These Terms of Service ("Terms") govern your use of the Glowcast mobile application ("Glowcast", "the app", "we", "us" or "our"), operated by PocketCraft OÜ, a company registered in Estonia, European Union. Please read them carefully. By using Glowcast you agree to these Terms; if you do not agree, do not use the app.
1. Your Acceptance
By downloading, installing, accessing or using Glowcast, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. This forms a legally binding agreement between you and PocketCraft OÜ. We may update the app and these Terms from time to time (see "Changes to These Terms"); your continued use after an update means you accept the revised Terms.
2. Service Overview
Glowcast is a personal tanning and skin-care assistant. It lets you scan your skin with a photo for an AI-assisted skin analysis, shows local UV index and weather information to help you plan, generates a personalised tanning plan, and can send reminders. Glowcast is a lifestyle and informational tool only — it is not a medical, diagnostic or safety device (see "Health, UV & Skin-Analysis Disclaimer"). We may add, change, suspend or remove features at any time. The app may link to or rely on third-party services, for whose content and practices we are not responsible.
3. Health, UV & Skin-Analysis Disclaimer
Glowcast does not provide medical advice. The app, its content, and its AI-generated output are for general informational and educational purposes only and are not a substitute for professional medical advice, diagnosis or treatment. Always consult a qualified doctor or dermatologist about your skin and sun exposure.
Skin analysis is an estimate, not a diagnosis
The skin analysis produces an estimate of tanning-relevant characteristics (such as skin tone). It is not a medical diagnosis, may be inaccurate depending on lighting, camera quality and other factors, and does not detect, screen for, or rule out skin cancer, melanoma or any medical condition.
UV and weather data
UV index and weather information are provided by third parties and may be delayed, incomplete or inaccurate. Do not rely on them as your sole basis for sun-exposure decisions.
Assumption of risk
Sun and UV exposure carries inherent health risks, including sunburn, premature skin ageing, eye damage and skin cancer. Any tanning guidance Glowcast provides is informational only and does not guarantee a safe outcome. You are solely responsible for your tanning decisions and accept all associated risks.
4. No Warranties
Glowcast is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, timely, secure or error-free, or that any content — including skin-analysis results, UV data, weather forecasts or AI recommendations — will be accurate, reliable or complete.
5. Limitation of Liability
To the fullest extent permitted by applicable law, PocketCraft OÜ will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to your use of (or inability to use) Glowcast. In particular, we are not liable for any personal injury or health consequence resulting from sun or UV exposure, or from reliance on the app's content or AI output.
Our total aggregate liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim or EUR 50. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for death or personal injury caused by our negligence, for fraud, or any mandatory rights you have as a consumer.
6. Indemnification
You agree to indemnify and hold harmless PocketCraft OÜ and its officers, employees and partners from any claims, damages, losses or expenses (including reasonable legal fees) arising from your misuse of the app, your breach of these Terms, or your violation of any law or the rights of a third party.
7. Premium Subscription
Glowcast has a paid Premium subscription that unlocks additional features (such as advanced plans and expanded analysis). Subscriptions are sold and billed through your Apple App Store account.
Billing and auto-renewal
Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before each renewal.
Free trials
If a free trial is offered, you are not charged during the trial, and it automatically converts to a paid subscription unless you cancel before it ends. Any unused portion of a trial is forfeited when you purchase a subscription. Trials are limited to one per Apple ID.
Cancellation and refunds
Manage or cancel your subscription anytime in iOS Settings > [your name] > Subscriptions; cancellation takes effect at the end of the current period. We do not provide refunds for partial periods. All purchases are processed by Apple, so refund requests are handled by Apple at reportaproblem.apple.com, subject to Apple's policies.
Price changes
We may change subscription prices; any change applies to the next billing period after appropriate notice. Glowcast contains no advertising.
8. Receipt Verification via Apphud
We use Apphud, a third-party service, to manage subscriptions and verify App Store purchase receipts. Apphud receives an anonymous identifier and your purchase/subscription status so we can grant the correct entitlements, as described in our Privacy Policy. We never receive or store your payment-card details — payment is handled entirely by Apple.
9. Acceptable Use
When using Glowcast, you agree not to:
copy, modify, distribute, sell, lease or sublicense any part of the app;
reverse-engineer, decompile or disassemble the app, except where the law expressly permits;
use bots, scrapers or other automated means, or attempt unauthorised access to the app or its systems;
manipulate, misuse or attempt to extract the underlying models behind the AI features;
interfere with, overload or disrupt the app or its infrastructure;
remove or obscure any proprietary notices; or
use the app for any unlawful purpose or in breach of these Terms.
10. Content Usage
Glowcast and all of its content, design, text, graphics, software and trademarks are owned by PocketCraft OÜ or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial purposes only. No rights are granted to our trademarks or branding. The Apple App Store's Licensed Application End User License Agreement (EULA) also applies to your use of the app and prevails in the event of a conflict.
11. User Content and Behaviour
You retain ownership of the photos and information you provide. You grant us a limited licence to process that content solely to provide the app's features to you (for example, to analyse a skin photo as described in our Privacy Policy). You are responsible for the content you submit and confirm you have the right to submit it; you must not provide content that is unlawful or infringes the rights of others.
12. Termination
We may suspend or terminate your access to Glowcast at any time, without notice, if you breach these Terms or use the app in a harmful or unlawful way. You may stop using the app and delete it at any time, which removes the data stored on your device. The "Health, UV & Skin-Analysis Disclaimer", "No Warranties", "Limitation of Liability", "Indemnification", "Content Usage" and "Governing Law and Dispute Resolution" sections survive termination.
13. Eligibility to Agree
You must be at least the age of majority in your country of residence (and at least 13, or 16 in the EEA) and have the legal capacity to enter into these Terms. If you are a minor, you may use Glowcast only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf. Glowcast is not intended for children.
14. Transfer of Rights
You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition or sale of assets. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect, and our failure to enforce a provision is not a waiver of it.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Estonia and applicable European Union law, without regard to conflict-of-law rules. If you are a consumer in the EEA, you keep the benefit of any mandatory consumer-protection rules of your country of residence. We encourage you to contact us first at support@pocketcraft.site so we can try to resolve any dispute informally; EU consumers may also use the European Commission's Online Dispute Resolution platform.
16. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and provide notice in the app. Your continued use of Glowcast after the changes take effect means you accept the updated Terms.
