Welcome to Tuning Fork Studio (the “App”). The App may appear as “Tuning Fork” in certain storefronts or languages. These Terms of Use (“Terms”) are an agreement between the developer of the App (“Developer,” “we,” “us,” or “our”) and the individual using the App (“you” or “your”). You can contact the Developer at liyangong697@gmail.com.
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not use the App or purchase any in-app product.
The App is a tool for sound generation, instrument playback, and audio analysis. Its features include custom frequencies, waveforms and harmonics, a piano keyboard and GeneralUser GS instrument playback, real-time microphone analysis, local sound-configuration storage, and audio export.
Subject to your compliance with these Terms and applicable law, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for your personal, non-commercial use on Apple-branded devices that you own or control. The Developer retains all rights, title, and interest in and to the App, its content, code, design, and intellectual property, except for rights expressly granted in these Terms.
You may not:
copy, modify, rent, lease, sell, distribute, sublicense, or otherwise transfer the App;
decompile, reverse engineer, disassemble, or attempt to derive the App’s source code, except to the extent such restriction is prohibited by applicable law;
remove or alter any copyright, trademark, or other proprietary notice in the App; or
use the App unlawfully, in a way that infringes another person’s rights, interferes with security, or otherwise harms others.
With your permission, the App uses your device’s microphone to perform real-time waveform, frequency, input-level, and spectrum analysis on your device. Microphone input is processed locally and is not uploaded to the Developer’s servers.
You are responsible for the audio you record, export, save, or otherwise use through the App. You must have the necessary rights to any audio, music, samples, or other content you use, and you must comply with applicable copyright, privacy, and other laws. Except as required by applicable law, the Developer does not claim ownership of your exported audio or locally saved sound configurations.
The App may offer Pro features through Apple In-App Purchases, including the full instrument library, additional waveforms, unlimited sound configurations, and longer audio-export durations. Product names, available features, territories, prices, taxes, and availability are those displayed in the App and on the App Store at the time of purchase.
The App currently offers the following purchase options:
Monthly Pro subscription: automatically renews each month.
Yearly Pro subscription: automatically renews each year.
Lifetime Pro: a one-time purchase that does not automatically renew.
Monthly and yearly Pro subscriptions are auto-renewable subscriptions:
Payment is charged to your Apple Account when you confirm your purchase.
Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current subscription period.
Your Apple Account will be charged for renewal within 24 hours before the end of the current subscription period, at the price shown at purchase.
You can manage or cancel auto-renewal after purchase in Settings > Apple Account > Subscriptions on your device.
Cancelling auto-renewal does not refund the current subscription period. Your Pro access continues until the end of that period.
If a free trial is offered, any unused portion of it is forfeited when you purchase the applicable subscription, unless otherwise stated on the purchase screen.
You may restore eligible purchases using the App’s “Restore Purchase” function or Apple’s purchase-restoration mechanism on eligible devices, subject to Apple’s rules.
Apple processes in-app purchase payments, renewals, refunds, and billing disputes under its own terms and policies. The Developer cannot directly issue refunds for App Store purchases; you may use Apple’s subscription-management or support channels for those matters.
The App is distributed through the App Store and uses Apple’s in-app purchase services. Your use of the App is also subject to applicable Apple Media Services terms and any other applicable third-party terms.
These Terms are between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support for the App. To the extent permitted by applicable law, the Developer, rather than Apple, is responsible for addressing claims relating to the App’s failure to meet an applicable warranty, product liability claims, regulatory claims, or claims that the App infringes a third party’s intellectual-property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of them, have the right (and are deemed to have accepted the right) to enforce these Terms against you.
You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Our handling of information relating to you is described in our Privacy Policy. Please read it before using the App:
https://sites.google.com/view/gly699/home/privacy_policy
The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, the Developer makes no express or implied warranty that the App will be continuously available, error-free, suitable for a particular purpose, or meet all of your requirements.
Frequencies, pitch, waveforms, spectra, and other analysis results provided by the App are for general audio creation, playback, and educational reference only. They are not medical, diagnostic, safety-testing, or professional-measurement advice. You are responsible for determining whether a result is appropriate for your intended use.
To the maximum extent permitted by applicable law, the Developer is not liable for any indirect, incidental, special, punitive, or consequential loss arising from or related to your use of, or inability to use, the App; in-app purchases; exported audio; or reliance on analysis results. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
The Developer may update these Terms to reflect changes in the App, law, or operations. An updated version will be published on this page and will apply from the date it is posted or any later effective date stated on the page. Your continued use of the App after an update means that you accept the updated Terms.
If you breach these Terms, the Developer may suspend or terminate your license to use the App to the extent permitted by law. You may stop using and uninstall the App at any time. Payments, refunds, and subscription matters already incurred remain subject to Apple’s rules and the applicable provisions of these Terms.
The interpretation, validity, and resolution of disputes under these Terms are governed by the laws that apply to both you and the Developer. If a dispute arises, please first contact the Developer using the email below so that we can try to resolve it informally. If it cannot be resolved, it will be handled by the competent authority as required by applicable law.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and the Developer regarding your use of the App, without limiting any other Apple terms or legal requirements that apply.
