Terms of Use govern your use of our mobile application and related services. By downloading, accessing, or using our App, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the GPHC Exam App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use the App.
2. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes through the App or by other means. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
3. App License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.
4. User Accounts
4.1 You may need to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.2 You agree to provide accurate and complete information when creating your account and to update your information as necessary.
4.3 We reserve the right to disable your account if we believe you have violated these Terms.
5. Subscription and Payments
5.1 The App offers both free and premium features. Access to premium features requires payment of subscription fees or one-time purchases.
5.2 All payments are processed through the Apple App Store and are subject to their terms and conditions.
5.3 Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
5.4 No refunds will be issued for subscription fees already paid, except as required by applicable law.
6. Intellectual Property Rights
6.1 The App and its content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the property of the GPHC Exam App or its licensors and are protected by UK and international copyright, trademark, and other intellectual property laws.
6.2 You may not modify, reproduce, distribute, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from the App without our prior written consent.
7. User Content
7.1 You retain ownership of any content you submit to the App ("User Content").
7.2 By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the App.
7.3 You represent and warrant that your User Content does not violate any third-party rights and complies with these Terms.
8. Prohibited Conduct
You agree not to:
8.1 Use the App for any illegal purpose or in violation of any local, state, national, or international law.
8.2 Violate or encourage others to violate the rights of third parties, including intellectual property rights.
8.3 Attempt to gain unauthorized access to the App or its related systems.
8.4 Interfere with or disrupt the App or servers or networks connected to the App.
8.5 Use any robot, spider, or other automatic device to access the App.
8.6 Introduce viruses, trojans, worms, logic bombs, or other harmful material to the App.
8.7 Share your account or account information with any third party.
9. Disclaimer of Warranties
9.1 THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9.2 We do not guarantee that the App will be uninterrupted, secure, or error-free.
9.3 We do not warrant that the content provided through the App is accurate, reliable, or correct.
10. Limitation of Liability
10.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.
10.2 Our total liability for all claims related to the App shall not exceed the amount you paid to us for the App in the preceding twelve months.
11. Indemnification
You agree to indemnify, defend, and hold harmless the GPHC Exam App and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
12. Termination
12.1 We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
12.2 Upon termination, your right to use the App will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
14. Dispute Resolution
Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the courts of the United Kingdom.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
